CHAPTER 10

AREA OF CITY IMPACT

9-10-1: - Purpose:

Idaho Code section 67-6526 requires that the governing board of the city adopt by ordinance a map identifying an area of city impact within the unincorporated area of the county surrounding said city.

9-10-2: - Consideration:

The following factors were considered by the planning and zoning commission and the city council in identifying the area of city impact for Sandpoint, Bonner County, Idaho:

A.

Trade area;

B.

Geographical factors;

C.

Areas that can be reasonably expected to be annexed to the city in the future;

D.

Areas where extension of city services are possible and reasonable;

E.

Areas where growth is occurring or growth is anticipated to occur;

F.

Areas in which to encourage or discourage particular types of growth and development and that which the city may want some form of control over in the future.

9-10-3: - Geographic Area of City Impact:

The official adopted geographic area of city impact is shown in section 9-10-8 of this chapter. All parcels of land lying within the area of city impact as delineated by Section 9-10-8 shall be subject to the provisions of this chapter.

9-10-4: - Comprehensive Plan:

The Comprehensive Plan and subsequent amendments thereof as officially adopted by Bonner County shall apply to the unincorporated portion of Bonner County, lying within the area of city impact for the city.

9-10-5: - Zoning and Subdivision Ordinances:

The Zoning and Subdivision Ordinances and subsequent amendments thereto as officially adopted by Bonner County, shall apply to the unincorporated portion of Bonner County, lying within the area of city impact.

9-10-6: - Review and Comment:

Any request for development, zone change, conditional use permit, variance or subdivision in the unincorporated portion of Bonner County lying within the area of city impact shall be referred to the planning and zoning commission and city council of the city for review and comment. The city shall have a forty (40) day period within which to respond to any request set forth above. If the city does not respond within forty (40) days, the city forfeits its right to comment on the request and processing shall continue under the County's administration.

9-10-7: - Administrative Jurisdiction:

The administrative jurisdictions of plans and ordinances which apply to the area of city impact delineated by the map incorporated herein shall be the duty of Bonner County, which shall apply the same plans and ordinances for the unincorporated areas of the County lying within the areas of city impact as those areas lying outside the area of city impact.

9-10-8: - Legal Description and Map:

The area of city impact within the area of Bonner County, Idaho, is particularly described in ordinance 1130 on file in the city and also set forth on the map in that ordinance, which map shall be in effect until amended or modified as allowed by law. This map is attached as exhibit A to ordinance 1130 and incorporated herein by this reference.
