CHAPTER 7

ZONES; MAP

8-7-1: ADOPTION OF ZONING MAP:

   A.   Purpose: The purpose of this chapter is to adopt a zoning map, which is in conformity with the plan map and which will provide notice to Payette County residents of various zones in unincorporated areas.
   B.   Adoption: A map entitled "the zoning map for Payette County, Idaho", a copy of which shall be kept on file with the planning and zoning administrator is hereby adopted.
      1.   Payette County is zoned in accordance with said map, which map shall be sufficient to show the location of various zones throughout Payette County.
      2.   Said map shall be made available to the public during normal working hours of the planning and zoning administrator and upon request shall be copied for a reasonable fee.
   C.   Rezoning: Whenever a tract of land is rezoned, the map should be updated, but failure to do so shall not render the map nor this title invalid. Maps which are updated shall be deemed adopted with the ordinance approving rezoning, and which updated map shall not require a separate ordinance of adoption.
   D.   Relief Action: Any person who has actual or constructive knowledge that a particular parcel, lot, tract or area is zoned in a particular manner, shall not be allowed to rely upon the fact that maps are not updated when applying for relief action under this title. (Ord. 2009-03, 6-15-2009)

8-7-2: INTERPRETATION OF ZONE BOUNDARIES:

   A.   Where zone boundaries are indicated as approximately following the centerline of street lines, highway right of way lines, streams, lakes or other bodies of water, the centerline shall be construed to be such boundary;
   B.   Where zone boundaries are so indicated that they approximately follow the lot lines, such lot lines shall be construed to be said boundaries;
   C.   Where zone boundaries are so indicated that they are approximately parallel to the centerlines or right of way lines of highways, such zone boundaries shall be construed as being parallel thereto and at such distance therefrom as indicated on the official zoning map. If no distance is given, such dimensions shall be determined by the use of the scale shown on the official zoning map; and
   D.   Where the boundary of a zone follows a railroad line, such boundary shall be deemed to be located in the middle of the main tracks of said railroad line. (Ord. 57, 4-18-1988)
