CHAPTER 10

PK PARKING DISTRICT

4-10-1: PURPOSE:

The PK Parking District is designed to designate areas which may be used only for parking as distinguished from areas where parking is a part of the use of the parcel on which is located a structure.

4-10-2: USES PERMITTED:

Land designated PK Parking may be used only for the temporary parking of automobiles brought to the site as conveyances for persons using establishments in C-1, C-2 and O areas.

4-10-3: PROCEDURE FOR DEVELOPER:

All requests for PK Parking zoning shall comply with procedures as set forth in Section 2-1-8 of this Code.

4-10-4: DESIGN AND CONSTRUCTION STANDARDS:

   A.   Generally: Areas designated PK Parking must conform to construction standards as required in Section 4-13-3-2 of this Title; except that all parking spaces shall be open to the sky unless otherwise approved by the Zoning and Planning Commission and the Board of Trustees.
   B.   Setbacks, Screening And Landscaping: All PK Parking requests shall be accompanied by a dimensioned and detailed site plan which shall indicate all setbacks, screening and landscaping as required herein 1 . The site plan shall also show all alleys and streets surrounding the site as well as the property, with all existing or proposed buildings, which the PK Parking lot is intended to serve.
      1.   Setbacks: There shall be a ten foot (10') setback from the property line facing any street to the finished surface of the parking area.
      2.   Screening:
         a.   There shall be a masonry wall of not less than five feet (5') nor more than six feet (6') in height, constructed of the same face brick material used on the principal building being served by the PK Parking lot where the PK Parking lot abuts any residence district. Use of masonry materials other than those used for the principal building will be permitted if approved by the Zoning and Planning Commission and the Board of Trustees.
         b.   Where a public alley exists between the parking area and a residence or residence district, a wall or fence and densely compact hedge, as determined by the Zoning and Planning Commission, of not less than five feet (5') nor more than six feet (6') in height, is required.
         c.   Where the public alley is used for ingress and/or egress to the parking area, the screening shall be installed under the direction of the Director of Office of Community Development and Growth Management , consistent with safe traffic ingress/egress practices.
         d.   A variation from the height limitations, set forth in subsections B2a and B2b of this Section, may be applied for and granted; provided that a finding is made as to each of the following conditions:
            (1)   That the plight of the petitioner for the variation is caused by unique circumstances; and
            (2)   That the variation, if granted, will not alter the essential character of the immediate surrounding area; and
            (3)   That a wall or fence and densely planted compact hedge, in full compliance with the maximum or minimum height limitations of either subsection B2a or B2b of this Section (whichever is applicable), would not adequately serve the same purposes as a wall or fence and densely planted compact hedge of increased or decreased height; and
            (4)   That strict adherence to the height limitation requirements of either subsection B2a or B2b of this Section would cause particular hardship upon the petitioner for the variation.
All requests for the aforementioned variation shall be heard by the Zoning and Planning Commission as a special petition.
      3.   Landscaping: There shall be a five foot (5') wide landscaped buffer strip wherever the parking lot abuts a residence district. The required wall or fence/hedge, as provided above, shall be part of the landscaped area.

4-10-5: PERFORMANCE STANDARDS:

Areas zoned PK Parking are subject to the applicable performance standards listed in Section 4-8-8 of this Title.

4-10-6: RESTRICTIONS:

   A.   Commercial Or Office Use: No area may be designated PK Parking to serve a commercial or office use unless the land is or will be owned by the owner of the commercial or office use. The Village shall require such covenants as are necessary to ensure that the land designated PK to serve a specific use will remain available for that and subsequent uses indefinitely.
   B.   Use As A Building Prohibited: Land designated PK Parking cannot be used for a building or structure of any kind, but may be counted toward the parking requirement for the C-1, C-2 or O use which it serves. (Ords. 75-10-55, 77-29-48, 81-36-77, 87-17-70, 92-11-45, 93-9-24, 19-16-66)
