CHAPTER 8

PERMITTED USES

8-8-1: PURPOSE:

For the purpose of this title, the various uses of buildings and premises shall be classified as follows, provided however, that a use herein set forth as permitted in any zone classification shall be deemed to be excluded from any other zone unless such use is specifically permitted in that zone, or is found to be a conditional use. 8-8-2: ZONE A (AGRICULTURAL):

   A.   Purpose: The purpose of the A zone is to preserve and protect the decreasing supply of agricultural land. This zone also is established to control the infiltration of urban development into agricultural areas which will adversely affect agricultural operations.
   B.   Uses: The following uses are permitted in A zones:
      1.   Permitted Uses: One single-family dwelling which may be located on a tract no smaller than forty thousand (40,000) square feet and which is subject to all standards adopted by this code, garden buildings and accessory structures. Cultivation, harvesting, storage and sale of crops, vegetables, fruits, plants, flowers and nursery stock produced on the premises. Plant and material nursery. Animal production subject to CAFO ordinance. One accessory dwelling unit which is located on a tract no smaller than two (2) acres, subject to all standards adopted by this code for a single-family dwelling unit, and shall be subject to the following requirements, conditions, restrictions, and limitations:
         a.   The lot must already have a permitted single-family dwelling;
         b.   Accessory dwelling unit must not exceed one thousand five hundred (1,500) square feet;
         c.   Accessory dwelling shall not be occupied without a valid occupancy or use permit;
         d.   The nearest corner or wall of the accessory dwelling unit must be built within two hundred (200) feet of the primary residence;
         e.   Shall use the same ingress and egress as the primary residence and shall share an address with the primary residence but be differentiated by A and B designations;
         f.   Property line setbacks shall be in accordance with section 8-10-3 of this title; and
         g.   Accessory dwelling units must remain on the same parcel as the primary residence, and the parcel shall not be reduced to less than two acres.
      2.   Permitted With Conditional Use Permit: Radio and television transmitting stations, private airstrip, home occupations, preschool nurseries, gravel pits, on site extractive manufacturing and quarries, riding stables, kennels, and cell towers.
      3.   Permitted Through Conditional Use and Requiring An Engineered Plat: Cemeteries, fairgrounds, commercial packing plants for farm crops, veterinary or animal hospital. (Ord. 2009-03, 6-15-2009; amd. Ord. 2021-04, 9-13-2021)

8-8-3: ZONE B (RECREATIONAL):

   A.   Purpose: The purpose of the B zone is to encourage the development of areas dedicated to leisure and recreational purposes.
   B.   Uses: The following uses and no others are permitted in all B zones:
      1.   Hunting preserves, firing ranges, picnic areas, public parks, playgrounds, wildlife refuges, and other public recreational areas owned and operated by governmental or nonprofit organizations.
      2.   Other uses related to or incidental to the primary uses set forth in this section. (Ord. 2009-03, 6-15-2009)

8-8-4: ZONE R (RESIDENTIAL):

   A.   Purpose: The purpose of the R zone is to permit the establishment of low density, single-family dwellings, on lots of not less than three (3) acres per dwelling unit. Community water and sewer facilities may be required as set out in section 9-7-1 of this code.
   B.   Uses: The following uses are permitted in all R zones:
      1.   Row crops, grazing, orchards and gardens; farm, ranch and garden buildings and accessory structures.
   C.   Uses Permitted With Engineered Plat: The following uses are permitted in all R zones accompanied by an engineered plat:
      1.   Churches and church schools.
      2.   Public parks, playgrounds and other public recreation areas owned and operated by governmental or nonprofit organizations; public utility mains and substations but not including public offices or repair or storage facilities.
      3.   Single-family dwellings and two-family dwellings, including modular homes, subterranean dwellings, and any other residential structure permissible by building code; residential subdivisions, subject to all zoning and subdivision requirements; multi-family dwellings.
      4.   Also permitted with an engineered plat by conditional use permit: College and private schools, dormitories, sorority and fraternity houses, public schools, assembly clubs, lodge buildings, membership clubs, preschool age nurseries, hospitals, rest homes, convalescent homes and nursing homes, clinics, cemeteries.
      5.   Other uses related to or incidental to the primary uses set forth in this section, including, but not limited to, storage garages, incinerators, identification signs, home occupations and private swimming pools.
      6.   Other compatible uses permitted by conditional use permit and public hearing process. (Ord. 2009-03, 6-15-2009)

8-8-5: ZONE C-1 (COMMERCIAL 1):

   A.   Purpose: The purpose of the C-1 zone is to permit the establishment of those businesses which historically have a low volume of people and with limited traffic. Local businesses permitted in C-1 zones shall include tracts devoted to small clusters of low volume retail and personal service shops, but do not include tracts devoted to manufacturing, wholesaling or industrial purposes.
   B.   Uses: The following uses are permitted in all C-1 zones accompanied by an engineered plat:
      1.   Bakery shops; cabinet shops; cemetery; equipment rental, equipment sales; furniture refinishing; commercial laundry plant; medical, dental or optometric laboratory; mortuary; nursery; commercial printer; sign shop; radio and appliance repair shop; residential storage units; medical offices, dental offices, optometric offices; drugstores; gift shops.
      2.   Other compatible uses permitted by conditional use permit and public hearing process. (Ord. 2009-03, 6-15-2009)

8-8-6: ZONE C-2 (COMMERCIAL 2):

   A.   Purpose: The purpose of the C-2 zone is to permit the establishment of those convenience businesses which historically have a high volume of people or walk-in traffic. Local businesses permitted in C-2 zones shall include tracts devoted to small clusters of high volume retail and personal service shops, but do not include tracts devoted to manufacturing, wholesaling or industrial purposes.
   B.   Uses: The following uses are permitted in all C-2 zones accompanied by an engineered plat:
      1.   Medical clinics, medical institutions, professional offices; motels, hotels, apartment buildings, recreational parks; automobile sales lots; banks, savings and loan institutions; service stations, garages, automobile, or motor vehicle repair, tire shops; personal service shops, barbershops, beauty shops; restricted retail businesses not of an industrial or manufacturing nature; amusement or recreation centers, auditoriums, membership clubs, assembly clubs; parts buildings, building supply outlets; establishments offering food and beverages; studios, dance studios, theaters, places of entertainment, bowling alleys; car washes; churches; retail outlets; laundromats; nursing homes, daycare facilities; equipment rentals; food stores.
      2.   Other compatible uses permitted by conditional use permit and public hearing process. (Ord. 2009-03, 6-15-2009)

8-8-8: ZONE I-1 (LIGHT INDUSTRIAL):

   A.   Purpose: The purpose of the I-1 zone is to encourage the development of manufacturing and wholesale business establishments which are clean and quiet with minimal hazardous or objectionable elements such as noise, odor, dust, smoke or glare and are operated primarily within enclosed structures. This zone is further designated to act as a transitional use between heavy commercial uses and other more intense industrial uses.
   B.   Uses: The following uses are permitted in all I-1 zones accompanied by an engineered plat:
      1.   Research activities; supply yards, building yards; sugar beet dumps; manufacturing facilities for cosmetics, pharmaceuticals, toiletries; manufacturing facilities for food products, sauerkraut, vinegar, and yeast, excluding fish or meat products; manufacturing of electrical equipment including electric signs; manufacturing of optical goods and precision instruments; above and below ground storage of bulk products; storage and sale of grain, livestock feed or fuel, provided dust is effectively controlled; wholesale houses, storage and warehouses; bag, carpet and rug cleaning, providing necessary equipment is installed and operated for the effective prevention of dust; blacksmith, welding or other metalworking shops, excluding any machine making noise to such a degree to cause a nuisance outside the physical plant; casting lightweight nonferrous metals, or electric foundries not causing noxious fumes or odors; ice manufacturing and cold storage plants, creamery and bottling plants; commercial packing sheds for farm crops; bottling works; lumberyards and cement and concrete sales establishments; dairy processing and distribution plants; commercial meatpacking plants; machine shops, plumbing shops, tin and sheet metal shops; storage warehouse, storage facilities for oil, gasoline or petroleum products. 8-8-9: ZONE I-2 (HEAVY INDUSTRIAL):

   A.   Purpose: The purpose of the I-2 zone is to encourage the development of major manufacturing, processing, warehousing and major research and testing operations. Zone I-2 shall not create a hazard or nuisance which either immediately or in the future will adversely affect the health, safety or general welfare of the community.
   B.   Uses: The following uses are permitted in all I-2 zones accompanied by an engineered plat:
      1.   Permitted Uses: Factory or industrial operation not permitted in other zones; automobile wrecking yard, junkyard, sanitary landfill; light and heavy extractive manufacturing, manufacturing of rubber products, foundries, commercial slaughterhouse and meatpacking facilities; rendering of fats and oils;
      2.   Other Uses: Any other lawful use not prohibited by this or any other county ordinance.
   C.   Prohibited Uses: The following uses shall not be permitted in class I-2 zones:
      1.   Churches and schools.
      2.   Kindergartens and daycare facilities.
      3.   Cemeteries.
      4.   Hospitals, sanitariums and nursing homes.
      5.   Dwelling of any kind for living purposes except a residence used in connection with the operation, for a caretaker. (Ord. 2009-03, 6-15-2009)

8-8-10: CONDITIONAL USES:

Since it is impossible to foresee and enumerate all future or potential and valid conditional uses, other conditional uses may be approved by the planning and zoning commission, provided the proposed use conforms strictly to the requirements of chapter 9 of this title. (Ord. 57, 4-18-1988)

8-8-11: PUBLIC UTILITY STRUCTURES:

Structures which are built by a public utility for the sole purpose of housing and maintaining fully operational communications transmission equipment used exclusively in the furtherance of the business of the public utility, shall be a permitted use in any zone. Such structures shall not be used at any time for human habitation, and when they are no longer used by the public utility, they shall be abandoned and removed. The purchase of land for the placement of such a structure shall not constitute a division of land for purposes of the one time division of property. Said structure shall be fully enclosed, not to exceed one story in height as defined by the uniform building code, shall not exceed three hundred (300) square feet in size and shall have no water or sewer connections. No storage of vehicles, equipment or supplies shall be allowed. The lot shall be kept weed free. Zero setback of the actual structure is permissible as long as there is no interference with sight distances which would compromise or impair vehicular traffic safety. (Ord. 57-K, 8-8-1994)
