CHAPTER 5

PARKING AND STORAGE OF MOBILE HOMES, TRAILERS, BOATS AND VEHICLES

10-5-1: SCOPE:

This chapter refers to and regulates any vehicle ordinarily classed or similarly defined as a "truck", "recreational vehicle", "boat", "trailer", "mobile home" or "inoperable vehicle". The definitions herein shall supplement and take precedence over similar definitions in chapter 2 of this title. (1977 Code § ZR-12-1)

10-5-2: PARKING AND STORAGE REGULATIONS:

   A.   Compliance With Provisions: Trucks, recreational vehicles, mobile homes, trailers and boats may not be parked or stored on any property within the Village except pursuant to the provisions and restrictions of this section and this title.
   B.   Storage; Shielding Requirements: No truck, recreational vehicle, trailer or boat shall be stored on any tract or parcel unless totally shielded from the view of other properties and public streets; provided, however, that a boat need not be so shielded when located on the bank of the pond or lake on which it is used. Shielding may be provided by residences, legal fencing, garages, legal storage buildings or landscaping and plantings when such screen provides a total year round shielding. Such storage shall constitute an "accessory building or use", as defined in this title, and must conform to all applicable sections of this title including setback requirements and provisions relative to incidental uses. Vehicles totally and legally "shielded" shall be permitted unlimited storage or parking within said shielding without a parking permit.
   C.   Unshielded Mobile Homes, Trailers, Boats And Vehicles:
      1.   Making Deliveries; Providing Services: Trucks, other commercial vehicles or contractors' equipment not so shielded may be parked on any tract or parcel when making a delivery or rendering a service at such site. The parking of a truck or contractors' equipment by the owner or operator of such vehicle or equipment at his place of residence shall not constitute the making of a delivery or the rendering of a service if such parking exceeds four (4) hours in any twenty four (24) hour period.
      2.   Loading And Unloading: Trucks, recreational vehicles, trailers or boats not so shielded may be parked on the resident's own tract or parcel off of the road right of way, for purposes of loading and unloading for a period or periods not to exceed four (4) nonconsecutive two (2) day periods in any calendar month, without permit. Parking for longer periods is permitted upon issuance of an annual permit to the property owner as provided in this chapter. Such annual permit parking is limited to a maximum of fourteen (14) consecutive (permit and nonpermit) days and no more than an aggregate of forty five (45) days in any three hundred sixty five (365) day period commencing with the date of the issuance of the permit to the property owner.
      3.   Mobile Homes:
         a.   A mobile home not so shielded may be parked for a period not to exceed fourteen (14) days upon issuance to the property owner of a permit as provided in this chapter. Temporary parking for a period in excess of fourteen (14) days may be permitted only by action of the Village Board.
         b.   A mobile home not so shielded may be used as a temporary office or shelter incidental to construction or development of parcels within a subdivision. Such mobile home may be placed within the subdivision only during the time construction or development is actively under way, and in no event shall such mobile home be located on the premises for a period in excess of one year unless permitted by action of the Village Board. No more than one mobile home for such purpose shall be permitted within any subdivision.
      4.   Storage Trailers: Storage trailers not so shielded may be used incidental to construction of parcels within a subdivision. Such trailers may be placed within such subdivision only during the time construction or development is actively under way, and in no event shall such storage trailers be located on the premises for a period in excess of one year unless permitted by action of the Village Board.       5.   Inoperable Vehicles: No automobile or truck that is in an inoperative condition as defined by section 7-9-1 of the Village Code or not displaying valid license plates shall be parked or stored for more than ten (10) days on any tract or parcel except in an enclosed garage. All repairs, other than minor, of such inoperative vehicles shall be accomplished within an enclosed garage. (1977 Code § ZR-12-2; amd. Ord. 1308, 9-27-2017)
   D.   Heliports: No heliports are permitted. (1977 Code § ZR-12-2)

10-5-3: TEMPORARY PARKING PERMIT:

   A.   Issuance: On written request by the resident within forty eight (48) hours of arrival, the Village Clerk will issue, without cost, a permit for the temporary parking of a truck, recreational vehicle, trailer, boat or mobile home.
   B.   Scope Of Permit:
      1.   Truck, Recreational Vehicles And Boats: A permit for the temporary parking of a truck, recreational vehicle, trailer or boat shall cover periods when such vehicle is actually on the premises as represented to the Village Clerk by the owner or occupier of the property on which the vehicle is parked, but not to exceed forty five (45) days in any three hundred sixty five (365) day period nor more than fourteen (14) consecutive days in any one period. New permits may be issued at the end of each three hundred sixty five (365) day period.
      2.   Mobile Homes: A permit for the temporary parking of a mobile home shall cover a single period not to exceed fourteen (14) days and may not be renewed.
   C.   Display Of Permit: Permits shall be kept in or attached to the vehicle for which the permit was issued on the portion of the vehicle nearest to a public road. (1977 Code § ZR-12-3)

10-5-4: VARIATION FROM PROVISIONS:

Any person making application for a variation from the provisions of this chapter shall be required to comply with all requirements of chapter 12 of this title, including but not limited to a hearing before the Zoning Board of Appeals, service of written notice on all properties within two hundred fifty feet (250') at least ten (10) days prior to the hearing, and the publication of the notice of such hearing not less than fifteen (15) days prior to the date thereof, provided that the fee for such application shall be three hundred dollars ($300.00). 10-5-5: ENFORCEMENT:

Enforcement of this chapter shall be by the enforcement agency as so designated by the Village. (1977 Code § ZR-12-4)
