CHAPTER 1272

Off-Street Parking, Loading and Garaging

1272.01 GENERAL REQUIREMENTS; PARKING SPACES; PARKING LOTS.

   The following regulations shall apply to all use districts:
   (a)   No building shall hereafter be erected, nor shall any building be remodeled or altered to provide for a greater degree of or intensity of use, and no change shall be made in the use of a building or premises that will increase the parking space needs or loading space needs of such building or premises, unless the requirements of this chapter are fulfilled for the off-street parking or garaging of motor vehicles of the occupants, employees, patrons, clients or guests thereof, and for off-street loading or unloading. Adequate street access to parking and loading spaces shall be provided and kept open and unobstructed.
   (b)   For the purpose of this chapter, a one-car parking space shall not be less than nine feet (9') in width, nor less than twenty feet (20') in length, and shall be accessed from a driveway adequate in width for the angle of parking. The driveway width for ninety (90) degree parking shall be not less than twenty-two feet (22'). The driveway width for other parking angles shall be as established by the City Engineer. Spaces shall be clearly marked, and off-street parking requirements set forth in this chapter shall have reference to such car parking spaces and to such abutting driveway, both entirely off the right of way of any public street. Any required parking space for a building or use which is provided on adjoining or adjacent premises, where such arrangement is permitted under this chapter, shall be in the form of allocation of not less than the required number of parking spaces for the exclusive use of such building or premises during its normal hours of activity or operation.
   (c)   Where parking lots are required they shall comply with the following conditions: the driveways and parking space shall be smoothly graded, adequately drained and hard-surfaced with concrete, asphaltic concrete or other bituminous material. Surface water shall not be permitted to discharge over the public sidewalks or roadways or onto other premises.
   (d)   For the purposes of computing required off-street parking, gross floor area shall mean the total area of all floors measured from the exterior faces of the building.
   (e)   Sources of light for illumination of parking lots shall be shielded so that the light source is not directly visible from residential property and light spillage at the property line shall not be greater than 0.1 lumens. Lighting shall be installed in conformance with a lighting plan approved by the Planning Commission.
   (f)   The side yard, front yard, building and setback lines requirements established elsewhere in this Zoning Code for buildings and other structures shall also apply to parking lots when they are required herein. Whenever a parking lot or driveway thereof adjoins a residence district, such parking lot or driveway shall be separated from the residence district by a solid masonry wall or other effective screening at least six feet high and extending to, but not in front of, the setback building line.

1272.02 REQUIREMENTS FOR DWELLINGS.

   (a)   Each single-family, duplex and two-family dwelling shall have on its premises a private garage sufficient in capacity for the storage at one time of at least two passenger automobiles for each dwelling unit on the premises.
 
   (b)   On any parcel of land of one acre or more in area, the garage space shall not exceed that necessary for the vehicles used by the families housed on such lot or parcel, including anyone they may employ, and except for vehicles used in agriculture, not more than one commercial vehicle shall be stored in a private garage. No commercial vehicle or trailer, recreational vehicle or boat shall be stored in a residential district except in a private garage. As used in this section, “recreational vehicle” is as defined in Ohio R.C. 4501.01.
 
   (c)   Each multiple-family and apartment dwelling shall have a private garage sufficient in capacity for the storage at one time of at least one and one-half passenger automobiles for each dwelling unit on the premises, and an additional parking space which may be outdoors for at least one-half of a passenger automobile for each dwelling unit.

1272.03 REQUIREMENTS FOR CHURCHES, THEATERS AND ASSEMBLY HALLS.

   Each church, theater and place of public assembly shall have off-street parking space on its premises sufficient in capacity for the parking at one time of one automobile per two seats of planned seating capacity. In the case of a church, only the seating capacity of the main worship hall shall be counted for the purpose of off-street parking.

1272.04 REQUIREMENTS FOR RETAIL STORES AND SHOPS.

   Each building containing banks, retail stores or shops, having a combined floor area in excess of one thousand (1,000) square feet, shall have a parking lot on or adjoining its premises sufficient in capacity to provide for one car parking space for each two hundred (200) square feet of gross floor area. Fueling areas at pump islands for gasoline stations shall not be considered parking spaces. (Ord. 2013-14. Passed 9-25-13.)

1272.05 REQUIREMENTS FOR RESTAURANTS, BARS AND TAVERNS.

   Each restaurant, bar or tavern shall have off-street parking space on its premises sufficient in capacity for the simultaneous parking of one (1) automobile for every two (2) seats at maximum permitted seating capacity.

1272.06 REQUIREMENTS FOR OTHER BUILDINGS OR USES.

   Each building or use other than those enumerated above in this chapter shall have off-street parking space sufficient in capacity as determined and established by the Planning Commission.

1272.07 REQUIREMENTS FOR OFFICE BUILDINGS.

   Each office building shall have off-street parking space on its premises sufficient in capacity for the parking at one time of one automobile for each two hundred fifty (250) square feet of gross floor area. No parking lot or parking area in any U-3 District shall be located within fifteen feet of any side or rear lot line. The area within fifteen feet from any side or rear lot line shall be landscaped. No parking lot or parking area shall be located in any front yard in a U-3 District, except behind the minimum building setback line.

1272.08 LOADING AND UNLOADING SPACES.

   In any district, each occupied premises not used exclusively for a residence and its accessory uses shall be provided with adequate space on its lot for the loading and unloading of trucks and commercial vehicles serving the premises. Whenever practical, access driveways to such loading and unloading space shall be so located as to make it unnecessary for vehicles to back in or out of public streets in order to reach them. The Inspector of Buildings shall administer the requirements of this section in a manner to eliminate, as far as practical, congestion and interference with vehicular and pedestrian traffic on the public streets.

1272.09 TYPE OF PARKING PROVIDED.

   Wherever in this chapter off-street parking spaces are required, they shall be provided on an outside lot or in a garage. There may be no more than one subterranean level of parking, and there shall not be any parking above ground level in or on structures.

1272.10 GARAGE DOORS.

   A door that is designed and used to permit the entry and exit of a motor vehicle into a garage shall not be located in such a way that the door faces a public right-of-way.
