ARTICLE I
General Provisions
§ 340-1 Short title.
This chapter shall be known as and may be cited as the "Silverdale Borough Zoning Ordinance of 2003."
§ 340-2 Purpose.
The purpose of this chapter is the promotion of the health, safety, morals, convenience, order and welfare of the present and future inhabitants of Silverdale Borough by:
A.
Lessening congestion on roads and streets;
B.
Securing safety from fire, panic, flood and other dangers;
C.
Promoting the appropriate use and development of land and resources in accordance with the Silverdale Borough Comprehensive Plan of 2002;
D.
Providing adequate areas for vehicle parking and loading space;
E.
Providing adequate light and air, access to solar energy, and a safe and reliable and adequate water supply for domestic, commercial, and industrial areas;
F.
Promoting health and the general welfare of the residents of the Borough;
G.
Promoting the proper density of population;
H.
Accommodating reasonable overall community growth, including population and employment growth, and opportunities for development of a variety of residential dwelling types and nonresidential uses;
I.
Encouraging the most appropriate use of land;
J.
Facilitating the adequate provision of transportation, water, sewerage, schools, parks, and other public improvements;
K.
Promoting the preservation of natural, scenic and historic resources;
L.
Conserving the value of land and buildings; and
M.
Encouraging harmonious and orderly development.
§ 340-3 Compliance required.
Except as hereinafter provided, no building, structure, land or parts thereof shall be used or occupied, erected, constructed or assembled, moved, enlarged or structurally altered and no change of use of any land or structure or portion thereof shall occur, unless in conformity with the provisions of this chapter, until a valid zoning permit has been applied for and obtained from the Silverdale Borough Zoning Officer. Failure to obtain a zoning permit shall constitute a violation of this chapter, subject to the penalties hereinafter provided.
§ 340-4 Interpretation.
In applying and interpreting the provisions of this chapter, they shall be held to be the minimum requirements for the promotion of the public health, safety, comfort, convenience and general welfare.
A.
Whenever any regulations made under authority of this chapter require a greater width or size of yards, courts or other open spaces, or require a lower height of buildings or smaller number of stories, or require a greater percentage of lot to be left unoccupied, or impose other higher standards than are required in or under any other statute, the provisions of the regulations made under authority of this chapter shall govern.

Whenever the provisions of any other statute require a greater width or size of yards, courts or other open spaces, or require a greater percentage of a lot to be left unoccupied, or impose other higher standards than are required by any regulations made under authority of this chapter, the provisions of such statute shall govern.
C.
This chapter does not repeal, abrogate, annul or in any way impair or interfere with existing provisions of other laws or ordinances, except those specifically or impliedly repealed by this chapter, or any private restrictions placed upon property by covenant, deed or other private agreement, unless repugnant hereto.
§ 340-5 Statement of community development objectives.
It shall be, and is hereby declared to be, the objective of Silverdale Borough to continue to provide for the orderly development of the Borough through its Zoning Ordinance and Subdivision and Land Development Ordinance[1]as are presently in effect or as may be amended. It shall also be the mission of this chapter to implement the goals, objectives and recommendations of the Silverdale Borough Comprehensive Plan (2002), which is incorporated herein by reference.
