Spencer City Zoning Code

   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.

   EVENTS CENTER. An indoor facility used for public assembly, agricultural, automotive, equipment, general retail and food sales, restaurant, recreation, sports, amusement and entertainment.

   FARMING. The cultivation, raising, harvesting, storing and marketing of grain, hay or straw, but not including breeding, feeding, raising or keeping of any livestock or animals.

   LIVESTOCK SHOWS. Shows, demonstrations, sales or competitions of all types of livestock and domestic animals.

   Within the F Fair and Exposition District, unless otherwise provided in this chapter, no building or land shall be used for other than one or more of the following purposes.

   (A)   Residential uses. None.

   (B)   Commercial uses.

      (1)   Agricultural demonstrations;

      (2)   Agricultural sales and services;

      (3)   Auction sales;

      (4)   Automotive sales;

      (5)   Business support services;

      (6)   Carnival rides, games and activities;

      (7)   Cocktail lounge;

      (8)   Commercial off-street parking;

      (9)   Commercial recreation, including indoor sports and recreation, outdoor sports and recreation, and indoor entertainment;

      (10)   Convenience storage;

      (11)   Convenience stores;

      (12)   Equipment sales;

      (13)   Farming;

      (14)   Food sales;

      (15)   General retail sales;

      (16)   Outdoor entertainment;

      (17)   Parking facilities;

      (18)   Restaurant (convenience);

      (19)   Restaurant (general);

      (20)   Vehicle, boat, implement, grain and miscellaneous equipment storage; and

      (21)   Visitor habitation - campground.

   (C)   Industrial uses. None.

   (D)   Civic uses.

      (1)   Administrative offices (fair related);

      (2)   Cultural services;

      (3)   Events center;

      (4)   Livestock shows;

      (5)   Local utility services;

      (6)   Maintenance and service facilities (fair related);

      (7)   Parking facilities;

      (8)   Postal facilities; and

      (9)   Public assembly.

   The following uses and structures may be permitted in the F Fair and Exposition District subject to the approval of the Board of Adjustment.

   (A)   Residential uses.

      (1)   Residences for employees; and

      (2)   Wind energy system.

   (B)   Commercial uses.

      (1)   Communications towers;

      (2)   Dormitory; and

      (3)   Hotel/motel.

   Unless otherwise provided in this chapter, each development in the F Fair and Exposition District shall be subject to the following regulations:

   (A)   Minimum lot area: five acres;

   (B)   Maximum height: 120 feet; and

   (C)   Front, side and rear yard setback: 50 feet.
