CHAPTER 927

Off-Street Parking and Loading Space Standards

927.01 PURPOSE.

   The purpose of these off-street parking and loading space regulations is to provide for convenient and efficient access to activities which require parking or loading, to limit on-street parking and loading, to facilitate safe on-site and off-site traffic flow, to encourage a more attractive economic, business, and residential climate, and to enhance and protect the physical appearance of the community.

927.02 REVIEW PROCEDURE AND APPLICABILITY.

   (a)    Applicability. No building or parking area shall be erected, substantially altered, or its use changed unless permanently maintained off-street parking and loading spaces have been provided in accordance with the applicable provisions of this Chapter.
   (b)   Change of Use, New Construction and Expansion. Whenever a new or existing building or parking area constructed is changed or enlarged in floor area, number of employees, number of dwelling units, seating capacity, or otherwise to create a need for an increase in the number of existing parking spaces, additional parking spaces and associated requirements shall be provided on the basis of the enlargement or change such that the site or use is in full compliance with the required number of parking spaces required under this Zoning Code.
   (c)   Review Procedure. The review process to determine conformance to all applicable regulations for parking or loading areas shall utilize the parking lot review procedure set forth in Chapter 925. (Ord. 03-2025. Passed 2-11-25.)

927.03 PARKING AREA DESIGN STANDARDS.

        (a)    Parking Area Setbacks. Parking and vehicular areas for non-residential uses and multi-family dwellings shall be located a minimum of fifteen (15) feet from the right-of-way line or access easement and at least ten (10) feet from a side or rear property line.
   (b)   Location of Parking Spaces. The following regulations shall govern the location of off-street parking spaces and areas:
           (1)    Off-street parking areas required for all single- and two-family residential dwellings shall be located on the same lot as the residential use which they are intended to serve.    
           (2)    All off-street parking areas required for multi-family residential uses shall also be located on the same lot with the building and uses served and shall be located in the side yard or rear yard area.
           (3)    All required off-street parking spaces for non-residential land uses shall be provided on the same lot and outside any public right-of-way area unless joint use parking is approved.
        
   (c)   Parking Area Screening. All parking areas shall be screened as set forth in Chapter 929.
   (d)   Lighting. Any parking area which is intended to be used during non-daylight hours shall be illuminated consistent with the lighting standards set forth in Section 925.07.
   (e)   Drainage. All parking spaces, together with driveways, aisles, and other circulation areas shall be graded and drained so as to dispose of surface water which might accumulate within or upon such area and shall be designed to prevent the excess drainage of surface water onto adjacent properties, walkways, or onto the public streets. Adequate arrangements shall be made to insure acceptable diversion to an adequate storm water drainage system.
   (f)   Visibility. Access of driveways for parking areas shall be located in such a way that any vehicle entering or leaving such parking area shall be clearly visible for a reasonable distance by any pedestrian or vehicle approaching the access or driveway from a public or private street or alley.
   (g)   Parking Space Striping. All parking areas, including ADA areas, shall be marked with paint lines, curbs, or in some other manner as approved by the Planning Commission and shall be maintained in a clearly visible condition at all times.
   
   (h)   Parking Area and Driveway Improvement Standards. Parking areas and access driveways shall be designed, graded, constructed, altered and maintained as follows:
         (1)   Grading and Pavement. Parking areas and access driveways shall be graded and drained so that surface water will not flow onto adjacent properties. Parking areas and driveways shall be improved with asphaltic concrete or Portland cement pavement, in accordance with standards established by the City Engineer. Gravel or other loose material not comprising a dust free hard surface shall be prohibited for use in any off-street parking and loading area including parking spaces, driveways, aisles and circulation drives.
         (2)    Entrance or exit driveways shall not exceed three (3) lanes in width and shall be designed so that all vehicles can be driven forward into the street. The width of such driveways, measured at the street right-of-way line, shall conform with the following:

        (3)    The angle of intersection between the driveway and the street shall be between seventy degrees (70°) and ninety (90°) degrees. The radii of the edge of the driveway apron shall be at least twenty-five feet (25').
         (4)    Driveways intersecting a public or private street shall be spaced at not less than one hundred twenty (120) foot intervals measured from the centerline of the driveways.
      (5)    An apron with a radius of twenty-five (25) feet at the curb line shall be provided to join the driveway to the street.
      (6)    Stormwater management requirements shall be reviewed by the City Engineer and designed according to the applicable standards set forth in the Stormwater Regulations.
      (7)   Appropriate curbs shall be provided to define off-street parking spaces from access and circulation driveways, and to prevent the extension of vehicles beyond parking spaces.
      (8)   Perimeters of parking areas shall be curbed or have other suitable barriers as approved by the Planning Commission.
   (i)   ADA Standards.
      (1)   Adequate street access to parking and loading spaces shall be provided and kept open maintained to be safe and in compliance with the property maintenance code and the Federal ADAAG accessibility guidelines and unobstructed.
      (2)   Maintenance shall include yearly patching of paving surfaces that have been damaged by winter freeze thaw, so as to be compliant with the one-fourth inch (¼") abrupt change in elevation per the ADA guidelines.
      (3)   Maintenance shall include re-striping of parking and cross walk aisles and ADA required signage.
      (4)   Each commercial building shall have two or more accessible means of egress out to the public way, in compliance with Chapter 10 of the Building Code.
      (5)   Each commercial building and each accessible tenant entrance shall have one or more accessible routes to and from the public way, in compliance with the Ohio Building Code and the Federal ADAAG accessibility design guidelines.
      (6)   Each commercial tenant accessible entrance shall have one or more accessible routes to each of the other accessible tenant entrances within a multi-tenant property.
      (7)   Maintenance shall include snow and ice removal. Snow shall not be piled up on required parking spaces or required means of egress or on accessible routes.
      (8)   ADA designated parking shall be compliant with all applicable ADA guidelines and shall be located closest to the accessible entrance to each tenant space.

927.04 PARKING SPACE DIMENSIONS.

        (a)    All new or altered parking areas shall conform to the parking space stall width, length, and aisle width, as set out in the Parking Dimensions Table below. Accessible parking spaces shall be provided in accordance with the American Disabilities Act of 1990, and any other applicable building code requirements.
        
   (b)    Accessible parking spaces shall be at least eight (8) feet wide with a five (5) foot passenger loading zone. Parking access aisles shall be part of an accessible route to the building or facility entrance. Two accessible parking spaces may share a common access aisle. Parked vehicle overhangs shall not reduce the clear width of an accessible route. Parking spaces and access aisles shall be level with surface slopes not exceeding 1:50 (2%) in all directions.

927.05 NUMBER OF PARKING SPACES REQUIRED.

   (a)   The minimum number of required parking spaces shall be set forth in the Minimum Required Parking Spaces Table provided in this Section.
   (b)   Multiple Land Uses on a Single Parcel. A parcel proposed for multiple tenants or land uses (for example, a building with ground-floor retail shops and second floor residential multi-family units) shall provide the aggregate number of parking spaces required for each separate use.
   (c)   Substantially Similar Land Use. The number of required parking spaces is set forth in the    Minimum Required Parking Spaces Table. In the event a land use is not listed in the Table, the following procedure for determining the appropriate land use designation shall be followed:
      (1)   The Building Commissioner shall refer to the land uses listed in Minimum Required Parking Spaces Table to assist in determining a suitable land use category that is substantially similar to the use under consideration based upon the proposed activities, operational characteristics, size and intensity of the proposed land use.
      (2)   If the Building Commissioner determines that the land use under consideration is not substantially similar to any of the land uses provided for in this Table, the Building Commissioner shall establish a minimum parking space requirement for the unidentified land use. This minimum parking space requirement shall be documented with supporting data and rationale setting forth a reasonable number of required parking    spaces based upon the land use under consideration and further based on those industry accepted parking plan elements including, but not limited to:
         A.   Estimated number of vehicle trips per day.
         B.   Estimated number of occupants for both all structures or open areas located upon the parcel under consideration based upon maximum building occupancy figures and other industry related data which provides insight into the intensity and timing of vehicle usage of the land use under consideration.

Residential Uses
Parking Spaces Required
Single Family Dwelling
Two (2) off-street parking spaces for each dwelling unit shall be provided on the same zoning lot. Both spaces shall be in a detached or attached enclosed garage.
Single Family Cluster Dwelling
(Applies to either attached or detached dwellings in a cluster development)   Each cluster dwelling unit shall have an enclosed garage providing storage for two (2) vehicles and also provide for a minimum of two (2) vehicle storage spaces in the required concrete driveway. Any driveway serving a dwelling shall have a minimum depth of 15'. The 15' required driveway depth shall not encroach into the sidewalk area.
Multi-Family Dwelling
Two (2) off-street parking spaces for each dwelling unit shall be provided on the same zoning lot. At least one required parking space per dwelling unit shall be enclosed or covered.
Multi-Family Dwelling (Townhouse Style)   
Two (2) off-street parking spaces for each dwelling unit shall be provided on the same zoning lot. Both spaces shall be in a detached or attached enclosed garage.
 
Residential Uses (Cont.)

Multi-Family Senior Living Facility
One and one half (1.5) off-street parking spaces shall be provided on the same zoning lot for each dwelling unit. At least one required parking space per dwelling unit shall be enclosed or covered.
Senior Care Facility
One space per six residents + one space per employee. When multiple shifts are expected, the maximum employee shift count shall be used.
Attached and Detached Single-Family Senior Cluster Dwelling Parking Requirements.
An attached or detached single-family senior cluster dwelling shall provide for a minimum of one (1) enclosed parking space per unit. Additional guest parking spaces shall be determined by the Planning Commission during the Development Plan review and approval process.

One space for each three seats or one space per 50 sq. ft. of net floor area where fixed seating is not available.
Athletic / play field   
Ten spaces per acre.
Day care center, child, pre-school
One space per employee + one space for each facility vehicle stored on the lot + one parking space for each six children.
Educational institution school, elementary and middle school
One space for each three seats in any auditorium, or one space for each classroom, whichever is greater.
Educational institution high school
One space per employee + twelve visitor spaces, plus one space per six students.
Vocational / professional school
One space per employee + one space per two registered student capacity.
College or University
One space per two employees + one space per four students.
Funeral home or mortuary
One space per 75 sq. ft. of parlor or chapel space or one per five seats, whichever is greater, but not less than 20 spaces.

Club, Private
One space for each 50 square feet of net floor area used for assembly.
Convenience store
(with or without gasoline pumps)
One space per 200 sq. ft. of net floor area + one space per gasoline pump + one space per employee.
Drive-in or drive-through facility
A minimum of five stacking spaces per lane + one space per employee if entirely drive-through. Planning Commission may require additional spaces as determined on a case-by-case basis.
Financial institution
One space per 200 sq. ft. of net floor area + stacking space for drive-in service lane.
Grocery store
One space per 167 sq. ft. of net floor area.
Hotel
One space per lodging unit, meeting rooms and restaurants calculated separately.

One space per 50 sq. ft. of net floor area + one space for each employee on the largest shift. If drive-through, provide five stacking spaces per drive-through lane.
Retail, sales and service
One space per 250 sq. ft. of net floor area.
Shopping center
One space per 222 sq. ft. of net floor area of general retail space + additional spaces, as required herein, for associated offices, theaters, and restaurants.
Swimming pools, tennis or racquet clubs, and similar recreation facilities open to the public for a fee
One parking space for each 50 square feet of pool area; eight spaces for each indoor tennis court; five spaces for each outdoor tennis court; five spaces for each racquet ball and/or handball court.

927.06 SHARED USE PARKING AREA.

   (a)   Shared Use Parking Area. Required Off-street parking spaces may be located on a different parcel if approved by the Planning Commission and subject to the following standards.
      (1)    Two (2) or more non-residential uses, which do have overlapping hours of operation, may jointly provide and use parking spaces. The total number of such shared spaces must equal the sum of the minimum number of spaces required for each separate use, except that the Planning Commission may, subject to conditions it deems appropriate, reduce the total number of parking spaces required by the strict application of this Chapter.
      (2)   The applicant must sufficiently demonstrate that fewer spaces than those required by this Chapter will adequately serve two (2) or more uses by reason of the hourly parking accumulation characteristics of such uses and such reduction will not adversely affect the site or the adjacent area.
      (3)   As a condition of any approved shared use parking area request, the applicant shall be required to provide proof of a recorded reciprocal parking and access easement prior to a certificate of occupancy permit being issued. This covenant shall run with the life of the project to guarantee required parking is maintained and reserved for the subject activity.
      (4)   A change of use or substantial expansion of use by any party to the shared use parking easement requires re-submission of a shared use parking area request and determination by the Planning Commission.

927.07 PARKING AREA MAINTENANCE REQUIREMENTS.

   (a)   These parking area maintenance requirements shall apply to any non-residential and multi-family land use. The property owner(s) and/or tenant(s) shall have a continued obligation to maintain parking area landscaping elements, parking area surfaces, access drives and any other related parking area element in good condition as originally approved by the Planning Commission. Some examples of maintenance obligations include, but are not limited to:
      (1)    Landscaping shall be kept alive and maintained in a healthy manner consistent with the aesthetic and screening considerations.
      (2)    Parking area surfaces shall be kept free of holes and substantial deterioration.
      (3)    Striping shall be clearly visible.
      (4)    Parking area directional signs shall be kept in place and clearly legible.
   (b)   Parking spaces shall be marked with paint lines, curbs, or in some similar manner approved by the Planning Commission and shall be maintained in a clearly visible condition.
   (c)   The Building Commissioner shall have the authority to prohibit the use of the area for parking purposes unless and until proper maintenance, repair or rehabilitation is completed.

927.08 OFF-STREET LOADING SPACE STANDARDS.

   (a)   These off-street loading space standards shall apply to all non-residential land uses.
   (b)   An off-street loading space shall have minimum dimensions of not less than twelve (12) feet in width, fifty (50) feet in length, exclusive of driveways, aisle, and other circulation areas, and a height clearance of not less than fifteen (15) feet.
   (c)   One off-street loading space shall be provided and maintained on the same lot for each separate occupancy requiring deliveries and having a minimum gross floor area of five thousand (5,000) square feet.
   (d)   The Planning Commission may require additional loading spaces based on the size, intensity and    specific operational activities of a particular land use.

927.09 OFF-STREET PARKING AND LOADING SPACE INTERPRETATION STANDARDS.

      (a)    Parking spaces for other permitted or conditional uses not listed in this Chapter shall be determined by the Planning Commission.
        
   (b)    Fractional numbers shall be increased to the next whole number.
        
   (c)    Where floor area calculations are relevant to determine parking space requirements under this Chapter, and except as otherwise provided herein, "usable floor area" shall be employed as the standard.

927.10 OFF-STREET PARKING AND LOADING SPACE WAIVER.

   (a)    An applicant may request one or more waivers from a required off-street parking or loading space standard found in this Chapter.
   (b)   The applicant shall provide written justification for the requested waiver including how the goals and intent of this Chapter and any other applicable Chapter of this Zoning Code is satisfied if required standards is modified or waived by the Planning Commission.
   (c)   Standard of Review Criteria. The Planning Commission shall review the requested waiver as part of the Development Plan review process using the following standard of review criteria:
                (1)    The specific conditions which are unique to the applicant's parcel.
                (2)    The manner in which the strict application of the provision of this Chapter would deprive the applicant of a reasonable use of the land in a manner equivalent to the use permitted other landowners in the same zoning district.
                (3)    The unique conditions and circumstances are not the result of actions of the applicant subsequent to the adoption of this Chapter.
               (4)    A modification or waiver of a standard shall preserve, and not harm, the public safety and welfare, and shall not alter the essential character of the neighborhood.
