An application for a Conditional Use Permit shall be made to the Planning Board, provided, however, that the Board of Adjustment shall have the power to grand conditional use approval whenever the Board of Adjustment is reviewing an application for approval of a variance pursuant to N.J.S.A. 40:55D-70(d), commonly known as a "use" variance.
a. The Planning Board shall grant or deny an application for a Conditional Use Permit within ninety-five (95) days of submission of a complete application within such further time as may be consented to by the applicant.
b. The Board of Adjustment, in conjunction with an application for a variance pursuant to N.J.S.A. 40:55D-70(d), shall grant or deny an application for a Conditional Use Permit within one hundred twenty (120) days or within such further time as may be consented to by the applicant.
