CHAPTER 1

PURPOSE; INTERPRETATION

10-1-1: FINDINGS:

The corporate authorities find that:
   A.   There are no public sewers, no sewage disposal systems, and no provisions for the same, to serve any portions of the Village other than the Wynstone subdivision which has a self-contained system;
   B.   The soil conditions prevailing in the Village repeatedly have led to sewage disposal problems by the use of individual sewage disposal systems (septic systems) on small lots, particularly on lots of less than forty thousand (40,000) square feet in area, presenting a serious hazard to the health and welfare of the residents of the Village and surrounding areas; and
   C.   Said sewage disposal problems are increased by additional sewage disposal systems on lots of less than forty thousand (40,000) square feet in area in proximity to the other lots having individual sewage disposal systems (septic systems). (1977 Code § ZR-1-1)

10-1-2: SCOPE OF REGULATIONS:

It shall be unlawful within the corporate limits of the Village to do, conduct or allow any of the following except as provided by this title and after obtaining written permission from the enforcing officer:
   A.   To establish any use of a building, structure or land, either by itself or in addition to another use.
   B.   To expand, change or reestablish any nonconforming use.
   C.   To excavate for any lake, pond, swimming pool, building, foundation, sewer, water conduit, well, septic tank, grease trap, disposal field or drain.
   D.   To alter, redirect or materially change the course of any creek, river or stream.
   E.   To erect, construct, alter, add to or move any building, structure or part thereof, or install any new siding. (1977 Code § ZR-1-2)
   F.   To erect fences except as permitted pursuant to chapter 11 of this title, as said chapter may be amended from time to time. (Ord. 1064, 7-25-2005)
   G.   To rebuild, structurally alter, add to or relocate any building or structure or part thereof. (1977 Code § ZR-1-2)

10-1-3: INTERPRETATION:

   A.   Minimum Requirements: The provisions of this title shall be held to be the minimum requirements for the promotion of the public health, safety, morals, comfort and general welfare.
   B.   Nonconflicting Provisions: It is not intended by this title to interfere with, abrogate, annul or repeal any ordinance, resolution, rule or regulation heretofore adopted which does not conflict with the provisions of this title.
   C.   Conflicting, More Restrictive Provisions: This title shall not nullify the more restrictive provisions of covenants, agreements, resolutions, other ordinances, this code or other laws, but shall prevail notwithstanding such provisions which are less restrictive. (1977 Code § ZR-1-3)

10-1-4: VALIDITY:

Should any section, clause or provision of this title be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of this title as a whole, or any part hereof, other than the part so declared to be invalid. (1977 Code § ZR-1-11)
