CHAPTER 10

2 PLANNING AND ZONING COMMISSION

10-2-1 ESTABLISHED; COMPOSITION; APPOINTMENT

Pursuant to authority granted in Utah Code Annotated section 10-9a-301, as amended, the City Council hereby creates a Planning and Zoning Commission within and for the City to be known as the Spring City Planning and Zoning Commission. The Planning and Zoning Commission shall consist of five (5) members to be appointed by the Mayor,  with the consent of the City Council. The Mayor and City Council shall also select one member of the City Council to be the Planning and Zoning Commission liaison, whose duties will be to keep both the City Council and Planning and Zoning Commission informed on current projects, concerns, and needs of each organization. The liaison is a non-voting Council representative, attending Planning and Zoning Commission meetings, assigned to assist in any discussions and research that will support the decision-making of the Planning and Zoning Commission. There shall be two(2) alternates in place to replace a current member's term if necessary. The members shall be selected without respect to political affiliations and shall serve without compensation, except for reasonable expenses. Attendance of three (3) or more Commission members at meetings constitutes a quorum. (Ord. 2017-01, 3-2-2017)

10-2-2 TERMS OF OFFICE; VACANCIES; REMOVAL

The term for the City Council member liaison to Mayor and Council for the Planning and Zoning Commission shall correspond to his tenure in office. The terms for the appointive members shall be for five (5) years and until their successors shall have been appointed; provided that the terms of the members first appointed shall be arranged such that the term of two (2) members shall expire every other year. Appointments made thereafter will be made for a full five (5) year term; those serving as members have the opportunity to be reinstated for more than one (1) 5-year term. For vacancies occurring other than through the expiration of terms, the Mayor, with the consent of the City Council, shall appoint members for the remainder of the unexpired term. Members may be removed after public hearing by a majority vote of the City Council. (Ord. 2014-01, 5-15-2014)

10-2-3 ORGANIZATION; ADOPTION OF RULES; RECORDS

The Planning and Zoning Commission shall elect from its membership a Chairperson and shall adopt rules for its own organization and for the transaction of its business not in conflict with this chapter or other ordinances. (Ord. 2005-02, 9-8-2005)

10-2-4 EMPLOYEES; EXPENDITURES

The Planning and Zoning Commission may appoint such employees and staff as it may deem necessary for its work and may contract with City planners and other consultants, provided its expenditures, shall be within the amounts appropriated for that purpose by the City Council. 10-2-5 POWERS AND DUTIES

The Planning and Zoning Commission shall have such powers as may be necessary to enable it to perform its functions and promote City planning as follows:

  1. Preparation Of Comprehensive Plan: It shall be the function and duty of the Planning and Zoning Commission, after holding public hearings, to make and adopt and certify to the City Council, a Comprehensive Plan for the physical development of the City, including any areas outside of its boundaries which, in the Planning and Zoning Commission's judgment, bear relation to the planning of the City. Where the plan involves territory outside the boundaries of the City, action shall be taken with the concurrence of the County or other municipal legislative bodies concerned. The Comprehensive Plan, with the accompanying maps, plats, charts and descriptive and explanatory matter, shall show the Planning and Zoning Commission's recommendations for the said physical development and may include among other things, the general location and extent of streets and other methods of circulation and transportation; the general location and extent of public utilities for water, power, sanitation or other purposes; the general location and extent of parks, playgrounds and drainage facilities; and the use of land, whether for residences, commerce, industry, agriculture, flood channels or open space. The Planning and Zoning Commission may from time to time amend, extend or add to the plan or carry any part or subject matter into greater detail.
  2. Prepare Reports And Recommendations; Entry Upon Land: The Planning and Zoning Commission may make reports and recommendations relating to the plan and development of the City to public officials and agencies, other organizations and citizens. It may recommend to the executive or legislative officials, programs for public improvements and the financing thereof. The Planning and Zoning Commission, its members and employees, in the performance of its functions, may enter upon any land at reasonable times to make examinations and surveys and place and maintain necessary monuments and markers thereon.
  3. Regulations Governing Subdivision Of Land: It shall be the duty of the Planning and Zoning Commission to prepare regulations governing the subdivision of land within the City or amendments to such regulations and to submit said regulations or amendments to the City Council for adoption.
  4. Approve Subdivision Plans And Plats: It shall be the duty of the Planning and Zoning Commission to review and approve all subdivision developments. No plat of a subdivision of land within the City or the Buffer Zone shall be filed or recorded in the County Recorder's office until it shall have been submitted to and approved by the Planning and Zoning Commission and such approval entered in writing on the plat. The approval by the Planning and Zoning Commission shall be in addition to the approval required from the City Council. The filing or recording of a plat of a subdivision without such approval shall be null and void and the transfer or sale of lots in any such unapproved subdivision shall be considered a violation of the subdivision ordinance for each lot so transferred or sold.
  5. Prepare Zoning Plan: The Planning and Zoning Commission, through its own initiative may, or by order of the City Council shall, make and certify to the City Council a zoning plan, including both the full text of the zoning regulations and maps, and representing the Planning and Zoning Commission's recommendations for zoning the City.
  6. Prepare Recommendations For Amendment To Zoning Regulations: The zoning regulations, including the maps, may be amended from time to time by the City Council. However, all proposed amendments shall be first submitted to the Planning and Zoning Commission for its recommendation which shall be returned to the City Council for its consideration within thirty (30) days.
  7. Preparation Of A Multiyear Improvement Program: The Planning and Zoning Commission, through its own initiative may, or by order of the City Council shall, make and recommend to the City Council a Multiyear Improvement Program, which shall set forth an orderly program for the acquisition of land, buildings and other facilities that are needed for City purposes.
  8. Conduct Hearings and Meetings: The Planning and Zoning Commission may conduct hearings and meetings with interested property owners, officials and citizens in the process of carrying out the functions and duties of its office. (Ord. 2005-02, 9-8-2005)
