CHAPTER 4

ESTABLISHMENT OF ZONES

10-4-1: ZONES ENUMERATED:

   A.   In order to accomplish more fully the objectives and purposes of this title, Rigby, Idaho, is hereby divided into zones which shall be known by the symbols and names as follows:

10-4-2: ZONING MAP:

   A.   The location and boundaries of each of the zones shall be detailed on a map to be entitled "Official Zone Map Of Rigby, Idaho", and said map with all notations, references and other information shown thereon is hereby declared to be an official record and a part of this title.
   B.   The Official Zone Map shall be identified by the signature of the Mayor, attested by the City Clerk, and shall bear the seal of the city under the following words:
I hereby certify that this is the Official Zone Map of Rigby, Idaho, which was adopted by the Council of the said City on this day of , 20.
   C.   The Official Zone Map shall be located in the office of the City Clerk and shall accurately designate the current boundary lines of the several zones within Rigby, Idaho.
   D.   Whenever amendments are made in zone boundaries or other matter portrayed on the Official Zone Map, said Official Zone Map shall be promptly changed by the Zoning Administrator.
   E.   Any area annexed to the municipality shall, upon annexation be automatically zoned residence R-1 until otherwise zoned.
   F.   No amendment to the official zone map shall become effective, however, until the map has been duly changed in accordance with an amending ordinance, and the amending ordinance has been signed by the Mayor and attested to by the City Clerk. In the event of a conflict between this or an amending ordinance and the zone map, this or an amending ordinance shall govern. (Ord. 402, 5-5-1987; amd. Ord. 2021-619, 9-14-2021)

10-4-3: DETERMINATION OF BOUNDARIES:

Where uncertainty exists with respect to the boundaries of various zones, the following rules shall apply:
   A.   Where the intended boundaries on the zone map are approximately street or alley lines, said street or alleys shall be construed to be the zone boundaries.
   B.   Where the indicated boundaries are approximately lot lines, said lot lines shall be construed to be the zone boundaries, unless otherwise indicated.
   C.   Where land has not been subdivided into lots, the zone boundary shall be determined by the use of a scale of measurement shown on the map.
   D.   Where uncertainty exists, the Zoning Commission shall interpret the map, subject to review by the Council. (Ord. 402, 5-5-1987; amd. Ord. 2021-619, 9-14-2021)

10-4-5: ZONING CLASSIFICATION:

Each zone is defined as follows.
   A.   RP Residential Park Zone: This zone is used for City of Rigby Parks and Recreation uses. Private parks and recreation uses will maintain the zoning of the subdivision.
   B.   R-1 Residential Zone: The R-1 zone is established to protect stable neighborhoods of detached single-family dwellings on larger lots. The limited uses allowed in this district shall be compatible with an atmosphere of large, landscaped lawns, low building heights, ample setbacks and side yards, predominantly off street parking, low traffic volumes, and low nuisance potentials. Not more than one (1) single-family dwelling shall be placed on a lot or parcel of land in the R-1 zone.
      1.   Permitted Uses: The following principal uses and structures indicated as "P", and no others, shall be permitted in the R-1 zone. The following uses and structures indicated as "CUP" may be permitted in the R-1 zone only after a Conditional Use Permit has been approved, and subject to the terms and conditions thereof.

**Tourist Home requires a review for Neighborhood Compatibility for Parking, Screening, Lighting and Landscaping to be approved by the Zoning Administrator or designee.
 
      2.   Lot Area: The minimum area of any lot or parcel of land in the R-1 zone is eight thousand (8,000) square feet.
      3.   Lot Width: Each lot or parcel of land in the R-1 zone shall have a width of no less than eighty feet (80').
      4.   Lot Depth: Each lot or parcel of land shall have a minimum lot depth of sixty feet (60').
      5.   Lot Frontage: Each lot or parcel of land in the R-1 zone shall abut a public street for a minimum distance of thirty-five feet (35'), on a line parallel to the centerline of the street or along the circumference of a cul-de-sac improved to City standards. Frontage on a street end, which does not have a cul-de-sac improved to City standards, shall not be counted in meeting this requirement. Private drives are allowed as per review by the Zoning Administrator or Designee.
      6.   Yard Requirements: The following minimum yard requirements shall apply in the R-1 zone:
         a.   Front Yard: Each lot or parcel in the R-1 zone shall have a minimum front yard of at least twenty-five feet (25') from right-of-way.
         b.   Rear Yard: The minimum depth of a rear yard shall be twenty-five feet (25').
         c.   Side Yard: Each lot or parcel of land in the R-1 zone shall have a side yard of at least seven and one-half feet (7 1/2') or six inches (6") of setback for every one foot (1') of building height, whichever is greater.
         d.   Accessory Building Setbacks: Accessory buildings are required to have the same setbacks as primary structures with the exception of tool sheds and other similar unoccupied one level structures two hundred square feet (200 sq. ft.) or smaller that may not be located in the front yard.
      7.   Building Height:
         a.   No lot or parcel of land in the R-1 zone shall have a building or structure, which exceeds a maximum height of twenty five feet (25'), measured at the top of building's horizontal wall.
         b.   Accessory Structure: In no case shall the height of an accessory structure exceed the height of any main structure on the same lot.
      8.   Permissible Lot Coverage:
         a.   Building Coverage: In an R-1 zone, all buildings, including accessory buildings and structures (including impervious surfaces, e.g. driveways), shall not cover more than seventy percent (70%) of the area of the lot or parcel of land.
         b.   Landscaping: At least thirty percent (30%) of the area of any lot shall be maintained in landscaping.
         c.   Impervious Surface: On any lot, concrete or asphaltic cement shall not cover more than forty percent (40%) of a front yard, fifty percent (50%) of a rear yard, and one hundred percent (100%) of one (1) side yard.
      9.   Signs: Unless otherwise prohibited by law, signs of the type and description listed below, but no others, may be placed and maintained in the R-1 zone.
         a.   Temporary: Two (2) temporary signs with a maximum area of six (6) square feet each, pertaining to the sale, lease, or rent of the particular building, property, or premises upon which displayed, and no other.
         b.   Points Of Interest: Signs or monuments identifying points of interest or sites of historic significance. The site, size and design of said signs or monuments, shall be specifically approved by the Zoning Administrator or Designee.
         c.   Address Signs: All dwellings shall have a permanently posted address, which shall be placed at driveway entrance (may be on mailbox) and be visible from both directions of travel along the road on which the address is located. Each dwelling must also have a permanently posted address, which shall be placed near main entry door.
         d.   Home Occupation Signs: Home occupation signs must be no larger than two (2) square feet, may not be lit and must be located in window only. Only one sign is allowed per dwelling.
   C.   R-2 Residential Zone: The R-2 zone is established to protect stable neighborhoods of detached single-family dwellings, duplexes and twin homes on medium sized lots. The uses allowed in this district shall be compatible with an atmosphere of large, landscaped lawns, low building heights, ample setbacks and side yards, predominantly off street parking, low traffic volumes, and low nuisance potentials. Not more than two (2) single-family dwellings shall be placed on a lot or parcel of land in the R-2 zone.
      1.   Permitted Uses: The following principal uses and structures indicated as "P", and no others, shall be permitted in the R-2 zone. The following uses and structures indicated as "CUP" may be permitted in the R-2 zone only after a Conditional Use Permit has been approved, and subject to the terms and conditions thereof.

      2.   Lot Area: The minimum area of any lot or parcel of land in the R-2 zone for a single family residence is seven thousand (7,000) square feet. Nine thousand (9,000) square feet is required for a duplex or twin home.
      3.   Lot Width: Each lot or parcel of land in the R-2 zone for a single family residence shall have a width of no less than sixty feet (60') and eighty feet (80') for a duplex or twin home.
      4.   Lot Depth: Each lot or parcel of land shall have a minimum lot depth of sixty feet (60').
      5.   Lot Frontage: Each lot or parcel of land in the R-2 zone shall abut a public street for a minimum distance of thirty-five feet (35'), on a line parallel to the centerline of the street or along the circumference of a cul-de-sac improved to City standards. Frontage on a street end, which does not have a cul-de-sac improved to City standards, shall not be counted in meeting this requirement.    D.   R-3 Residential Zone: The R-3 zone is established to protect stable neighborhoods of detached single-family dwellings on smaller lots, duplexes, twin homes and multi-family housing. Restoration or rehabilitation of older homes in this district shall be encouraged. Uses shall be compatible with an atmosphere of low building heights, low traffic volumes, ample off-street parking, and low nuisance potentials at a higher density than R-1 and R-2 zones. R-3 Zoning is not allowed adjacent to R-1 zoning. A buffer of R-2 zoning is required between R-1 and R-3 zoning.
      1.   Permitted Uses: The following principal uses and structures indicated as "P", and no others, shall be permitted in the R-3 zone. The following uses and structures indicated as "CUP" may be permitted in the R-3 zone only after a Conditional Use Permit has been approved, and subject to the terms and conditions thereof.

**Tourist homes, apartments and condominiums require a review for neighborhood compatibility for parking, screening, lighting and landscaping to be approved by the Zoning Administrator or designee.
 
      2.   Lot Area: The minimum area of any lot or parcel of land in the R-3 zone for a single family residence is five thousand (5,000) square feet. seven thousand (7,000) square feet is required for a duplex or twin home. Apartment or condominium projects shall not exceed sixteen (16) units per acre.
      3.   Lot Width: Each lot or parcel of land in the R-3 zone for a single-family residence shall have a width of no less than sixty feet (50') and seventy feet (70') for a duplex or twin home. The minimum lot width for apartments and condominium projects is eighty feet (80').
      4.   Lot Depth: Each lot or parcel of land shall have a minimum lot depth of sixty feet (60').
      5.   Lot Frontage: Each lot or parcel of land in the R-3 zone shall abut a public street for a minimum distance of thirty-five feet (35'), on a line parallel to the centerline of the street or along the circumference of a cul-de-sac improved to City standards. Frontage on a street end, which does not have a cul-de-sac improved to City standards, shall not be counted in meeting this requirement. Private drives are allowed as per review by the Zoning Administrator or designee.

         a.   Front Yard: Each lot or parcel in the R-3 zone shall have a minimum front yard of at least fifteen feet (15') from right-of-way and twenty five feet (25') from right-of-way for garage with driveway.
         b.   Rear Yard: The minimum depth of a rear yard shall be twenty feet (20').
         c.   Side Yard: Each lot or parcel of land in the R-3 zone shall have a side yard of at least five feet (5'). For apartments and condos next to single family, duplexes or twin homes on separate lots, the side yard setback is seven feet (7') or six inches (6") of setback for every one foot (1') of building height, whichever is greater.
         d.   Accessory Building Setbacks: Accessory buildings are required to have the same setbacks as primary structures with the exception of tool sheds and other similar unoccupied one level structures two hundred square feet (200 sq. ft.) or smaller that may not be located in the front yard.
      7.   Building Height:
         a.   No lot or parcel of land in the R-3 zone shall have a building or structure, which exceeds a maximum height of twenty feet (30'), measured at the top of building's horizontal wall.

            (1)   Xeriscape: Reduced-water usage landscape achieved using good planning and design, limited turf areas, soil improvements, efficient irrigation, mulching, low water use plants, and appropriate trees, shrubs, and ground cover.
            (2)   Zeroscape: Zero-water usage landscape made entirely of gravel placed over a weed barrier to produce a continuously weed-free, water-free area.
         c.   Impervious Surface: On any lot, concrete or asphaltic cement shall not cover more than forty percent (40%) of a front yard.

         e.   Apartment Or Condominium Complex Identification Signs: Identification signs must be located on the property of the complex they advertise. They must not be located in driveway site triangles unless they are no higher than three feet (3') above ground surface. The maximum area of the sign(s) for each complex is thirty-two (32) square feet. The sign(s) may be lit only by a white light source aimed onto the sign. Colored, internal and neon lighting is not allowed.
      10.   Water Lines: All water lines for multi-family buildings must be at least two inches (2") in diameter.
      11.   Street Access: In an R-3 zone, new streets shall enter and exit only from and to arterial streets.
   E.   C Commercial Zone: The C zone consists of two areas, the Downtown Business District and the rest of the Commercial Zone:
The Downtown Business District was established to recognize the historic central retail and service center of the City. Front setbacks are not common and lot coverage may approach or be one hundred percent (100%). On-street parking serves many of the businesses. Office and residential uses are encouraged on the upper floors of the downtown buildings.
Attractive, inviting, and well-maintained shops, stores, offices, and other buildings are also characteristic of this area. Signing of shops and business establishments should be simple and attractive with signs mounted flat against the building to reduce the sign clutter and enhance the aesthetics of the downtown area. The uses characteristic of this zone are retail stores, banks, office buildings, theaters, hotels, and a wide variety of specialty shops and retail outlets. Conversely, uses which tend to create business dead spots, cause undue scattering of business, and generally tend to thwart the use of the land for its primary purpose have been excluded from the zone. This zone will tend to encourage an architectural theme which will strengthen the continuity of the downtown area and give it a "character" with which the citizens of Rigby can identify.
The Downtown District is shown on the City of Rigby GIS map and is described as North 1st West to West 1st North Main street to North Clark St. Part of North 1 West start at West Fremont to hwy 48.
The rest of the C zone is established to provide an area in which a general shopping center facilities can be established to satisfy the specialty shopping needs of the community. It is intended that the C zone will be characterized by specialty shops situated in an attractively designed shopping center complex surrounded by appropriate landscaping. The area will be located adjacent to major thoroughfares or collector streets which will provide immediate access for automobile traffic without passing through residential areas. Uses permitted in the C zone will be characterized by a department store and a supermarket as anchors, and by a wide range of restaurants, specialty shops and hard goods or soft goods stores. Offices are encouraged to be built in the Downtown area but are allowed in the rest of the C zone. Some light manufacturing may be allowed with a Conditional Use Permit (CUP). Storage units and other warehousing is not allowed.

The following uses and structures indicated as "CUP" may be permitted in the C zone only after a Conditional Use Permit has been approved, and subject to the terms and conditions thereof.

**Tourist homes, apartments and condominiums require a review for neighborhood compatibility for parking, screening, lighting and landscaping to be approved by the Zoning Administrator.   
 
         a.   Permitted Accessory Uses: Accessory uses and structures are permitted in the C zone provided they are incidental to, and do not substantially alter, the character of the permitted principal use or structure. Such permitted uses and structures include, but are not limited to, the following:
            (1)   Accessory building such as garages, carports, equipment storage buildings and supply storage buildings which are customarily used in conjunction with and incidental to a principal use or structure permitted in the CBC zone.
            (2)   Storage of materials used for construction of a building, including the contractor's temporary office, provided that such use is on the building site or immediately adjacent thereto, and provided further that such use shall be permitted only during the construction period and thirty (30) days thereafter.
      2.   Lot Area: The minimum area if any lot or parcel of land in the C zone shall be five (5) acres; however, smaller lots or parcels may be created as part of an approved and recorded Record of Survey. Said land shall be in single ownership or single control for integrated development.
      3.   Lot Width: Each lot or parcel of land in the C zone shall have a width of no less than one hundred feet (100'); however, smaller widths may be allowed as per the Planning Administrator.
      4.   Lot Depth: Each lot or parcel of land in the C zone shall have a depth of no less than one hundred feet (100'); however, smaller depths may be allowed as per the Planning Administrator.
      5.   Lot Frontage: Each lot or parcel of land in the C zone shall abut a public street for a minimum distance of fifty feet (50'), on a line parallel to the centerline of the street or along the circumference of a cul-de-sac improved to City standards. Frontage on a street end, which does not have a cul-de-sac improved to City standards, shall not be counted in meeting this requirement. Private drives are allowed as per review by the Zoning Administrator.
      6.   Yard Requirements: The following minimum yard requirements shall apply in the C zone:
         a.   Front Yard: Each lot or parcel in the C zone shall have a front yard of no less than ten feet (10'). Said front yard shall not be used for vehicular parking and shall be appropriately landscaped.
         b.   Side And Rear Yards: Each lot or parcel of land in the C zone shall have a side and rear yard of at least ten feet (10') when located adjacent to a residential zone. There shall be no requirement in those instances where the side property line abuts a commercial or industrial zone.
         c.   Storage Units: In this zone, all storage units are required to be built internally to a lot. During the "Conditional Use Permit" proceedings, the applicant shall show how the storage units are being buffered from any street rights-of-way and neighboring properties. For example, the most desirous buffering would be commercial buildings. Areas of landscaping greater in distance than the required yard setbacks should be included. These landscaped areas would need large nursery stock shrubs and trees to act as buffering. The landscaping and use of landscaping must be approved by the Planning Administrator.
      7.   Building Height: No lot or parcel of land in the C zone shall have a building or structure which exceeds a height of thirty-five feet (35'), measured at the top of building's horizontal wall. Chimneys, flagpoles, or similar structures not used for human occupancy are excluded in determining height.
      8.   Lot Coverage: At least ten percent (10%) of the area of any lot shall be maintained in landscaping. Impermeable surfaces may cover up to ninety percent (90%) of the area of a lot. In a C zone in which a majority of the perimeter is contiguous to residential zones, all buildings and structures shall not cover an area of more than seventy percent (70%) of the lot or parcel of land upon which they are placed. Landscaping to be approved by the Planning Administrator.
   F.   I Industrial Zone: The I Zone is established to provide areas in the City where light industrial firms can engage in processing, assembling, manufacturing, warehousing, storage and wholesale distribution; and for incidental service facilities and public facilities to serve the manufacturing area. Heavy industrial requires a Conditional Use Permit (CUP) and is required to be buffered from residential zones by commercial and/or light industrial zones.
Areas in this zone require large level sites with open storage and service areas which utilize regional transportation such as railways and state highways and the available utilities necessary for successful manufacturing or processes. The zone is intended to encourage sound development by providing and protecting an environment for such development, subject to regulations necessary to assure the orderly growth of the City of Rigby, and the protection of residential and commercial land uses from noise and other disturbances.
      1.   Permitted Uses: The following principal uses and structures indicated shall be permitted in the C zone. The following uses and structures indicated as "CUP" may be permitted in the C zone only after a Conditional Use Permit has been approved, and subject to the terms and conditions thereof.
