§ 107-21.1

R-1U Residence Utility District.

A. 
Permitted principal uses are as follows:
(1) 
Single-family detached dwellings used as a residence by not more than one family limited to one dwelling per lot
(2) 
Electric transmission towers and cables as regulated by the Board of Utilities.
(3) 
Wireless communications facilities with antennas attached to existing electric transmission towers.
B. 
Accessory uses.
(1) 
Required accessory uses for residential uses are as follows:
(a) 
Private garages intended for the shelter and storage of motor vehicles and providing off-street parking as required in § 107-20 of this article.
(2) 
Permitted residential accessory uses are as follows:
(a) 
Private swimming pools on residential lots in accordance with § 107-21B(2)(a).
(b) 
Private tennis courts on residential lots in accordance with § 107-21B(2)(b).
(c) 
Home-based business operations in accordance with § 107-21B(2)(c).
(3) 
Permitted residential accessory buildings are as follows:
(a) 
Accessory buildings on residential lots in accordance with § 107-21B(3).
C. 
Residential height restrictions. Height restrictions for residential dwellings shall be in accordance with § 107-21C.
D. 
Residential area, yard and building requirements. The bulk requirements for residential dwellings shall be in accordance with § 107-21D.
E. 
Requirements for non-residential lots are as follows:
(1) 
Minimum lot area: 20,000 square feet.
F. 
Requirements for wireless communications antennas and equipment are as follows:
(1) 
Wireless communications and equipment installed in accordance with this section shall be exempt from § 107-12.
(2) 
The collocation of wireless communications antennas shall only be permitted on existing electric transmission towers.
(3) 
Applications for wireless communications antennas and equipment shall be subject to administrative review and approval by the Borough Engineer.
(4) 
Wireless communications antennas and equipment shall not increase the height of the existing electric transmission tower by more than 10% or 20 feet, whichever is greater.
(5) 
Wireless communications antennas shall not be located within 15 feet of any lot line.
(6) 
Equipment compounds for wireless communications facilities shall not be located within 15 feet of any lot line and shall be screened with six- to eight-foot high solid fencing and supplemented with plantings subject to the review and approval of the Borough Engineer and as permitted in accordance with N.J.A.C. 14:5-9.6.
(7) 
Ground-mounted wireless communications equipment shall not exceed a height of 15 feet.
(8) 
No commercial, brand or advertising signs may be located on wireless communications facilities. Safety and regulatory signs required by other public agencies shall be permitted.
(9) 
Any antennas and equipment that are abandoned, discontinued or otherwise not in use shall be removed within six months of being unused. The wireless provider shall notify the Borough within one month of abandonment or discontinuance indicating the proposed removal timeframe which shall be agreed upon by both parties. Failure to notice or remove such antennas or equipment within the prescribed timeframe will result in fines up to $1,000 per day of violation.
(10) 
Wireless providers shall prioritize the collocation of antennas on towers with existing antennas and shall only be permitted to place antennas on new towers when the provider can scientifically demonstrate that such placement is necessary to provide service.
