The Neighborhood Business District is created to provide for the retailing of convenience goods and essential personal services in order to satisfy the daily and weekly household and personal needs of the surrounding residential neighborhoods.
In an NB District, the following uses shall be classed as conditionally permitted uses and may be permitted by the Board of Zoning Appeals subject to the general conditions as set forth in §§ 153.520 through 153.586, and the following specific conditions:
(A) Automobile automatic wash stations (see § 153.282 for general conditions).
(B) Service stations (see § 153.282 for general conditions).
(C) Child day-care center/Type A family day-care home (see § 153.117).
(D) Bar:
(1) It must have a minimum lot area of 20,000 square feet.
(2) The structure setback shall be at least 35 feet from any residential property and a solid fence, wall or hedge six feet in height shall be provided on any side of the site adjacent to a residential property.
(3) Shall comply with the current state liquor license requirements for allowed distances from churches, schools or similar institutions.
(4) Access shall be from an arterial street or shall be provided in a manner that does not cause heavy traffic on residential streets.
(5) An assessment shall be made of the probable effects of the proposed facilities parking
provisions and evening operations on the surrounding area.
(E) All other requirements of the NB District shall be met.
The following yard requirements shall apply to all yards in the Neighborhood Business District:
(A) Front yard - setback of 50 feet from the road right-of-way line. A 15 feet deep unobstructed open buffer strip shall be provided next to the right-of-way and parking in this strip shall be prohibited.
(B) Rear yards - 40 feet.
(C) Side yards:
(1) Minimum side - ten feet where there is no rear access.
(2) Abutting a street - 25 feet from road right-of-way line.
(3) Abutting a residential zone - a 20 foot unobstructed buffer strip suitably landscaped.
(D) Access ways - each lot shall have not more than two access ways to any one street or highway with not less than a 45 foot separation between centerlines. The width of the access ways leading to or from a highway shall be not less than 20 feet nor shall it exceed 36 feet. No access ways shall be closer than 70 feet to the right-of-way side lines.
