CHAPTER 6

OFF-STREET PARKING AND LOADING FACILITIES

10-6-1: GENERAL REQUIREMENTS:

   A.   No building or structure shall be erected, substantially altered or its use changed unless permanently maintained off-street parking and loading spaces have been provided in accordance with the provisions of this title.
   B.   The provisions of this chapter, except where there is a change of use, shall not apply to any existing building or structure created before the date of this title. Where the new use involves no additions or enlargements, there shall be provided as many such spaces as may be required by this title.
   C.   Whenever a building or structure constructed after the effective date of this title is changed or enlarged in floor area, number of employees, number of dwelling units, seating capacity or otherwise, to create a need for an increase in the number of existing parking spaces, additional parking spaces shall be provided on the basis of the enlargement or change. Whenever a building or structure existing prior to the effective date of this title is enlarged to the extent of fifty percent (50%) or more in floor area, number of employees, number of housing units, seating capacity or otherwise, said building or structure shall then and thereafter comply with the full parking requirements set forth herein. 10-6-2: STANDARDS:

   A.   Location Of Parking Spaces: The following regulations shall govern the location of off-street parking spaces and areas:
      1.   Parking spaces for all detached residential uses shall be located on the same lot as the use which they are intended to serve unless part of approved parking for platted multi-family units with a homeowner's association.
      2.   Parking spaces for commercial, industrial or institutional uses shall be located not more than three hundred feet (300') from the principal use; and
      3.   Parking spaces for apartments, condominiums or similar residential uses shall be located not more than three hundred feet (300') from the principal use.
      4.   Handicapped parking is required to be on closest access to building. The first handicapped space is required to be a van accessible space. Handicapped spaces are required to be sized and identified with surface paint and pole signs as per the American National Standards. The quantity of handicapped and handicapped van accessible spaces is required as per the International Building Code specifications.
   B.   Loading Space Requirements And Dimensions: Off-street loading spaces for commercial uses shall be provided in accordance with the following table:

For each additional 75,000 sq. ft. or fraction thereof, an additional Type A space will be provided.
 
      1.   Loading Space Size: The size of an off-street loading space shall not be less than the following, exclusive of access platform and loading area:

      2.   Access To Loading Spaces: Convenient access to loading spaces from streets or alleys shall be provided; access aisles shall not be less than twelve feet (12') in width.
      3.   Location Of Required Loading Facilities: The off-street loading facilities required for the uses mentioned shall not project into the public right of way or setback area. In no case shall the required off-street loading berths be part of the area used to satisfy the off-street parking requirements.
      4.   Design And Location: Design and location of entrances and exits for required off-street loading areas shall be subject to review of the Planning Administrator and the Public Works Director.
   C.   Maintenance: The owner of property used for parking/loading shall maintain such area in good condition without holes and free of all dust, trash and other debris.
   D.   Paving: The required number of parking and loading spaces as set forth in this section. Parking space requirements, together with driveways, aisles and other circulation areas, shall be improved with such material to provide a durable and dust-free surface. The owner of property used for parking shall maintain such area in good condition without holes and free of all dust, trash and other debris
   E.   Drainage: All parking and loading areas shall provide for proper drainage of surface water to prevent the drainage of such water onto adjacent properties, walkways or into City right of way.
   F.   Lighting: Any parking/loading area which is intended to be used during non-daylight hours shall be properly illuminated to avoid accidents. Any lights used to illuminate a parking lot shall be so arranged as to reflect the light away from the adjoining property.
   G.   Access: Any parking area shall be designed in such a manner that any vehicle leaving or entering the parking area from or onto a public or private street shall be traveling in a forward motion. Access driveways for parking areas or loading spaces shall be located in such a way that any vehicle entering or leaving such area shall be clearly visible by a pedestrian or motorist approaching the access or driveway from a public or private street.
   H.   Striping: All parking areas with a capacity over four (4) vehicles shall be striped.
   I.   Screening And/Or Landscaping: Whenever a parking area is located in or adjacent to a residential district, it shall be effectively screened on all sides which adjoin or face any property used for residential purposes by an acceptably designed wall, fence or planting screen. Such fence, wall or planting screen shall be not less than four feet (4') nor more than six feet (6') in height and shall be maintained in good condition. The space between such fence, wall or planting screen and the lot line of the adjoining premises in any residential district shall be landscaped with grass, hardy shrubs or evergreen ground cover, and maintained in good condition. In the event that terrain or other natural features are such that the erection of such fence, wall or planting screen will not serve the intended purpose, then no such fence, wall or planting screen and landscaping shall be required.
Parking spaces and aisles shall be screened from the public right-of-way with trees and bushes. The buffer shall consist of a minimum five feet (10') wide landscaped strip to be planted with one (1) deciduous tree and five (5) shrubs per thirty (30') lineal feet.
Landscaping: Plant material size (minimum), at time of planting:
      1.   Deciduous Trees: Two inch (2") caliper around the trunk of the tree.
      2.   Shrubs: Five (5) gallon containers.
      3.   Landscaping must be maintained as in its original design and purpose.
   J.   Wheel Blocks: Whenever a parking lot extends to a property line, wheel blocks or other suitable devices shall be installed to prevent any part of a parked vehicle from extending beyond the property line.
   K.   Minimum Distance And Setbacks: No part of any parking area for more than ten (10) vehicles shall be closer than twenty feet (20') to any dwelling unit, school, hospital or other institution for human care located on an adjoining lot, unless, separated by an acceptably designed screen. If on the same lot with a one-family residence, the parking area shall not be located within the front yard required for such building. In no case shall any part of a parking area be closer than four feet (4') to any established street or alley right of way.
   L.   Disabled Vehicles: The parking of a disabled vehicle within a residential or commercial district for a period of more than two (2) weeks shall be prohibited, unless such vehicle is stored in an enclosed garage or other accessory building.
   M.   Permits Required: Parking lot construction shall be permitted as part of a Building Permit. Additions to existing parking lots and any reconfigurations require a Building Permit. Parking lots not accessory to a structure(s) require a Conditional Use Permit.
   N.   Joint Use: Two (2) or more non-residential uses may jointly provide and use parking spaces when their hours of operation do not normally overlap, provided that a written agreement approved by the Zoning Administrator shall be filed with the application for a permit. 10-6-4: PARKING SPACE REQUIREMENTS:

For the purpose of this chapter the following parking space requirements shall apply:

Three (3) parking spaces with at least 1 parking space covered by a private garage or carport. If a one-car garage is provided, that space will count toward the total spaces required. However, if a two-car garage is provided, one of the spaces will not count towards the total required.
In addition, visitor parking spaces shall be provided at 10% of total parking.
 
Boarding houses, rooming houses, dormitories and fraternity houses having sleeping rooms

10-6-5: GENERAL INTERPRETATIONS:

In the interpretation of this chapter, the following shall govern:
   A.   Parking spaces for other permitted or conditional uses not listed in this chapter shall be determined by the Planning Administrator;
   B.   Fractional numbers shall be increased to the next whole number; and
   C.   Where there is an adequate public transit system or where for any reason parking demand is unusually low, then the parking space provisions cited above may be reduced proportionately by the Commission. (Ord. 402, 5-5-1987; amd. Ord. 2021-619, 9-14-2021)
