04 ZONING AND DEVELOPMENT IN GENERAL

Sec 13.04.010 Purpose

The general purpose of this title is to control land uses within the corporate limits of the Town, in order to guide the community's growth in a logical and orderly manner as prescribed by its comprehensive plan. The specific purpose of this title is to provide for the conservation of public health, and for the safety, convenience and general welfare of the Town by ensuring the impacts of development are within the limits of established community standards.

Sec 13.04.020 Enactment

  1. This title, establishing zoning and land development regulations for the Town in accordance with the provisions of RCW ch. 35.27 and the laws of the state, is pursuant to the recommendations of the Town Council. As such, the regulations set forth in this title shall apply to all lands within the existing and future corporate boundaries of the Town. This title supersedes all other zoning ordinances enacted by the Town.
  2. In the event the Town does not have provisions for certain design or improvement standards, County regulations shall be used.

Sec 13.04.030 Short Title

This title shall be known and cited as "Town of Rockford Zoning and Development Regulations."

Sec 13.04.110 General Statement

The Town has the right to enforce this title by any legal means. These means include, but are not limited to, actions in the courts, whether criminal or civil in nature. These means also include administrative actions, including, but not limited to, revocation of a license or permit, collection of a penalty or imposition of a fine, recovery of the costs of enforcement, or any combination of these actions.

Sec 13.04.120 Filing And Investigation Of Complaints

Upon filing of a written complaint, the Town's compliance officer shall investigate the matter complained of and submit written findings to the Town Council.

Sec 13.04.130 Violations

The Town Council shall review the compliance officer's findings to determine whether this title has been violated. If it determines that this title has been violated, the Town Council or its attorney shall notify the violator. The notice shall specify a date after which the violator may be subject to a penalty if the violation continues. The notice shall also recite the penalty to which the violator may be subject if the violation continues.

Sec 13.04.140 Civil Penalty Clause

If the Town Council finds that a violation of this title has occurred, the Council may fine the violator up to $1,000.00 for each such violation. Further, each day that a violation continues shall constitute a separate violation. As a result, if, for example, a violation occurs for three days, the Council may fine the violator up to $3,000.00.

Sec 13.04.210 Purpose

Invariably, at the time the ordinance codified in this title is adopted or amended, certain uses that existed prior to the adoption or amendment will not conform to the regulations of this title. These are known as nonconforming uses, and in order to feasibly adopt the ordinance from which this title is derived and so as not to cause undue economic hardship on owners of nonconforming uses, these uses are allowed to continue under special conditions as outlined in this article.

Sec 13.04.220 Continuation Of Nonconforming Structure Or Use

Subject to the provisions of this article, a nonconforming structure or use may be continued and maintained in reasonable repair but shall not be altered or extended. For nonconforming uses occupying structures intended for expansion of that use, the use may be extended into the space designed for the use, provided that the Town Council approves the expansion.

Sec 13.04.230 Discontinuance Of Nonconforming Use

If a nonconforming use, either of the property or a structure, is discontinued for a period of 18 months or more, then that nonconforming use is no longer legal, and subsequent uses shall conform to this title.

Sec 13.04.240 Change Of Nonconforming Structure

Except for signs, a structure that contains a conforming use but is nonconforming in height or lot coverage may be altered. Any alteration shall not exceed the limits of the structure's height or lot coverage at the time of the adoption of the ordinance from which this title is derived. A nonconforming sign shall not be altered or extended except to make it comply with the requirements of this title.

Sec 13.04.250 Change Of A Nonconforming Use

  1. If a nonconforming use not involving a structure is replaced by another use, the new use shall conform to this title.
  2. If a nonconforming use involving a structure is replaced by another use, the new use shall conform to this title unless the Town Council determines that such structure is suitable only for another nonconforming use not more detrimental to surrounding properties than the one to be replaced.
  3. Any existing mobile (manufactured) home, as of the date of the ordinance codified in this title, which does not meet the standards established in this title will be allowed to legally remain as a nonconforming use until such time as it is moved offsite or is destroyed or damaged to any extent which exceeds 50 percent of the assessed value of the mobile (manufactured) home, at which time it shall conform to the provisions of this title. Any mobile (manufactured) home which is moved into the Town or which is relocated to another site within the Town shall conform to the provisions of this title.

Sec 13.04.260 Destruction Of Nonconforming Structure Or Use

If a nonconforming use or structure or a structure containing a nonconforming use suffers damage or is destroyed by any cause, including intentional destruction, exceeding 50 percent of its assessed value and is not returned to use or repair within 12 months, a future structure or use on the site shall conform to this title.

Sec 13.04.270 Legal Nonconforming Uses And Structures

Legal nonconforming uses and structures include:

  1. Any use which does not conform with the present regulations of the zoning district in which it is located that was in existence and in continuous and lawful operation prior to the adoption of the ordinance codified in this chapter and RMC chs. 13.08 through 13.20.
  2. Any permanent structure in existence and lawfully constructed at the time of any amendment to this chapter and RMC chs. 13.08 through 13.20, which, by such amendment, is placed in a zoning district wherein it is not otherwise permitted and has since been in regular and continuous use.
  3. Any permanent structure lawfully used or constructed that was in existence at the time of annexation into the Town and which has since been in regular and continuous use.
  4. Existing legally established single-family residential uses located in a nonresidential zoning district.

Sec 13.04.280 Density And Dimension Standards

Residential standards are set forth in Table 13.04.280. Standards for alternate residential development are set forth in RMC ch. 13.20, and standards for planned residential developments are set forth in RMC ch. 13.24, art. VII. Commercial and industrial standards are set forth in RMC ch. 13.16.
