USES
The Commission is hereby authorized to review and render a final decision in approving, approving with conditions, or denying Conditional Use Applications (as per RZC 10-15-9), as identified herein, with an accompanying and required Site Plan Application.
All requests to establish a Conditional Use, as identified as a Conditional Use in the Table of Uses, RZC 10-17, shall be made on the applicable application form provided by the City. A property owner may present a Conditional Use Application for review and approval by the Commission. An agent of the property owner, or a lessee of the property, may present a Conditional Use Application to the Commission for review and decision, provided such Application is accompanied by a property owner affidavit of authorization.


All applications to establish a Conditional Use shall include a Site Plan and provide the following information:

The Commission shall approve a Conditional Use:
Approval of a Conditional Use Application shall approve the establishment of the use only. A Conditional Use Application shall not authorize the establishment of any building, activity, construction, or occupancy. Only when the Commission has approved, or approved with conditions, the necessary and required Site Plan Application may any building, activity, construction, or occupancy be established, subject to any conditions of approval. The approval of a Conditional Use Application shall not be deemed an approval of any other application, permit, or license.
Any person aggrieved by a decision of the Commission regarding a Conditional Use Application may appeal the decision to the authorized Appeal Authority as provided by RZC 10-28.
