17.430 Temporary

Use Permits

17.430.010 Purpose – Applicability.

The purpose of these provisions is to set forth the requirements and procedures for the review of specified temporary uses. The requirement for a temporary use permit shall apply to temporary uses, including contractor storage yards, temporary trailer offices for businesses, and circuses and carnivals and other temporary uses as determined by the Planning Director. A temporary use permit shall not be required for events that are subject to a City special events permit, or for circuses, carnivals, and festivals sponsored by the City, with such sponsorship identified by resolution of the City Council, places of worship, or community nonprofit organizations on land controlled by said organizations or by public agencies, or for events which occur in theaters, meeting halls, other permanent public assembly facilities, or for private social gatherings. 17.430.020 Term.

The Planning Director may authorize temporary uses for one term of up to six months and may approve one extension of up to six months; terms, other than extensions, in excess of six months shall be subject to Planning Commission review. (Ord. 1111, 2018)

17.430.030 Conditions.

The decision-making authority may designate such conditions as determined to be necessary in order to secure the purposes of this code, and may require such guarantees and evidence that such conditions are being, or will be, complied with. (Ord. 1111, 2018)

17.430.040 Findings.

A temporary use permit may only be granted if the establishment, maintenance or operation of the proposed use applied for will not, under the circumstances of the particular case, be detrimental to the health, safety, peace, comfort and general welfare of persons residing or working in the neighborhood of such proposed use or development, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City.
