Off-Street Parking and Loading
§ 103-49 When off-street parking required.
Off-street parking space shall be required for all buildings constructed or new uses established after the effective date of this chapter. Each off-street space shall consist of at least 200 square feet, with a minimum width of 10 feet and depth of 20 feet. In addition, space necessary for aisles, maneuvering and drives shall be provided. Parking requirements are specified in § 103-50.[1]

§ 103-50 Off-street parking schedule.

The following schedule is established for off-street parking spaces:

§ 103-51 Required off-street loading.
A.
At least one off-street loading space shall be provided for each commercial or industrial establishment hereafter erected or substantially altered to have a gross floor area in excess of 5,000 square feet, computed as described below. Space for off-street loading shall be in addition to space for off-street parking.
B.
Each off-street loading space shall be subject to the following minimum requirements:
(1)
Each berth shall be not less than 12 feet wide, 40 feet long and 14 feet in height when covered.
(2)
Off-street loading space (or spaces) located within 50 feet of a residential property shall be shielded by a wall, fencing or other suitable material which shall serve to screen noise and uncontrolled entrance.
§ 103-52 Required driveways and aisles.
Except for one-, two-, three- or four-family dwellings, all parking spaces required by this chapter shall be accessible from a public street by a driveway or aisle which shall conform to the following minimum requirements:
A.
No space in any required driveway or aisle shall be counted toward satisfying the parking requirements of this chapter.
B.
Driveways serving parking areas containing eight or fewer parking spaces shall be a minimum of 12 feet in width, while those serving nine or more parking spaces or one or more loading spaces shall be a minimum of 24 feet in width. No parking space shall have direct access to a driveway.
C.
Aisles providing access between parking and loading spaces and driveways shall be a minimum of 24 feet in width.
D.
Driveways and aisles shall have a minimum vertical clearance of 14 feet, clear of any obstruction.
E.
Entrances to a public street shall be no narrower than the driveway or aisle they serve nor more than 36 feet in width, except where lane dividers are installed to segregate entering, existing or turning traffic or where the aisle served exceeds 36 feet in width.
§ 103-53 Protection to buildings.
Wherever any driveway, aisle, parking space or loading space is adjacent to or within two feet of any building wall, a guardrail or other suitable protection consistent with the level of use, as determined by the Town Planning Board, shall be installed. This provision shall not apply to one- and two-family dwellings.
§ 103-54 Required paving.

Parking and loading spaces, driveways and aisles serving or located in a parking area containing eight or fewer spaces shall be paved with at least a suitable base of compacted gravel. Paving requirements for those spaces, driveways and aisles with more than eight spaces shall conform to the following requirements:
A.
In the R-80 and R-40 Districts, a suitable base of compacted gravel shall be required.
B.
In the R-20 and R-10 Districts, a suitable base of compacted gravel shall be required for the following uses:
(1)
Dwelling units of fewer than 10 per site.
(2)
Rooming houses and tourists homes.
(3)
Administrative, professional, institutional or utility offices with fewer than 20 spaces.
(4)
Nursing homes with fewer than 20 spaces.
(5)
Wholesale, storage, freight terminal or utility use with fewer than 20 spaces.
(6)
Home occupations.
(7)
Churches or temples.
C.
In the R-20 and R-10 Districts with the following uses, parking areas shall be paved to at least the standards of a local street:
(1)
Dwelling units of 10 or more per site.
(2)
Administrative, professional, institutional or utility offices with 20 or more spaces.
(3)
Nursing homes with 20 or more spaces.
(4)
Wholesale storage, freight terminal or utility use with 20 or more spaces.
(5)
Funeral homes.
(6)
Schools.
(7)
Theaters or other places of assembly.
(8)
Retail store or banks.
(9)
Clubs and restaurants.
(10)
Bowling establishments.
(11)
Industrial or manufacturing uses.
(12)
Drive-in restaurants.
(13)
Commercial or shopping centers.
(14)
Commercial garage.
D.
In the B-1, B-2, ID, ID-2, HDD, MHD and all PDD Districts, parking areas shall be paved to at least the standards of a local street.
E.
Any use(s) in the R-20 or R-10 District which have not been included above shall be reviewed by the Planning Board to determine whether a base of compacted gravel is sufficient or whether the area(s) should be paved. In making this decision the Planning Board shall consider the number of spaces and/or driveway area the use has, the frequency of use the proposed use gets, the type of use the proposed use gets (heavy truck, buses, vans or cars) and the type of business or use on the site.
F.
All parking areas of nine or more spaces that are required by this Code to be paved to the standard of a local street must be striped with semipermanent clearly visible painted lines delineating the approved size, location and number of the parking spaces as shown on the site or sketch plan approved by the Town Planning Board or the Town Board. Required regular maintenance of the striping includes the repainting of these lines, as needed, to the same width and length as originally approved.

§ 103-55 Required maintenance.
All required parking and loading spaces, driveways and aisles shall be maintained to at least the standard of original construction by the property owner.
§ 103-56 Drainage.
All parking areas, driveways and aisles shall be graded to permit drainage either by surface or by storm drains of suitable capacity and shall cross adjacent property only by way of a drainage easement to natural watercourses or collective storm sewers.
