SECTION 14

- ISSUANCE OF PERMITS, ENFORCEMENT AND PENALTY

Article 14.01. - Zoning inspector.

The zoning inspections and permits shall be handled by the building inspector who shall ex officio be the city zoning inspector.

Article 14.02. - Building permits.

It shall be unlawful to commence the excavation for the construction of any building, including accessory buildings or to commence moving or altering any building, including accessory buildings, until the building and zoning inspector has issued a building permit for such work.

Article 14.03. - Issuance of building permits.

In applying to the building and zoning inspector for a building permit, the applicant shall submit a dimensional sketch drawn to scale indicating the shape, size, height and location of all buildings to be constructed, altered or moved and of any building already on the lot. A plat of said lot signed by a registered surveyor, civil engineer or architect shall be submitted with the application upon request of the inspector, if necessary, for proper determination of the facts.

The applicant shall state the existing and intended use of all such buildings and supply other information required by the building inspector for determining whether the provisions of this ordinance are being observed. If the proposed construction as set forth in the application is in conformity with the provisions of this ordinance and other city ordinances, the building inspector shall issue a building permit for such construction. If a building permit is refused, the inspector shall state such refusal in writing with the cause.

The issuance of a permit shall in no case, however be construed as waiving any provision of this ordinance. If the work described in any building permit has not begun within six (6) months from the date of issuance thereof, said permit shall expire automatically. The permit shall become invalid if the work authorized by such permit is suspended or abandoned for a period of one year after the time the work is commenced; provided that, for cause, one or more extensions of time, for periods not exceeding ninety (90) days each, may be allowed in writing by the building inspector.

Article 14.04. - Reserved.

Article 14.05. - Violation.

In case any structure is erected, constructed, reconstructed, altered, converted or any structure or land is used in violation of this ordinance, any proper official or their duly authorized representatives, or neighboring property owner who would be especially damaged by such violation, may, in addition to other remedies, institute injunction, mandamus, or other appropriate actions or proceeding to prevent such unlawful erection, construction, reconstruction, alterations, conversion, or use, or to correct or abate such violation, or to prevent the occupancy of such building, structure or land. Each day such violation continues shall constitute a separate violation.

Article 14.06. - Penalty.

Any person violating any provisions of this ordinance shall be guilty of a misdemeanor, and upon conviction shall be fined an amount not to exceed twenty-five dollars ($25.00), or imprisoned for not more than thirty (30) days, for each offense. Each day such violation shall continue shall constitute a separate offense.
