CHAPTER 10

11 AMENDMENTS

10-11-1 PROCEDURE; APPLICATION

Amendments to this title or the official zone map shall be upon recommendation from the planning commission, then subject to review and final approval or denial by the city council. Applications for amendment shall contain the following:

  1. Designation Of Amendment: Designation of the specific zone change or title amendment desired.
  2. Statement Of Reason And Justification: The reason and justification for such zone change or title amendment, and a statement setting forth the manner in which a proposed title amendment or zone change would further promote the objectives and purposes of this title.
  3. Legal Description: A complete and accurate legal description of the area proposed to be rezoned, or a draft of the proposed title amendment.
  4. Plat: An accurate plat, drawn to scale, showing all areas to be included within the proposed rezoning, designating the present zoning of the subject property and properties immediately adjacent thereto.
  5. List Of Property Owners: A list of all property owners within a radius of three hundred feet (300') of the boundaries of the property to be rezoned, as taken from the latest assessment polls prepared by the county assessor. (Ord. 93-5, 7-2-1998)
  6. Filing Fee: A nonrefundable filing fee of such amount as the city council may from time to time establish by resolution. (Ord. 93-5, 7-2-1998; amd. 2002 Code)
  7. Public Hearing; Decision: The city council, after fifteen (15) days' notice and at a public hearing, shall approve, modify and approve, or deny any amendment to this title or zone map. (Ord. 93-5, 7-2-1998)
