The following words and phrases shall have the particular meanings specified in the purpose of interpreting this chapter.
ACCESSORY USE OR STRUCTUREA use or structure that is subordinate and incidental to the principal use or structure of the property and which may occupy a separate structure and/or an area on or in the ground.
ADULT BOOKSTORE/VIDEO STOREAny commercial establishment in which more than 5% of the inventory offered for sale or rental to the public consists of books, publications, films or other media which depict nudity or sexual conduct, as defined herein.
ADULT BUSINESSAn adult bookstore/video store, adult live theater, movie theater or moviehouse, as defined herein.
ADULT MOVIE THEATER OR MOVIEHOUSEAny movie theater or moviehouse, including mini-theaters, which on a regular, continuing basis shows films rated "X" by the Motion Picture Coding Association of America, or any movie theater or moviehouse which presents for public viewing on a regular, continuing basis so-called "adult films" depicting sexual conduct, as defined herein.
ADULT LIVE THEATERAny commercial establishment which features on a regular basis live shows for public viewing in which all or some of the performers are displaying nudity or engaging in sexual conduct, as defined herein.
AGRICULTUREGrowing or producing for use on the lot or for sale domestic livestock, farm grains, feeds or hay, fruits, nursery stock, vegetables, dairy products, poultry, eggs or other crops or produce typical of farm activity in the County of Butler and related use of equipment and accessory farm buildings and structures necessary for the foregoing purposes including, but not limited to, barns, stables, corn cribs, silos and the like.
ALLEYA passage or way, open to public travel and dedicated to public use, affording generally a secondary means of vehicular access to abutting lots and not intended for general traffic circulation.
ANIMAL HOSPITALAn establishment for the medical or surgical treatment of animals, including the Boarding of hospitalized animals, but excluding the Boarding of animals not subjected to medical or surgical treatment.
ARTERIAL STREETA public street which serves large volumes of high speed and long distance traffic. Streets classified as arterial in the Borough are Butler Road, Main Street, Pittsburgh Street, Rebecca Street and Water Street.
AUTOMOBILE REPAIR GARAGEA building, or part thereof, used for the servicing and repair of motor vehicles, including engine overhaul, body work and recapping/retreading of tires and where all storage of parts and dismantled vehicles and all repair work are conducted entirely inside a "completely enclosed building," as defined by this chapter.
AUTOMOBILE SERVICE STATIONAny establishment which provides for one or more of the following activities:
A. The servicing of motor vehicles and operations incidental thereto and limited to one or more of the following activities; the retail sale, of petroleum products; retail sales and installation of automotive accessories; automobile washing by hand; waxing and polishing of automobiles; tire changing and repairing (excluding recapping); battery service, changing and replacement, excluding repair and rebuilding; radiator cleaning and flushing, excluding steam cleaning and repair; installation of accessories; and State inspection; and/or,
B. The following operations, which shall be permitted only if they are conducted within a "completely enclosed building" as defined by this chapter: lubrication of motor vehicles; replacement of exhaust systems; brake servicing limited to servicing and replacement of brake cylinders, lines and brake shoes; wheel balancing; the testing, adjustment and replacement or servicing of carburetors, filters, generators, points, rotors, spark plugs, voltage regulators, water and fuel pumps, water hoses and wiring; and/or,
C. The operation of a convenience food store, provided retail sale of petroleum products is a part of the operation.
AUTOMOBILE WRECKINGThe dismantling or wrecking of motor vehicles or trailers, or the storage, sale, or dumping of dismantled or partially dismantled, obsolete, or wrecked vehicles or their parts. The collection and/or storage of two or more motor vehicles or trailers, not in running condition or which do not have valid and current registration and a current and valid inspection sticker as required by the Motor Vehicle Code of the Commonwealth of Pennsylvania constitutes an automobile wrecking yard within the scope of this chapter.
BASEMENTThat portion of a building which is partly below and partly above grade, and having at least 1/2 of its height above grade.
BILLBOARDAny sign, as defined herein, which advertises an establishment, person, activity, product or service which is unrelated to or not available on the premises on which the sign is located.
BOARDThe Zoning Hearing Board of the Borough of Saxonburg, Butler County, Pennsylvania.
BOROUGH COUNCILThe Borough Council of the Borough of Saxonburg, Butler County, Pennsylvania.
BUFFER AREAA landscaped area of a certain depth specified by this chapter which shall be planted and maintained in trees, grass, ground cover, shrubs, bushes or other natural landscaping material and shall consist of a mix of types and sizes of plant material which within three years of planting meets the standard of providing a compact, year-round visual screen at least six feet in height or an approved existing natural or constructed physical barrier which duplicates the effect of the required buffer area.
BUILDINGAny structure having a roof and four walls, but excluding all forms of vehicles even though immobilized.
BUILDING AREAThe total of areas taken on a horizontal plane at the main grade level of the principal building and all accessory buildings exclusive of uncovered porches, terraces and steps.
BUILDING HEIGHTThe vertical distance measured from the average elevation of the finished grade around the building to the highest point of the coping of a flat roof, or to the deck line of a mansard roof, or to the average height of the highest gable of a pitch or hip roof. Chimneys, spires, towers, elevator penthouses, tanks and similar projections, other than signs, shall not be included in calculating the height.
BUILDING LINE, FRONTA line parallel to or concentric with the front lot line, the minimum measurement of which is the front yard depth required by this chapter.
BUSINESS SERVICESEstablishments engaged in rendering services to business offices on a fee or contract basis including, but not limited to advertising and mailing; data processing; secretarial; financial; photocopying, quick printing and fax; office supplies; building maintenance; equipment servicing, rental, leasing and sales; employment services; management and consulting services; and other similar business services.
CARPORTA structure to house or protect motor vehicles, which is open to the weather for at least 40% of the total area of its sides.
CERTIFICATE OF OCCUPANCYA certificate issued by the Zoning Officer prior to the use of any structure or land or the construction, reconstruction, alteration, enlargement or relocation of any structure which certifies that the proposed use or construction is in compliance with the requirements of this chapter for the zoning district in which the proposed use or construction is located, but which does not include approval of the structural integrity of the proposed construction or the materials or methods of construction proposed.
CELLARA portion of a building having 1/2 or more of its height below the average grade of the adjoining ground.
CEMETERYProperty used for interring of the dead, including mausoleums and columbariums, but not including crematoriums.
CHURCHA building, other than a dwelling, used primarily as a place of worship for a recognized religious denomination which may also include as accessory uses rooms for religious education, social and recreational activities, administrative offices, pre-school or elderly day care, parish houses, rectories, convents, manses and similar facilities.
CLINICAn establishment where patients receive medical, dental, and surgical diagnosis, treatment and counselling under the care of licensed medical doctors and dentists and their supporting staff, where said patients are not provided with board or room or kept overnight on the premises.
COLLECTOR STREETA public street which, in addition to giving access to abutting lots, intercepts local streets and provides a route for carrying considerable volumes of local traffic to community facilities and arterial roads. Streets classified as collector streets in the Borough for the purposes of interpreting this chapter are Horne Avenue, Isabella Street and State Street.
COMPLETELY ENCLOSED BUILDINGA building designed and constructed so that all exterior walls shall be solid from the ground to the roof line, containing no openings except for windows and doors which are designed so that they may be closed.
CONDITIONAL USEAn authorized use which may be granted only by Borough Council pursuant to express standards and criteria contained in this chapter after review and recommendation by the Planning Commission and after conducting a public hearing pursuant to public notice.
CONSTRUCTION TRAILERA "structure" designed, used or constructed so as to be used for a period of six months or less, to provide temporary offices for land sales or construction supervision on the site of an approved subdivision or land development during the time that a valid building or grading permit is in effect.
CONTRACTOR'S YARDA lot or parcel used for the permanent storage of construction equipment and supplies, but not including the sale of supplies or the repair or sale of heavy equipment.
COVERAGEThat percentage of the lot area covered by the "building area," as defined by this chapter.
DAY-CARE CENTERA facility, licensed by the Commonwealth, located within a building which is not used as a dwelling unit, for the care on a regular basis during part of a twenty-four-hour day of children under the age of 16 or handicapped or elderly persons.
DAY CARE HOMEA facility, licensed by the Commonwealth, located within a dwelling, for the care on a regular basis during part of a twenty-four-hour day of not more than six children under 16 years of age, excluding care provided to children who are relatives of the provider where such use shall be secondary to the use of the dwelling for living purposes and persons who do not reside in the dwelling shall not be employed.
DENSITYThe number of dwelling units per acre of land.
DISTRICTAn area accurately defined as to boundaries and location on an Official Zoning Map and within which area only certain types of land uses are permitted and within which other types of land uses are excluded, as set forth in this chapter.
DOMESTIC PETSAnimals or fowl normally permitted in a house and kept for company or pleasure such as dogs, cats, hampsters or canaries.
DWELLINGA building designed exclusively for residential purposes, including single-family, two-family and multifamily dwellings, but not including hotels or motel units.
DWELLING TYPESThe following dwelling types are included in this chapter:
A. SINGLE-FAMILY DWELLINGA detached building designed exclusively for occupancy by one family and containing one dwelling unit.
B. TWO FAMILY DWELLINGA building designed exclusively for occupancy by two families living independently of each other, and containing two dwelling units, including double houses and duplexes.
C. MULTIFAMILY DWELLINGA building designed exclusively for occupancy by three or more families living independently of each other and containing three or more dwelling units, including garden apartments and townhouses.
D. APARTMENTA dwelling unit in a multifamily dwelling or in a nonresidential building designed for occupancy by one family.
E. GARDEN APARTMENTA multifamily residential building containing three or more dwelling units sharing a common entrance which is not more than three stories in height.
F. TOWNHOUSEA residential structure that has three or more "dwelling units", each unit being separated from the adjoining unit or units by a continuous unpierced wall or walls extending from the basement or cellar floor to above the roof on a flat roof and to the ridge line on other roofs; each unit being capable of being separately owned, having its own access to the outside, both front and rear; and, having no other units above or below.
G. GROUP HOMEA dwelling unit where room and board is provided to not more than six permanent residents, who are mentally retarded or physically handicapped persons of any age and who are in need of supervision and specialized services and no more than two supervisors on any shift who may or may not reside in the dwelling and who provide health, social and/or rehabilitative services to the residents. The services shall be provided only by a governmental agency, its licensed or certified agents, or any other responsible nonprofit social services corporation and the facility shall meet all minimum requirements of the sponsoring agency. A group home shall be considered a single-family dwelling and shall be authorized wherever a single-family dwelling is permitted subject to the requirements of the district applicable to single-family dwellings.
H. GROUP CARE FACILITYA facility which provides room and board and specialized services for more than six permanent residents who are mentally retarded or physically handicapped persons of any age, or any number of dependent and/or delinquent children under the age of 18, adjudicated by the court system; or mentally disturbed persons of any age who are in need of supervision and staff qualified by the sponsoring agency who may or may not reside at the facility and who shall provide supervision on a twenty-four hour basis. The facility shall be licensed or certified by a sponsoring agency to provide specialized health, social and/or rehabilitative services to the residents and shall meet all minimum requirements of the sponsoring agency.
I. TRANSITIONAL DWELLINGA dwelling unit occupied on a short term basis by persons assigned by a court of law, or public or semi-public agency, and managed by a public or semi-public agency responsible for the occupants' care, safety, conduct, counselling and supervision for a specified period of time, including alcoholic recovery, shelters for battered persons and their children, community re-entry services following incarceration or other court ordered treatment, and other such short-term supervised assignments.
J. BOARDING OR LODGING HOUSEA single-family dwelling in which not more than three individuals not related by blood, marriage or adoption to the family occupying the dwelling are provided sleeping rooms and may be provided meals at a weekly or monthly rate.
K. PERSONAL CARE BOARDING HOMEA facility licensed by the Commonwealth located within a dwelling where room and board is provided to more than three permanent residents, who are not relatives of the operator, and who are mobile or semi-mobile and require specialized services in such matters as bathing, dressing, diet and medication prescribed for self-administration for a period exceeding 24 consecutive hours, but who are not in need of hospitalization or skilled nursing care or intermediate nursing care.
L. (1) A transportable single-family dwelling intended for permanent occupancy, contained in one unit, or in two or more units designed to be joined into one integral unit, capable of again being separated for repeated towing, which arrives at a site complete and ready for occupancy except for minor and incidental unpacking and assembly operations, and constructed so that it may be used without a permanent foundation.
(2) A mobile home which is rendered immobile by permanent placement on a continuous masonary foundation or at least two concrete footers which project at least three feet below the finished grade and which is skirted and tied to its foundation in accordance with the requirements of the American National Installation of Mobile Homes Requirements (NFPA No. 501-A-2974, ANSI A119.3-1975), as amended, and which are connected to all available utilities shall be permitted as a single-family dwelling. All other mobile homes shall be restricted to a mobile home park.
DWELLING UNITTwo or more rooms designed for or occupied by one family only and containing cooking and food storage facilities and, in a separate room, toilet, and tub or shower, with hot and cold water supply, all for the exclusive use of the family occupying the dwelling unit.
ESSENTIAL SERVICESThe provision of distribution systems by public utilities, municipal or other government agencies, or agencies regulated by the Public Utilities Commission (PUC) or other governmental agencies of underground or overhead gas, electrical, steam, or water pipes, sewers, conduit, fire alarm boxes, traffic signals, hydrants and other similar equipment and accessories in connection therewith, reasonably necessary for the furnishing of adequate services by such public utilities or municipal or governmental agencies or for the public health and safety or general welfare.
FAMILYAn individual, or two or more persons related by blood, marriage, adoption or foster care, or a group of not more than three unrelated persons living together without supervision in a dwelling unit. "Family" shall not include persons living together under the supervision of a public or semi-public agency which shall be permitted only in a "group care facility," "personal care boarding home" or "transitional dwelling."
FARMAny parcel of land containing at least 10 acres which may be used for gain in the raising of agricultural products, livestock, poultry and dairy products. It includes necessary farm structures within the prescribed limits and the storage of farm equipment. It excludes the raising of fur-bearing animals, riding academies, livery or boarding stables and dog kennels, unless approved as a special exception under the terms of this chapter.
FENCE OR WALLA structure designed for the purpose of enclosing space or separating parcels of land. The term "fence or wall" shall not include retaining wall.
GARAGE, PRIVATEAn accessory building or a portion of the principal building, enclosed on not less than three sides, not being accessible to the general public and designed or used for shelter or storage of private vehicles and personal property of the occupants of the principal building.
GARAGE, PUBLICA building, other than a private garage, containing two or more parking spaces accessible to the general public used for the storage or parking of motor vehicles, or where such vehicles are kept for remuneration, hire or sale, but not including the repair of vehicles or the storage of dismantled or wrecked motor vehicles, or "junk", as defined by this chapter.
GROSS FLOOR AREAThe sum of the gross horizontal areas of the several floors of a building or buildings measured between exterior faces of walls.
HEALTH CLUBA commercial recreational enterprise or private club which has as a principal use a gymnasium, swimming pool or other sports facility and which may offer massages, whirlpool baths, steam rooms, saunas and/or medical facilities as accessory uses to the principal use.
HOBBY FARMAn accessory use on a lot which does not meet the minimum acreage requirements for a farm where the principal use is a single-family dwelling and the accessory use is limited to activities authorized in the definition of agriculture, provided the accessory use does not constitute the principal source of income for the residents of the dwelling.
HOME GARDENINGGrowing of flowers, plants or vegetables for consumption by the person resident on the premises and not for sale.
HOME OCCUPATIONAn accessory use of a service character conducted on a regular basis, made available to the general public and intended to generate a profit, customarily conducted entirely within a dwelling by the residents thereof, which use is clearly incidental and secondary to the use of the dwelling for dwelling purposes and does not change the character of the dwelling.
HOME OFFICE OR SERVICEAn accessory use conducted entirely within a dwelling by the residents thereof, which use is clearly secondary to the use of the dwelling for living purposes and which is limited to an office of an engineer, attorney, architect or similar recognized profession or the office of a realtor, insurance agent, investment counselor, manufacturer's representative, broker or similar office or service where customers or clients do not routinely visit and where no one who is not a resident of the dwelling is employed.
HOSPITALAn establishment licensed by the Commonwealth for the care of human patients suffering from physical or mental illnesses, and which may or may not include facilities for major surgery and which may be publicly or privately operated.
INDOOR AMUSEMENTAn enterprise operated for profit by other than a public entity in a completely enclosed building for the pursuit of sports, recreation and leisure activities including, but not limited to, theaters, dance halls, bowling alleys, indoor racquet clubs, gymnasiums, health clubs, fitness centers, sports arenas and similar facilities.
JUNKAny rubbish or scrap material, including all paper cartons, boxes, barrels, wood, excelsior, bedding, cans, metal, glass, crockery, mineral refuse, ashes and any similar substances, scrapped or used appliances, fixtures, automobile parts, machinery and machinery parts or other similar material or any other form of discarded, unused or unusable materials, including building materials.
JUNK DEALERAny person or enterprise having a fixed place of business in the Borough and engaged in conducting, managing or carrying on the business, either wholesale or retail, of buying, selling, recycling or otherwise dealing in "junk," as defined by this chapter.
JUNKYARDAny premises devoted wholly or in part to the storage, buying or selling, salvaging, recycling or otherwise handling or dealing in "junk", as defined by this chapter.
KENNELA structure and/or premises where four or more dogs or cats which are six months or older are kept, bred, trained or boarded at any one time, whether for profit or not.
LANDOWNERThe legal or beneficial owner or owners of land, including the holder of an option or contract to purchase (whether or not such option or contract is subject to any condition), a lessee if he is authorized under the lease to exercise the rights of the landowner, or other person having a proprietary interest in land.
LOADING AREAA portion of a lot used for the standing, loading or unloading of motor vehicles.
LOTA tract of land legally described in a recorded plat or deed recorded in the Butler County Recorder of Deeds Office utilized as a single unit for purposes of development under the provisions of this chapter.
LOT AREAThe total area within the lot lines, excluding the area within any street right-of-way.
LOT FRONTAGEThat portion of the lot which adjoins the street right-of-way or through which access is provided to a public street.
LOT LINEA line of record bounding a lot which divides one lot from another lot or from a public or private street or other public space.
LOT LINE, FRONTThat lot line which is contiguous with the street center line or the street right-of-way line.
LOT LINE, SIDEAny lot line which is not a front lot line or rear lot line.
LOT TYPESThe following diagram illustrates terminology used in this chapter with reference to "corner lots," "interior lots," "reversed frontage lots" and "through lots." The lots are lettered to show the lot types indicated by letters A-D, below.

| A. | CORNER LOT — A lot abutting two streets which intersect next to one corner of the lot. |
| B. | DOUBLE FRONTAGE LOT — A through lot which has frontage on two public streets. |
| C. | INTERIOR LOT — A lot other than a corner lot with only one frontage on a street other than an alley. |
| D. | THROUGH LOT — A lot, other than a corner lot with frontage on more than one street, other than an alley. |
| E. | REVERSED FRONTAGE LOT — A lot in which the frontage is at right angles, or approximately right angles, to the general pattern in the area involved. A reversed frontage lot may also be a "corner lot" or an "interior lot." (See A-D and B-D in diagram). |
LOT WIDTHThe straight line distance between the point of intersection of the front building line with the side lot lines.
MEDIATIONA voluntary negotiating process in which parties in a dispute mutually select a neutral mediator to assist them in jointly exploring and settling their differences, culminating in a written agreement which the parties themselves create and consider acceptable.
MINERAL REMOVALAny extraction of any mineral for sale or other commercial purposes which involves removal of the surface of the earth or exposure of the mineral or subsurface of the earth to wind, rain, sun or other elements of nature. The term "mineral" includes, but is not limited to, anthracite and bituminous coal, lignite, limestone and dolomite, sand, gravel, rock, stone, earth, slag, ore, vermiculite, clay and other mineral resources, including activities carried out beneath the surface of the earth by means of shafts, tunnels or other underground mine openings.
MOBILE HOME LOTA parcel of land in a mobile home park improved with the necessary utility connections and other appurtenances necessary for the erection thereon of a single mobile home.
MOBILE HOME PARKA parcel or contiguous parcels of land under single ownership which has been so designated and improved that it contains two or more mobile home lots for the placement thereon of mobile homes.
MOTELA group of attached or detached buildings containing individual units where a majority of such units open individually and directly to the outside, where a garage is attached to or a parking space is conveniently located to each unit all for the temporary use by automobile tourists or transients, and which also may provide additional supporting services such as restaurants, meeting rooms, recreation, facilities and living quarters for a resident manager or proprietor. The term "motel" shall include tourist courts, motor courts, automobile courts, automobile camps and motor lodges.
NONCONFORMING LOTAny lot, the area or dimension of which was lawful prior to the adoption or amendment of this chapter, but which fails to conform to the requirements of the zoning district in which it is located by reason of such adoption or amendment.
NONCONFORMING STRUCTUREA structure or part of a structure which does not comply with the applicable area and bulk provisions of this chapter or amendment heretofore or hereafter enacted, where such structure lawfully existed prior to the enactment of this chapter or amendment or prior to the application of this chapter or amendment to its location by reason of annexation. Such nonconforming structures include, but are not limited to, nonconforming signs.
NONCONFORMING USEA use, whether of land or of a structure, which does not comply with the applicable use provisions in this chapter or amendment heretofore or hereafter enacted, where such use was lawfully in existence prior to the enactment of this chapter or amendment, or prior to the application of this chapter or amendment to its location by reason of annexation.
NUDITYThe showing of the human male or female genitals, pubic area or buttocks with less than a fully opaque covering, or the showing of the female breast with less than a fully opaque covering of any portion thereof below the top of the nipple, or the depiction of covered male genitals in a discerernably turgid state.
NURSING HOMEAn institution licensed by the Commonwealth for the longterm care of patients requiring skilled nursing or intermediate nursing care, but not including facilities for major surgery or care and treatment of narcotics addiction.
OFFICEA room or group of rooms used for conducting the affairs of a business, profession, service or government.
PARKING AREAA portion of a lot designed for the parking of motor vehicles in accordance with the requirements of this chapter.
PERSONAL SERVICESAny enterprise providing services pertaining to the person, their apparel, or personal effects commonly carried on or about the person including, but not limited to, shoe repair, tailoring, clothes cleaning, watch repairing, barber shops, beauty parlors and related activities.
PLANNING COMMISSIONThe planning Commission of the Borough of Saxonburg, Butler County, Pennsylvania.
PRE-SCHOOL FACILITYAn establishment which offers private educational services to children who are under the minimum age for education in public schools.
PRINCIPAL USEThe primary or predominant use to which the property is or may be devoted, and to which all other uses on the premises are accessory.
PRIVATEOwned, operated or controlled by an individual, group of individuals, association or corporation, not for profit, and restricted to members who meet certain qualifications and their guests.
PRIVATE CLUBAny establishment operated by an organization for social, recreational, educational, fraternal or sororal purposes, but open only to members and their guests, and not to the general public.
PRIVATE STABLEThe keeping of horses for personal use only on a lot which does not meet the minimum acreage requirements for a farm, not involving any profit-making activity such as boarding, riding instruction or training of horses owned by persons other than residents of the lot.
PUBLICOwned, operated or controlled by a government agency, Federal, State, County or local.
PUBLIC HEARINGA formal meeting held pursuant to public notice by the governing body or planning agency, intended to inform and obtain public comment, prior to taking action in accordance with this chapter.
PUBLIC MEETINGA forum held pursuant to notice under the Act of July 3, 1988 (P.L. 388, No. 84), known as the "Sunshine Act."
PUBLIC NOTICENotice published once each week for two successive weeks in a newspaper of general circulation in the Borough. Such notice shall state the time and place of the hearing and the particular nature of the matter to be considered at the hearing. The first publication shall not be more than 30 days and the second publication shall not be less than seven days from the date of the hearing.
PUBLIC UTILITY INSTALLATIONAny facility operated as a public utility, other than essential services, including, but not limited to, office buildings, maintenance sheds or other structures for human occupancy or storage of movable equipment, water and sewage treatment plants, water towers, inter-municipal transmission facilities, regulators, pumping stations, lift stations, switching facilities, substations, and similar facilities.
RECEPTION HALLA hall or similar structure intended to be rented for profit to the general public for holding celebratory events such as receptions, parties, shows and public events.
RECREATION, COMMERCIALAn enterprise operated for profit by other than a public entity, for the outdoor pursuit of sports, recreation or leisure activities including, but not limited to, such establishments as miniature golf, golf or batting practice facilities, ice or roller rinks, playing fields, racquet clubs, swimming pools, amusement parks, amphitheaters and similar facilities.
RECREATION, COMMERCIALAn enterprise operated by an individual, association or corporation, other than a public entity, whether or not for profit, and whether or not the facilities are advertised to the general public, including either indoor or outdoor facilities for the pursuit of sports, recreation or leisure activities, the use of which is limited to members and their guests including, but not limited to, such establishments as country clubs, golf courses, sportsman's clubs, golf practice facilities, playing fields, tennis or racquet clubs, swimming pools, and similar facilities.
RECREATION, PRIVATEAn enterprise operated by a public entity, available to the general public, whether or not an admission fee is charged, including either indoor or outdoor facilities for the pursuit of sports, recreation or leisure activities, including, but not limited to, parks, playgrounds, playing field, golf courses, golf or batting practice facilities, ice rinks, tennis courts, swimming pools, and similar facilities.
RECREATION, PUBLICAn enterprise operated by a public entity, available to the general public, whether or not an admission fee is charged, including either indoor or outdoor facilities for the pursuit or sports, recreation or leisure activities including, but not limited to, parks, playgrounds, playing fields, golf courses, golf or batting practice facilities, ice rinks, tennis courts, swimming pools, and similar facilities.
RESTAURANTAn establishment which offers food and beverages for sale and consumption either on or on and off the premises.
RETAIL BUSINESSEstablishments located entirely within an enclosed building which sell goods, services or merchandise to the general public for personal, household or office consumption and which shall not include wholesaling, manufacturing or processing of the goods offered for sale.
RETIREMENT COMMUNITYA residential development designed primarily or exclusively for occupancy by elderly or retired persons and which features one or more of the following special services associated with the needs of elderly or retired persons such as transportation, limited nursing facilities, dispensaries, common dining facilities, minimum maintenance, laundry service, recreation programs, personal services (such as beauty and barber shops, or cleaner's valet service), florist and/or gift shop, doctor's offices, branch bank, postal service and similar services or facilities.
SCHOOL, PUBLIC AND PRIVATEAn accredited institution of learning which offers elementary and secondary level instruction or which offers associate, bachelor or higher degrees in the several branches of learning required by the Commonwealth of Pennsylvania.
SEXUAL CONDUCTPatently offensive representations or descriptions of ultimate sexual acts, normal or perverted, actual or simulated, and patently offensive representations, descriptions or acts of masturbation, excretory functions, homosexuality, sodomy, sexual intercourse or physical contact with a person's clothed or unclothed genitals, pubic area, buttocks, or if such person be female, breasts.
SIGNAny structure or device used to attract attention by word or graphic display.
SIGN, SURFACE AREA OFThe area enclosed by one continuous line, connecting the extreme points or edges of a sign. The area shall be determined using the largest sign area or silhouette visible at any one time from any one point. This area does not include the main supporting sign structure, but all other ornamental attachments, innerconnecting links, etc., which are not part of the main supports of the sign shall be included in determining the sign area. The area shall include the smallest triangle, rectangle or circle which can wholly enclose the extreme outside points on the perimeter of the surface area of the sign. For two sided signs, only one face is counted in computing the surface area.
STORAGE TANKAny completely enclosed vessel, whether above ground or underground, which has the capacity to contain in excess of 100 gallons.
STREETA public or recorded private right-of-way which affords primary means of vehicular access to abutting property, but not including alleys.
STREET, PUBLICA public right-of-way dedicated and open for public use which has been adopted by the Borough, County, Commonwealth or other governmental body.
STRUCTUREAny man-made object having an ascertainable stationary location on or in land or water whether or not affixed to the land.
STRUCTURAL ALTERATIONSA change or re-arrangement of the structural parts of existing facilities, or an enlargement by extending the sides or increasing the height or depth, or the moving from one location to another. In buildings for business, commercial, industrial, or similar uses, the installation or rearrangement of partitions affecting more than 1/3 of a single floor area shall be considered an alteration.
SWIMMING POOLAny body of water or receptacle for water having a depth at any point greater than two feet and a surface area greater than 100 square feet, used or intended to be used for swimming or bathing and constructed, installed or maintained outside any building.
TEMPORARY STRUCTUREA building or structure intended to be used for a period of six months or less including, but not limited to, tents, bleachers, air-supported structures, seasonal displays and the like.
USE BY SPECIAL EXCEPTIONA use authorized by this chapter granted only by the Zoning Hearing Board following a public hearing subject to express standards and criteria contained in this chapter.
VARIANCEAn adjustment in the application of the specific regulations of this chapter granted by the Zoning Hearing Board in accordance with the criteria established by the Pennsylvania Municipalities Planning Code (Act 247, as amended) for a particular piece of property which, because of special circumstances applicable to it, cannot be developed in compliance with the literal terms of this chapter without undue physical hardship.
WAREHOUSINGA building used for the storage and handling of freight or merchandise, but not including the maintenance or fueling of commercial vehicles.
WHOLESALE BUSINESSAn establishment engaged in selling merchandise to retailers, institutional, commercial or professional business customers or other wholesalers, rather than to the general public, or acting as a broker for such merchandise sales.
YARDAn open space, other than a court, on a "lot", unoccupied and unobstructed from the ground upward unless specifically otherwise permitted in this chapter.
YARD, FRONTA yard extending between side lot lines across the full "lot width" from the street right-of-way line to a line parallel to the front lot line, the minimum horizontal distance required by this chapter.
YARD, SIDEA yard extending from the required front "building line" to the rear lot line, parallel to the side lot line, the minimum horizontal distance required by this chapter.
YARD, REARA yard extending across the rear of the lot between the required "side yard" lines, parallel to the rear lot line, the minimum horizontal distance required by this chapter.
