903.01 PLANNING COMMISSION ESTABLISHMENT AND ORGANIZATION.
(a)Appointment, Powers and Terms. See City Charter Article V, Section 7 for provisions relative to the appointment, powers and terms of members of the Planning Commission.
(b)Compensation. Each member of the Planning Commission shall be paid an annual salary based upon the most recent compensation figure as adopted by City Council, payable on a monthly basis.
(d) Adoption of Rules and Regulations. The Planning Commission shall exercise only such authority with respect to the submission and approval of plats and subdivisions as is specifically set forth in the rules and regulations contained in Chapters 933 and 935 Subdivision Regulations of this Zoning Code, and shall be bound in its jurisdiction thereunder by such rules and regulations as the same are now constituted or as the same may be amended.
(e)Time Allotted for Action on Referral. It is hereby determined that the Planning Commission of the City, shall have sixty days from the date of referral of any matter so referred to it by City Council pursuant to the provisions of City Charter Article V, Section 7(e), to act upon such matter and report such action to City Council. If the Planning Commission shall fail to act within the time allotted, it shall be deemed to have approved such matter.

903.02 FEE REQUIRED TO COVER EXPENSES.
No action of the Planning Commission shall be heard on any matter until the applicable fee has been paid by the applicant as established in the most recent fee schedule adopted by City Council. Such fees shall be used by the City to defray expenses of required notices, legal publications, consultant plan review services and other applicable costs.

903.03 AUTHORITY AND DUTIES OF THE PLANNING COMMISSION.
(a) Authority and Duties of the Planning Commission. For the purpose of this Zoning Code, the Planning Commission shall have the following duties:
(1) Implement such rules and provisions adopted through a set of by-laws or similar organizational document necessary to carry out the duties assigned by this Zoning Code.
(2) Interpret the provisions of this Zoning Code in such a way as to carry out the intent and purpose of the Seven Hills Master Plan.
(3) Hear, initiate, review, and make recommendations related to amendments to this Zoning Code text as set forth in Chapter 901.
(4) Hear, initiate, review, and make recommendations related to amendments to the zoning map as set forth in Chapter 901.
(5) Review and make decisions on applications for Development Plans as set forth in Chapter 925.
(6) Review and make decisions on subdivision plans as set forth in Chapters 933 and 935.
(7) Review and make decisions on applications for conditional use permits as set forth in Chapter 921.
(8) Consider and decide any questions related to the interpretation of the Zoning Code text or the zoning map and zoning district boundaries in such a way as to carry out the intent and purpose of the Seven Hills Master Plan and this Zoning Code.
(9) Perform all other duties as authorized by this Zoning Code, the Municipal Charter or other ordinances of the City.

903.04 PUBLIC HEARING PROCEDURE.
(a) The following public hearing procedure shall be used by the Planning Commission when required by this Zoning Code.
(1)Public Hearing Notice Requirements. Proper notice of a public hearing before the Planning Commission shall consist of the following notice(s) given at least five (5) business days prior to the date of such hearing, in such manner as the Commission may, by its rules, prescribe:
A. Written notice to any other property owners or their agents directly affected, as determined by the Planning Commission on a case-by-case basis, so far as is practicable, and in such manner as the Planning Commission may, by its rules, prescribe at least five (5) business days prior to the date of such public hearing.
B. Posted on the City website, at least fourteen (14) days prior to the public hearing, and
C. Posted at City Hall and the Recreation Complex at least fourteen (14) days prior to the public hearing.
(b) Failure of delivery of such notice set forth in this Section shall not invalidate action taken on such application.
(c) The Planning Commission may recess and continue a public hearing without making a final determination on the matter, and, if the time and place of the continued hearing is publicly announced at the time of the adjournment, no further notice shall be required.
(d) Any interested person may appear at the public hearing in person or by attorney.
(e) The Planning Commission may call upon any City department or outside consultant for assistance in the performance of its duties and it shall be the duty of such departments to render such assistance to the Commission as may reasonably be required.
