Yard Regulations

§ 208-14.2 General regulations.

A. 
No building or part thereof shall project into any yard as the same is defined in or required by this chapter.
B. 
No yard or open space required in connection with any building or use shall be considered as providing a required open space for any other building on the same or any other lot.

§ 208-14.3 Projections into required front and rear yards; general exceptions.

A. 
The ordinary projection of parapets, windowsills, doorposts, rainwater leaders and similar ornamental or structural fixtures may project a maximum distance of 12 inches into required yards; eaves or other such roof overhangs may project a distance of 12 inches, including any gutters attached thereto, into required yards unless the same are at least 10 feet above the natural grade beneath, in which case the permitted projection shall be 24 inches.
B. 
Cornices, canopies, bay windows and necessary landings and other similar architectural features may project a maximum distance of 12 inches into required yards.
C. 
Chimneys or flues may project a maximum distance of six inches into required yards except in residential zones, wherein one such chimney may project no more than twenty-four inches as long as such projection has a width of no more than six feet and so long as such projection is in either the front, rear or the larger of the two side yards only.
D. 
Patios and decks may be located in any required rear yard only, provided that they are not closer than five feet to a property line and so long as they do not exceed a height of four feet over the natural grade of such yard, exclusive of railings, which shall not exceed an additional height of 36 inches.
E. 
Fences and walls may project into any required yard subject to all other applicable regulations.
F. 
Unenclosed structures commonly known as “porches” or “stoops,” together with the steps leading thereto, may project into any required front or rear yard a distance of no more than eight feet so long as such structures have a width no greater than six feet and a height no greater than six feet exclusive of railings and banisters as required by the BOCA Code.

§ 208-14.4 Projections into required side yards; general exceptions.

The same projections as permitted into front and rear yard under § 208-14.3 hereof are permitted into required side yards (unless that provision is expressly limited to one or both of those yards) except that no porch, terrace or outside stairway shall project into any required side yard unless such construction is no higher than the first-floor level of the house, exclusive of railings and banisters required by the BOCA Code, if the same is unroofed and unenclosed and is less than 10 feet in the dimension parallel to nearest lot side line, in which case it shall be permitted to project into required side yard not more than three feet six inches.

§ 208-14.5 Front yard requirements affected by Master Plan or Official Map.

Where any lot fronts upon a street right-of-way which is proposed to be widened as indicated on an Official Map or an adopted Master Plan of the Township of South Hackensack, the front yard shall be measured from such proposed future right-of-way line.

§ 208-14.6 Front yard requirement affected by future widening.

Where any lot fronts upon a street right-of-way which is proposed to be widened by means of a proposed dedication of land for a right-of-way widening or proposed easement for road widening purposes, the front yard shall be measured from such proposed future right-of-way or easement line.
