100 - PLANNING & ZONING COMMISSION
The continued existence and service of the planning and zoning commission (the "commission") is hereby recognized by the city council of the City of Spring Valley, Texas. (Ordinance 190, Book I, Section 2, adopted 5-24-88)
(a)
Members. The commission shall be composed of seven (7) regular members and one (1) alternate member. Members shall be resident citizens of the City of Spring Valley, Texas.
(b)
Selection and Period of Service.
(1)
The mayor shall select, subject to approval by the city council, the regular and alternate members of the commission. Commission members so selected and approved shall serve in such capacity for period of not more than two (2) years. Four (4) members of the commission will serve terms beginning on odd-numbered years, and four (4) members will serve terms beginning on even-numbered years. The alternate member shall serve in the absence of a regular member when requested to do so by the chairman of the commission. Vacancies for the unexpired term of any member whose term becomes vacant shall be filled by selection by the mayor, subject to approval by the city council. Newly selected members shall be duly sworn and installed at the first regular commission meeting or city council meeting after their appointment, or as soon thereafter as practicable. Members of the commission shall serve without compensation.
(2)
Members shall serve at the pleasure of city council and are subject to removal by the city council at any time, with or without cause, and shall have no expectation of continued service either in the position or on the commission. A member who is absent from three (3) consecutive meetings of the commission shall be subject to removal by city council.

Vote. Each commission member in attendance at a duly called meeting may vote.
(b)
Officers. The commission shall elect a chairman, vice chairman, and secretary from among the members.
(c)
Power to employ qualified persons. The commission shall have the power to employ such qualified persons and incur such expenses as may be necessary for the proper conduct and undertaking of its functions and meetings, subject to advance approval of such services and expenses by the city council.
(d)
Rules. In addition to statutory requirements, the following rules shall govern the commission:
(1)
The planning and zoning commission shall keep minutes of its proceedings, showing the vote of each member upon each question, or, if absent or failing to vote, indicating such fact, and shall keep records of its examinations and other official actions, all of which shall be promptly filed in the office of the city secretary.
(2)
The commission shall report to the city council from time to time and annually.
(3)
A majority of the members of the commission shall constitute a quorum for the transaction of business. The concurring vote of a majority of the members of the commission in attendance shall be necessary for the passage of any motion.
(e)
Fees. Matters submitted for consideration by the planning and zoning commission shall not be accepted for filing unless the applicant shall have paid to the city the appropriate filing fee in an amount as may be determined, from time to time, by the city council.
