CHAPTER 8

Commercial Districts

10-8A-1 Purpose

The purpose of the C General Commercial District is to establish areas for general commercial and business activities, areas of employment and a limited number of residential uses located in the second story of general commercial or business activities. (Ord. 313-08, 6-9-2008)

10-8A-2 Compliance With Provisions

In the C General Commercial District, no building or premises shall be used nor shall any building or structure hereafter be erected or altered (unless provided by this title) except for one or more of the uses listed in this article in accordance with the standards provided in this article. (Ord. 313-08, 6-9-2008)

10-8A-3 Uses Permitted

Agriculturally oriented service or sales.

Automobile and equipment repair conducted within an enclosed area screened from public view.

Automobile or motor vehicle sales lot; boat sales lot.

Banks and other financial institutions.

Beauty salons, barbershops and spas.

Cabinet or carpenter shop within an enclosed building.

City public utility facilities.

Farm implement sales and repair.

Garden shop, florist, nursery, greenhouse.

General business offices.

Hospital, medical facilities.

Hotels, motels.

Laundromats.

Lumberyards.

Public or private academic schools.

Public safety and administrative buildings.

Rental facilities; tools and small equipment.

Restaurants, coffee shops, bars and lounges.

Retail stores.

Service station and/or car wash.

Theaters.

10-8A-4 Accessory Uses

Accessory uses are permitted if constructed either at the same time or subsequent to the primary allowed building. Such uses shall be limited to one story in height. Accessory uses for the C District shall be limited to the following:

All PWSFs or WCFs mounted on existing buildings or structures upon issuance of a wireless permit in accordance with the provisions of subsection 10-3-4B and chapter 3, article A of this title.

Attached garages.

Storage building for items directly supportive of business. (Ord. 313-08, 6-9-2008)

10-8A-5 Conditional Uses

The following uses may be considered by the Planning and Zoning Commission in accordance with chapter 3, article A of this title:

Aboveground combustible liquid tanks.

Commercial boarding kennels.

Daycare centers.

Light manufacturing/assembly work conducted within an enclosed building.

Mobile home sales lots.

Nonprofit clubs and lodges of a fraternal order.

Recreational vehicle park.

Retirement, convalescent or nursing home.

Shopping centers.

Storage facilities, personal and commercial. (Ord. 313-08, 6-9-2008)

10-8A-6 Area Requirements

There shall be no minimum lot size. (Ord. 313-08, 6-9-2008; amd. 2018 Code)

10-8A-7 Development Standards

  1. Setback Requirements:
    1. A C use that is adjacent to or across from a residential use must, at a minimum, meet the most restrictive setback requirements governing that residential use for the side of the lot that is adjacent or across from the residential use. Reconstruction of existing residential uses destroyed by fire or natural disaster in the C District, approved through the conditional use permit process, require the same setback requirements as set forth in the R-2 District.
    2. Front yard: Zero feet (0').
    3. Side yards: Zero feet (0').
    4. Rear yard: Twenty five feet (25').
  2. Lot Coverage: Total lot coverage of all buildings on the property shall not exceed sixty percent (60%).
  3. Required Parking: Required parking shall have alley access and meet parking requirements as set out in chapter 12 of this title.
  4. Snow Storage: Snow storage shall be provided either on or off site. A minimum area not less than ten percent (10%) of any parking lot shall be provided for snow storage.
  5. Accessory Structures: Accessory structures shall be located in the rear yard area.
  6. Sidewalks: An eight foot (8') wide sidewalk shall be required at the edge of the street right-of-way abutting each lot. The lot owner/renter shall be responsible for keeping the sidewalk clear and open for pedestrian traffic and for the maintenance, upkeep and reconstruction of said sidewalk. (Ord. 313-08, 6-9-2008)

10-8A-8 Building Height

No building within the C District shall be constructed greater than a height of thirty five feet (35'). (Ord. 313-08, 6-9-2008)

10-8A-9 Signs

Signs in the C District shall be restricted to a maximum size of one and one-half (1 1/2) square feet of area per linear foot of building width, or part of a building occupied by the C use, not to exceed one hundred (100) square feet. Projection of wall signs shall not exceed two feet (2') from the face of the building. Signs may be illuminated by light of constant intensity, but flashing, intermittent, rotating or moving light shall be prohibited. (Ord. 313-08, 6-9-2008)

10-8A-10 Design Review Standards

All new buildings and structures in the C District are subject to design review by the City Planning and Zoning Commission and City Council and shall meet the design review guidelines as set forth in chapter 4 of this title. (Ord. 313-08, 6-9-2008)

10-8B-1 Purpose

The CBD Central Business District is established to promote the health, safety and welfare of current and future residents of the City; to provide a location for groups of compatible commercial uses having the common characteristics of not involving more than incidental and minimal assembly, fabrication or storage of commodities; for example, enterprises dispensing retail commodities and those providing professional and personal services to the individual. The Central Business District is the most intensive commercial district that promotes pedestrian use. (Ord. 313-08, 6-9-2008)

10-8B-2 Compliance With Provisions

In the CBD Central Business District, no building or premises shall be used nor shall any building or structure hereafter be erected or altered (unless provided by this title) except for one or more of the uses listed in this article in accordance with the standards provided in this article. 10-8B-3 Uses Permitted

Artisan shops.

Banks and financial institutions.

Beauty salons, barbershops and spas.

Business and personal services.

City public utility facilities.

Combination commercial and residential use, provided the commercial use is located in the first floor areas, and the residential use is located in the second floor areas.

Grocery stores.

Indoor recreation centers.

Laundromats.

Library.

Post Office.

Professional offices and buildings.

Public offices.

Public parks.

Restaurants, coffee shops, bars and lounges.

10-8B-4 Accessory Uses

Accessory uses are permitted if constructed either at the same time or subsequent to the primary allowed building. Such uses shall be limited to one story in height. One attached or detached accessory use shall be allowed in the CBD District and shall be limited to the following:

All PWSFs or WCFs mounted on existing buildings or structures upon issuance of a wireless permit in accordance with the provisions of subsection 10-3-4B and chapter 3, article A of this title.

10-8B-5 Conditional Uses

The following uses may be considered by the Planning and Zoning Commission in accordance with chapter 3, article A of this title:

Commercial parking lots.

Drive-through businesses.

Hotels, motels.

Medical facilities.

10-8B-6 Area Requirements

There shall be no minimum lot size; except, that existing single-family residential uses destroyed by fire or some natural disaster may be approved for reconstruction through the conditional use permit process. The residence shall follow the same area requirements as set forth in the R-2 District. (Ord. 313-08, 6-9-2008; amd. 2018 Code)

10-8B-7 Development Standards

10-8C-1 Purpose

The BRD Business/Residential District is a moderately intensive district including both offices and high density housing. It serves as a transitional zoning district between residential areas and commercial and industrial areas. (Ord. 313-08, 6-9-2008)

10-8C-2 Compliance With Provisions

In the BRD Business/Residential District, no building or premises shall be used nor shall any building or structure hereafter be erected or altered (unless provided by this title) except for one or more of the uses listed in this article in accordance with the standards provided in this article. 10-8C-3 Uses Permitted

Beauty salons, barbershops and spas.

Bed and breakfast.

Boarding house.

City public utility facilities.

Combination single-family/professional office structures.

Daycare facilities.

Establishments that provide clerical, professional or other skilled services.

Laundromats.

Library.

Medical offices.

Multi-family dwellings that meet the requirements of the R-3 District.

Public offices.

10-8C-4 Accessory Uses

Accessory uses are permitted if constructed either at the same time or subsequent to the primary allowed building. Such uses shall be limited to one story in height. One attached or detached accessory use shall be allowed in the BRD District and shall be limited to the following:

All PWSFs or WCFs mounted on existing buildings or structures upon issuance of a wireless permit in accordance with the provisions of subsection 10-3-4B and chapter 3, article A of this title.

10-8C-5 Conditional Uses

The following uses may be considered by the Planning and Zoning Commission in accordance with chapter 3, article A of this title:

Nonprofit clubs and lodges of a fraternal order.

Places of worship and religious practice.

Post Office.

Retirement, convalescent or nursing home.

10-8C-6 Area Requirements

The minimum lot size requirements shall conform to the requirements set forth in the R-3 Residential District. (Ord. 313-08, 6-9-2008; amd. 2018 Code)

10-8C-7 Development Standards

    2. Side yards: Ten feet (10').
    3. Rear yard: Twenty feet (20').
  2. Lot Coverage: Total lot coverage of all buildings on the property shall not exceed fifty percent (50%).
  3. Required Parking: Required parking shall have alley access and meet parking requirements as set out in chapter 12 of this title.
  4. Snow Storage: Snow storage shall be provided either on or off site. A minimum area not less than ten percent (10%) of any parking lot shall be provided for snow storage.
  5. Accessory Structures: Accessory structures shall be located in the rear yard area.
  6. Sidewalks: An eight foot (8') wide sidewalk shall be required at the edge of the street right-of-way abutting each lot.
