ARTICLE XVI

GOVERNMENT UTILITIES, RECREATION/OPEN SPACE, PUBLIC SCHOOLS, PUBLIC PARKING AREAS AND GOVERNMENT ADMINISTRATION

Sec. 16.0.- Purpose.]

The purposes of this zoning district are as follows: to provide areas suitable for public recreation and open space; to provide areas suitable for public schools; to provide areas suitable for public parking; to provide areas suitable for the conduct of the essential functions of local government.

Sec. 16.1. - Uses permitted.

No building, structure, land or water shall be used except for one or more of the following uses:

1.

Essential services and service structure relating to potable water, sanitary sewers, storm water drainage, solid waste, telephone, gas, electric, cable television and any other related utility systems.

2.

Playgrounds, tennis courts, ballparks, swimming, fishing, boating, golfing, hiking, walking, jogging, bicycling, shuffleboard, basketball, handball, racquetball, any other similar recreational use and essential services which may be needed to supply and/or monitor recreational activities.

3.

Public schools and libraries.

4.

Publicly owned recreational vehicle parks and boat ramps.

5.

Governmental office buildings, police station, fire station, courthouse, public works service facilities and essential services.

Sec. 16.2. - Designation of areas for governmental use.

The city commission of the city of South Bay, Florida, shall designate the areas to be used under section 16.1 if the property to be used is owned by the State of Florida, Palm Beach County, the City of South Bay, Florida, or any governmental agency. All other areas to be considered for use under section 16.1 shall apply for a special exception use and shall be subject to the special exception procedure for approval.

Sec. 16.3. - Building height regulations.

No buildings shall exceed the height stated below for the various categories of uses:

1.

Government. Forty (40) feet, except for fireman's training tower that may be fifty (50) feet.

2.

Public schools and public libraries. Fifty (50) feet.

3.

Utilities. Forty (40) feet, except for a water tower that may be one hundred fifty (150) feet.

4.

Recreation structures. Forty (40) feet.

Sec. 16.4. - Building site area regulations.

1.

For essential government functions, the minimum lot or building site area shall be ten thousand (10,000) square feet. The minimum width of the lot measured at the building line shall be one hundred (100) feet. The minimum lot depth shall be seventy-five (75) feet.

2.

For public schools, the minimum lot or building site area shall be ten thousand (10,000) square feet. The minimum width of the lot measured at the building line shall be one hundred (100) feet. The minimum lot depth shall be seventy-five (75) feet.

3.

For utilities, the minimum lot or building site area shall be ten thousand (10,000) square feet. The minimum width of the lot measured at the building line shall be one hundred (100) feet. The minimum lot depth shall be seventy-five (75) feet.

4.

For recreational structures, considered on the basis of each special exception application where applicable.

Sec. 16.5. - Maximum building dimension and lot coverage requirements.

1.

For essential government functions, the maximum building dimension shall not exceed two hundred (200) feet. Lot coverage by the principal building and accessory structures shall not exceed fifty (50) percent of the gross area of the building site area.

2.

For public schools, the maximum building dimension shall not exceed two hundred (200) feet. Lot coverage by the principal building and accessory structures shall not exceed fifty (50) percent of the gross area of the building site area.

3.

For utilities, the maximum building dimension shall not exceed one hundred (100) feet. Lot coverage by the principal structure and accessory structures shall not exceed sixty (60) percent of the gross area of the building site area.

4.

For recreational structures, considered on the basis of each special exception application where applicable.

Sec. 16.6. - Yard setbacks.

1.

For essential governmental functions, all principal structures shall be set back from property lines as follows:

a.

Front yard setback: Thirty (30) feet.

b.

Side yard setbacks: Fifteen (15) feet per side.

c.

Rear yard setback: Fifteen (15) feet.

2.

For public schools, principal structures shall be set back from the property lines as follows:

a.

Front yard setback: Thirty (30) feet.

b.

Side yard setbacks: Fifteen (15) feet per side.

c.

Rear yard setback: Fifteen (15) feet.

3.

For utilities, principal structures shall be set back from the property lines as follows:

a.

Front yard setback: Thirty (30) feet.

b.

Side yard setbacks: Fifteen (15) feet per side.

c.

Rear yard setback: Fifteen (15) feet.

4.

For recreational structures, considered on the basis of each special exception application where applicable.

Sec. 16.7. - Open space requirements.

A minimum of open space area, landscaped and kept "green" [2] shall be maintained in the percentages that follow:

1.

For essential government functions: Thirty (30) percent.

2.

For public schools: Thirty (30) percent.

3.

For utilities: Twenty (20) percent.

4.

For recreational facilities: Considered on the basis of each special exception application where applicable.

The term "green" shall not be construed as prohibiting the use of creative landscaping, including gravel, tile, etc., instead of grass, as long as a green landscaped appearance is achieved.
