- GENERAL PROVISIONS
A.
Title. This chapter shall be known as the Port Allen Zoning Ordinance and may be referred to and cited herein as the "Zoning Ordinance."
B.
Authority and effective date.
1.
This zoning ordinance was adopted under the authority granted by section 4721 through 4732, Title 33, Louisiana Revised Statues of 1950, as amended.
2.
This zoning ordinance was adopted on April 13, 2016 and became effective on April 13, 2016. All previously enacted zoning ordinances are hereby repealed.
C.
Severability. Should any provision of this zoning ordinance be decided by the courts to be unconstitutional or invalid, that decision shall not affect the validity of this zoning ordinance other than the part declared to be unconstitutional or invalid.
D.
Purpose. The purposes of this chapter are to:
1.
Promote the health, safety, and general welfare of the City of Port Allen.
2.
Promote the policies and objectives articulated in the City of Port Allen Smart Growth Master Plan.
3.
Provide for adequate light, air, and privacy, and secure safety from fire, flood and other danger.
4.
Promote orderly and beneficial development and use of land within the city.
5.
Promote compatibility among different land uses and provide for a suitable mix of land uses.
6.
Minimize congestion in the public streets and ensure safe, convenient, and efficient circulation of motor vehicles, bicycles, and pedestrians.
7.
Protect the city's economic stability and provide opportunity for business and industry.
8.
Allow a range of housing opportunities.
9.
Preserve and enhance the beauty, aesthetics, and environmental integrity of the city.

A.
Jurisdiction. This chapter applies to all land within the incorporated areas of the City of Port Allen.
B.
Compliance required.
1.
No building, structure or land shall be used or occupied, and no building or structure shall be erected, constructed, reconstructed, moved or structurally altered, except in conformity with all requirements of this chapter.
2.
Every building erected, reconstructed, converted, moved or structurally altered shall be located on a lot of record. No more than one single-family detached dwelling shall be located on one lot of record, except as otherwise provided for in this chapter.
C.
Minimum standards. The requirements of this zoning ordinance shall be considered the minimum requirements for the promotion of the public health, safety and general welfare.
D.
Relationship to other regulations.
1.
Conflicts.
a.
Whenever any provision of this chapter conflicts with any other provision of law, rule, or regulation covering the same subject matter, whether set forth in this chapter or elsewhere, the provision which is more restrictive or imposes the higher standard or requirement shall govern.
b.
If the provisions of this chapter are more restrictive or impose higher standards than an easement, covenant or other private agreement, the requirements of this chapter shall govern. If the provisions of an easement, covenant or other private agreement are more restrictive or impose higher standards than this chapter, the private agreement shall govern. The city will not be responsible for enforcing a private agreement.
2.
Whenever this chapter refers to a law, rule, or regulation that is later amended, reenacted, or superseded, the reference shall be deemed to refer to the amended or reenacted provision, or the one that most nearly corresponds to the superseded provision.

A.
Zoning districts enumerated. The City of Port Allen is hereby divided into the following zoning districts:
1.
Residential districts.
a.
R-1 single-family residential.
b.
R-2 single-family residential.
c.
R-3 single-family residential.
d.
R-4 attached residential.
e.
R-5 multifamily residential.
f.
R-6 manufactured home park.
g.
R-7 manufactured home subdivision.
2.
Commercial and mixed use districts.
a.
DMU downtown mixed use.
b.
C-1 light commercial.
c.
C-2 commercial.
3.
Industrial and employment districts.
a.
L-1 employment and institutional.
b.
L-2 light industrial.
c.
L-3 heavy industrial.
4.
Traditional neighborhood development district.
B.
Zoning maps.
1.
Establishment of zoning district map. The boundaries of the zoning districts are established and shown on the Port Allen Zoning Map, which may be cited and referred to as the "official zoning map". The official zoning map is hereby made part of this zoning code. All notations, references and other information shown on the map shall have the same force and effect as if fully set forth or described in this zoning ordinance. The official zoning map shall be kept on file by the administrator.
2.
Interpretation of district boundaries. Where uncertainty exists with respect to the boundaries shown on the official zoning map, the administrator shall interpret the boundaries using the standards below in this section and in consultation with the planning commission.
3.
Zoning district boundaries shall be interpreted using the following rules:
a.
Boundaries are the center lines of the streets, alleys, waterways and rights-of-way, unless otherwise indicated. Where a boundary line on the official zoning map coincides with the location of a street, alley, waterway or right-of-way, the center line of the street, alley, water way or right-of-way shall be construed to be the boundary of such district.
b.
Boundaries indicated as approximately following platted lot lines shall be construed as following such lot lines.
c.
Boundaries indicated as approximately following city limits shall be construed as following such city limits.
d.
Boundaries indicated as following shorelines shall be construed to follow such shorelines, and in the event of change in the shoreline shall be construed as moving with the actual shoreline.
e.
Boundaries indicated as parallel to or extensions of features indicated in subsections a. through d., above shall be so construed.
f.
Distances not specifically indicated on the official zoning map shall be determined by the scale of the map.
4.
Classification of annexed territory. The zoning category of annexed land shall be established by the city council in the ordinance annexing the land.
