ARTICLE VII

R-4 Special Moderate-Density Residential District

§ 455-7.1 Purpose.

The R-4 Special Moderate Density Residential District is hereby established in order to provide for moderate residential, compatible nonresidential uses, agricultural, public recreation, and appropriate accessory uses while protecting environmentally sensitive areas of land and streams without significant intrusion. The R-4 Zoning District shall include land exhibiting steep slopes, high landslide risk, as well as land in close proximity to natural watercourses. In addition, this classification of land provides for agricultural and public recreation opportunities and other compatible nonresidential uses where conditions are met.
Refer to Section XIV, Supplemental Regulations, for review of additional regulations which may pertain to the proposed use.

§ 455-7.2 Permitted uses.

A lot or parcel may be used and a building or structure may be erected and used for any of the following purposes:
Principal uses:
Agricultural operations. (See § 455-15.10.)
Single-family dwellings.
Municipal parks.
Group home, as defined.
Accessory use. (See § 455-15.19.)
Private garages.
Garden or storage sheds and shelters.
Essential services, as defined.
Satellite dishes, dish and radio antennas. (See § 455-15.31.)
Swimming pools.
Signs. (See Article XVI.)
Fences, walls and retaining walls. (See § 455-15.12.)
No-impact home-based business. (See § 455-15.22.)
Amateur radio communications towers. (By special exception; see § 455-15.40.)
Solar energy facility. (See § 455-15.36.)
Wind energy facility. (See § 455-15.37.)
Geothermal energy facility. (See § 455-15.39.)
Extended family living area.
Pool house.
Model farms. (See § 455-15.11.)
Keeping of domesticated chickens. (See § 455-15.43.)

§ 455-7.3 Conditional uses.

A lot or parcel may be used and a building or structure may be erected and used for any of the following purposes, subject to the granting of a conditional use pursuant to procedures established by this chapter.
Fire and emergency medical equipment facilities.
Public utility facilities.
Parks (public recreation). (See § 455-15.33.)

§ 455-7.4 Planned development uses in R-4.

A lot or parcel may be used and a building or structure may be erected and used subject to the granting of tentative and final approval of a planned development pursuant to the procedures established by this chapter.
Lot averaging "LA" developments. (See Article XII.)

§ 455-7.5 Parking requirements.

All uses requiring off-street parking shall comply with the provisions of Article XV applicable to that use.

§ 455-7.6 Lot area, yard and height requirements.

The minimum lot areas, minimum lot width, minimum front yard, minimum width of each side yard and the maximum height for permitted principal uses shall be as follows:
Minimum lot area: 30,000 square feet.
Minimum lot width: 125 feet.
Minimum depth front yard: 40 feet.
Minimum depth rear yard: 40 feet.
Minimum width side yard: 20 feet.
Maximum height of structure: 30 feet.
Bulk: maximum building coverage: 20%.
Permitted accessory structures shall be located no closer than 10 feet to the side or rear property line.
Conditional uses shall be situated on lots in compliance with the minimum area, dimensions and setbacks established for permitted uses.

§ 455-7.7 Performance standards.

All permitted, conditional and accessory uses shall comply with the performance standard provisions of Article XVIII applicable to that use.
A traffic study shall be required for all nonresidential uses or developments which generate 50 or more a.m. or p.m. peak-hour trips and for all residential uses or developments which generate 100 or more average weekday vehicle trip ends.
The study shall be prepared pursuant to the provisions of § 455-19.2.

§ 455-7.8 Permits.

A zoning/building permit shall be required prior to the erection, construction or alteration of any structure proposed in relation to those uses enumerated in this article.
