Miscellaneous Provisions

§ 625-95 Violations and penalties.

For any and every violation of the provisions of this chapter, the owner, contractor or other person or persons interested as lessee, tenant or otherwise in any building or premises where such violation has been committed or shall exist and refuses to abate said violation within 10 days after written notice has been served upon him, either by registered mail or by personal service, shall for each and every violation be punished with a fine up to $1,000 and/or 90 days in jail and/or 90 hours of community service. Each and every day that such violation continues after such notice shall be considered a separate and specific violation of this chapter. (See N.J.S.A. 40:49-5.)

§ 625-96 Severability.

If any section, paragraph, subdivision, clause or provision of this chapter shall be adjudged invalid, such adjudication shall apply only to the section, paragraph, subdivision, clause or provision so adjudged, and the remainder of this chapter shall be deemed valid and effective.

§ 625-97 Expiration of exceptions and variations.

Any exception or variation from this chapter, granted by the Board to an applicant, shall expire if no construction, alteration or conversion has been commenced within two years from the exceptions, unless otherwise provided in the resolution of the Board granting the exception or variation or unless the time is extended upon application to the Board for a good cause shown.

§ 625-98 Prohibited uses.

A. 
The following uses, as defined within § 625-3, are expressly prohibited from all zones established within the Town of Phillipsburg:
(1) 
Bail bond services.
(2) 
Check cashing services.
(3) 
Pawnshops.
(4) 
Cannabis uses. All classes of cannabis establishments or cannabis distributors or cannabis delivery services as said terms are defined in section 3 of P.L. 2021, c. 16, excepting the delivery of cannabis items and related supplies by a delivery service, and the operation of the preexisting alternative treatment center as both a medical cannabis dispensary and an adult use cannabis dispensary, shall be and hereby are prohibited in all districts.

B. 
The individual prohibitions set forth in Subsection A shall not apply to any prohibited use that was already in existence and in conformance with all other provisions of this chapter prior to the date of enactment of said prohibitions.

§ 625-99 Redevelopment areas.

All redevelopment areas in the Town of Phillipsburg shall be subject to the requirements of the redevelopment plan adopted for that area by the Phillipsburg Town Council.
