SECTION 2

- GENERAL PROVISIONS

Article 2.01. - Zoning affects every structure and use.

No structure or land shall hereafter be used and no structure or part thereof shall be erected, reconstructed, converted, moved or structurally altered unless in conformity with the regulations as set forth in this ordinance. However, buildings which are legally nonconforming with respect to yard areas or height may be structurally altered or enlarged providing the portion of the building which is altered or the portion of the building which is added is in conformity with the provisions of this ordinance.

Article 2.02. - Only one principal building on any lot.

Every building hereafter erected, reconstructed, converted, moved, or structurally altered shall be located on a lot of record which abuts at least one public street and in no case shall there be more than one main building and its customary accessory buildings on one lot except as provided for in this ordinance.

Article 2.03. - Reduction in lot area prohibited.

No lot shall be reduced in area so that yards, lot area per family, lot width, building area, or other requirements of this ordinance are not maintained.

Article 2.04. - Required yards cannot be used by another building.

No part of a yard, parking space, or other open space required for any building or use for the purpose of complying with the provisions of this ordinance shall be included as part of a yard or parking space required under this ordinance for another building.

Article 2.05. - Classification of annexed territory and petition for zoning classification prior to annexation.

(a)

All territory not zoned which may be hereafter annexed shall be automatically classified as a temporary R-1 Residence District, except as provided herein, until otherwise changed by ordinance after public hearing.

(b)

Any party or parties who petitioned the City of Pineville, Louisiana, for annexation may condition their petition upon the property proposed for annexation being annexed into the city under a particular zoning classification designated in the said petition. After filing a petition for annexation, the petitioners may file an application with the zoning commission requesting that the property to be annexed be zoned in any manner, classification or district provided by the ordinances of the City of Pineville. Upon receiving this application, the zoning commission shall publish its usual notice and shall schedule a hearing upon the application in the same manner and under the same procedures followed upon an application for zoning of property already contained with the city limits. The zoning commission shall hold a hearing and shall file a written report of its recommendations with the mayor and board of aldermen at or prior to its next regular meeting. The mayor and board of aldermen may grant a hearing in the matter, or may approve the report without further hearing or take such other action as it desires. In the event a petition for annexation contains a request that the property be zoned into a particular zoning classification, the City of Pineville, Louisiana, must approve both the annexation and the zoning request, or the party or parties submitting the petition shall be allowed to withdraw the petition for annexation within ten (10) days after receiving notice of the intention of the City of Pineville, Louisiana, with regard to their petition. To withdraw a petition for annexation which is conditioned upon a zoning classification, the parties to the said petition shall withdraw the petition by notice to the City of Pineville in writing within the prescribed time period.

Article 2.06. - Flashing signs.

Revolving signs of the type similar to the revolving beacons of flashing lights used by police cars and ambulances are prohibited in all districts irrespective of the color of the light used.

Article 2.07. - Regulations of areas under water.

All areas within the corporate limits of the city which are under water and are not shown as included within any district shall be subject to all the regulations of the district adjacent to the water area. If the water area adjoins two (2) or more districts, the boundaries of each district shall be construed to extend into the water area in a straight line.

Article 2.08. - Provisions of ordinance declared to be minimum requirements.

In their interpretation and application, the provisions of this ordinance shall be held to be minimum requirements, adopted for the promotion of the public health, safety, morals, or general welfare. Wherever the requirements of this ordinance are at variance with the requirements of any other lawfully adopted rules, regulations, ordinances, deed restrictions or covenants, the most restrictive or that imposing the highest standards, shall apply.

Article 2.09. - Outdoor storage of materials.

All materials or waste which might cause fumes, dust, odors, or constitute a fire hazard, or attract rodents or insects shall be stored outdoors only in closed bins or containers. Nonoperable automobiles or trucks shall not be parked outdoors in any area except I Industrial for more than thirty (30) days.
