Sec. 13-5(a).- Short title.

This title shall be known, referred to and cited as the Submittal Guidelines for the City of Southaven, Mississippi and shall govern all development within its jurisdiction.

Sec. 13-5(b). - Purpose.

The purpose of this title is to provide for the coordination of overall developments including streets within subdivisions with other existing or planned streets or with other features or lots or tracts; for requirements of the preliminary and final plats; for minimum standards of physical improvements in new standards of physical improvements in new subdivisions; for adequate open spaces for traffic, utilities, firefighting apparatus, recreation, light and air; and for distribution of population and traffic; all of which are intended to improve health, safety and general welfare of the community.

Sec. 13-5(c). - Plat approval required.

It shall be unlawful for any person being the owner, agent or person having control of any land within the incorporated areas of the city to subdivide or lay out such land in lots unless by a plat in accordance with the regulations contained herein. No lots shall be sold nor any plat recorded until the plat has been approved as herein provided.

Sec. 13-5(d). - Annexed areas.

Any area hereafter annexed to the city immediately upon annexation shall no longer be subject to the Desoto County subdivision regulations, but shall conform to the subdivision development manuals regulations adopted by the city.

Sec. 13-5(e). - Variances.

Whenever the tract to be subdivided is of such unusual size or shape, or in the interest of the preservation of existing trees and other natural beauty, or is surrounded by such development or unusual conditions that the strict application of the requirements contained in this title would result in real difficulties or substantial hardship or injustice, the governing authority, after report by the planning commission, may vary or modify such requirements so that the subdivider may develop his property in a reasonable manner, but so that at the same time the public welfare and interests of the city are protected and the general intent and spirit of this title are preserved.

Sec. 13-5(f). - Recommendations from neighborhood municipalities.

If a major subdivision lies within one (1) mile of a boundary between municipality and county, the application shall be referred to the governing authority thereof for a recommendation prior to final approval.

Sec. 13-5(g). - Amendments.

Any regulations or provisions of this title may be changed and amended from time to time by the governing authority in accordance with applicable state statutes.

Sec. 13-5(h). - Compliance.

It shall be illegal to sell, or offer to sell, any lot, tract or property, which does not conform to the requirements and regulations of this title. In the case of any violation of this title, the governing authority, in addition to other remedies, may institute any appropriate action or proceedings to prevent such unlawful acts.

Sec. 13-5(i). - Penalty.

Any person, firm or corporation who shall knowingly and willfully violate the terms, conditions or provisions of this title, for violation of which no other criminal penalty is prescribed, shall be guilty of misdemeanor and upon conviction shall be sentenced to pay a fine not to exceed five hundred dollars ($500.00), and in case of continuing violations without reasonable effort on the part of the defendant to correct the same, each day the violation continues thereafter shall be a separate offense.

Sec. 13-5(j). - Conflicts.

The regulations in this title are not intended to interfere with or annul any other ordinance, rule or regulation, statute or other provision of law. Where any provision of this title imposes restriction different from those imposed by any other provision of this title or any other ordinance, rule or regulation, or other provision of law, whichever provisions are more restrictive shall control.
