Bed and breakfast facilities.

7.23.01 Definition.

For purposes of this section the meaning of the term "bed and breakfast" shall be as defined under Chapter 2, section 2.01.00 of the New Port Richey Land Development Code.

7.23.02 Conditions for approval.

Every applicant for a bed and breakfast facility will be required to submit to the development services department of the city a petition for a special exception. The submittal must include both a scaled site plan and a scaled floor plan of the property and demonstrate compliance with the following requirements, as well as the general standards for a special exception:

Location. The bed and breakfast facility must be within a structure located in a single-family zoning district or within the downtown zoning district or within the Downtown Residential Overlay District.

Parking. Two (2) parking spaces shall be required for the bed and breakfast facility, and one additional parking space shall be provided for each guest room shown on the floor plan. All parking shall be located on the site, at the rear of the residence if possible. Parking spaces shall conform to the minimum dimensions as required in Chapter 11 of the New Port Richey Land Development Code, but are not required to meet the other design standards listed in section 11.04.00, given the residential nature of the area. Landscaping must be provided for the parking area to the extent practicable. Parking must be designed so as not to have adverse impacts on the surrounding neighborhood.

Number of guests and rooms; size of rooms. A minimum of two (2) bedrooms to be used for guests is required for consideration as a bed and breakfast facility. Bed and breakfast facilities are limited to a maximum of five (5) transient lodging bedrooms or suites in all zoning districts except the downtown zoning district. Bed and breakfast facilities in the downtown zoning district may have up to fourteen (14) bedrooms or suites per acre. Properties located in the downtown zoning district may have a maximum of five (5) bedrooms or suites if the application of the fourteen (14) bedrooms or suites per acre formula results in less than five (5) bedrooms or suites. Occupancy will be limited to two (2) adults per bedroom with a maximum stay of twenty-one (21) days. The minimum size for bedrooms to be used in the bed and breakfast facility shall be one hundred (100) square feet.

Residential quarters. Bedrooms for all permanent residents must be located in areas of the residence which shall not be used by guests.

Bathroom facilities. Separate toilet and shower facilities for the exclusive use of guests must be provided. At least one (1) bathroom for each two (2) guestrooms must be provided.

Signs. Any other sections of the New Port Richey Land Development Code specifically regulating signs notwithstanding, a bed and breakfast facility shall be allowed a four-square-foot sign containing only the name of the proprietor or the name of the residence. The identity of the residence as a bed and breakfast facility shall be allowed by letters not exceeding three (3) [inches] in height. Such signs shall be nonilluminated.

Cooking facilities. No cooking facilities shall be located in guest bedrooms. Furthermore, no cooking in guest bedrooms shall be permitted.

8.

Other conditions. The following conditions should be addressed in the request for a conditional use, and all must be complied with prior to issuance of a local business tax receipt:

a.

No bed and breakfast facility shall be allowed to prepare food for guests unless all applicable approvals have been issued by the county environmental health department and all other applicable local and state agencies. No food shall be sold to non-guests. No alcoholic beverages shall be sold to guests or non-guests.

b.

No bed and breakfast facility shall be allowed which has not received approval from the fire chief, or designee, for compliance with all applicable fire and safety regulations. A guest list containing names, addresses and telephone numbers shall be maintained and made available to the development services department.

c.

All business-related deliveries to the bed and breakfast facility shall be made between the hours of 9:00 a.m. and 4:00 p.m., Monday through Friday.

d.

Check-in and check-out times shall be between 9:00 a.m. and 4:00 p.m.

e.

No local business tax receipt shall be issued for a bed and breakfast facility that is not in compliance with this section and has not obtained a license from the state division of hotels and restaurants pursuant to section 509.271., Florida Statutes.

f.

All bed and breakfast facilities must operate through a national registry as approved by the city.

g.

Refuse containment must be reviewed with and approved by the development services department.

7.23.03 Review and revocation of local business tax receipt.

Failure to operate under the terms of and restrictions as set forth in this chapter may result in a revocation of the local business tax receipt. As a condition of approval, the city council may request a review of the bed and breakfast facility if the city council determines that the bed and breakfast facility has not fulfilled the requirements of this chapter. A one-year review of the bed and breakfast facility may be required as a condition of approval.
