ARTICLE V
R-20 Residential District Regulations
§ 103-19 Purpose and intent.
The general purpose and intent of this residential district is to provide for areas within the Town of Oneonta where the living environment associated with single-family and two-family residential development and their related facilities can be preserved and/or where the development of such an environment is encouraged. In promoting the general purpose of this chapter, the specific intent of this Article is:
A.
To encourage the construction of and the continuous use of the land for single-family and two-family residential dwellings; to encourage the development of recreational, religious and educational facilities required for and compatible with a balanced single- and two-family residential neighborhood; and to permit home occupations.
B.
To discourage all business, commercial and industrial development of the land and multiple-family units and developments such as mobile home parks, and to prohibit any other use which would substantially interfere with or be deleterious to the development and continuation of single- and two-family dwellings in this residential district.
C.
To discourage all land uses which would generate traffic on residential streets other than normal traffic to the residences on those streets.
§ 103-20 Permitted uses.
The following uses are permitted in the R-20 Residential District:
A.
One-family homes, but not including mobile homes.
B.
Two-family dwellings.
C.
Home occupations.
§ 103-21 Uses requiring sketch plan review or site plan review and special use permit.

A.
The following uses are subject to sketch plan review or site plan review, at the discretion of the Planning Board (see Article XVI):

Public and semipublic uses.
B.
The following uses may be undertaken in the R-20 Residential District only upon a special use permit being obtained:

Nursing, convalescent or proprietary home for adults and like uses.

The following regulations apply to all uses permitted by right, after sketch plan review or site plan review and by special permit.

B.
Increasing front yard depth. Front yard depth along collector and arterial roads shall be increased to 50 feet except where existing development occurred prior to the enactment of this chapter. In those cases, the front yard depth may be the average of the front yard depth for 250 feet on both sides of the proposed use along the contiguous street line.
C.
Determining front yard depth. Where no right-of-way or street line information is readily available to determine the point from which front yard depth shall be measured to the building line, the front yard depth shall be that number of feet indicated in Subsection A plus 25 feet from the center line of the street.
D.
Increasing side yard depth. On a corner lot the minimum side yard requirement shall increase to 25 feet for the side yard between the street line and the building line on the side street.
E.
Lot coverage. No more than 25% of the lot may be covered by buildings. This includes garages and accessory buildings.
F.

G.
Garages, accessory buildings and parking areas.
(1)
Attached garages must meet setback and yard requirements listed above for principal buildings.
(2)
Detached garages, parking areas and accessory buildings must meet the front setback requirements for the principal building and must leave a minimum side yard depth of eight feet and a minimum rear yard depth of 10 feet.

H.
Building height. No building shall be erected to a height in excess of 35 feet except upon approval of a special permit by the Board of Appeals.
I.
Family. The provisions of § 103-14H of the Town Code of the Town of Oneonta shall also apply, and reference is hereby made to such provision as if more fully set forth below.
