AN ORDINANCE PROVIDING FOR ZONING DISTRICTS AND THE REGULATION THEREOF WITHIN THE CORPORATE LIMITS OF THE CITY OF SPRING VALLEY, TEXAS; PROVIDING FOR AND RESTRICTING CERTAIN BUILDINGS, STRUCTURES AND IMPROVEMENTS AND THE USE THEREOF; PROVIDING FOR THE ADMINISTRATION AND ENFORCEMENT OF SUCH DISTRICTS, REGULATIONS, RESTRICTIONS AND PROVISIONS; AND PROVIDING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE.

WHEREAS, the City Council of the City of Spring Valley, Texas, has appointed zoning districts and appropriate regulations to be enforced therein, as provided in this Comprehensive Zoning Ordinance hereinafter set forth;

AND WHEREAS, such Planning and Zoning Commission has made a preliminary report to the City Council and held public hearings thereon before submitting a final report, in the manner and at the times provided by law;

AND WHEREAS, such Planning and Zoning Commission has made a final report, wherein it recommended the provisions of said Comprehensive Zoning Ordinance to be enacted by the City Council, based upon the findings of fact as follows:

1.

The City of Spring Valley, Texas, is predominantly residential area in which most of the land is occupied by homes;

2.

Most of the homes located within the corporate limits of the City of Spring Valley are located within the boundaries of residential subdivisions, wherein homeowners rely upon, and desire to enforce, contractual covenants restricting the use of land to use for residential purposes only;

3.

There are comparatively few commercial establishments within the corporate limits of the City of Spring Valley, and there are numerous commercial establishments and a large commercial area situated near the City of Spring Valley, Texas, to serve any commercial requirements of the municipality;

4.

Establishment of boundaries of Zoning Districts, in accordance with a comprehensive plan would serve to mitigate congestion in the streets of the City of Spring Valley, would secure safety from fire, panic and other dangers, would promote health and the general welfare within the community, would assist in avoiding undue concentration of population and the overcrowding of land, and would facilitate adequate provision of sewage, water, transportation, schools, parks and other public requirements;

The City of Spring Valley has a central water system, central sewage system, a system of pressure mains and fire plugs throughout the City of Spring Valley for fire control and fire fighting, and the capacities of the sewage, water and fire control systems now existing are, at most, barely adequate for the present residential needs of the community.

The area of the City of Spring Valley is generally heavily wooded, so as to increase natural fire hazards;

Control of natural fire hazards and promotion of health and general welfare all recommend and require establishment of regulations for spacing of buildings and structures upon land, as recommended by the Planning and Zoning Commission;

Establishment of large commercial or industrial districts would impose greater burdens upon sewage, water and fire control systems than would residential districts;

9.

The area of the City of Spring Valley is one in which many children reside, making it especially important to provide for traffic safety, and to avoid traffic congestion;

10.

Establishment of large commercial or industrial districts would increase and intensify problems concerning traffic safety, traffic congestion and fire hazards;

11.

The character of the district within the corporate limits of the City of Spring Valley, its peculiar suitability for particular uses, conservation of the value, and encouragement of the most appropriate use of land within the municipality, all recommend and require the enactment of an ordinance providing for Zoning Districts and regulations therefor, as recommended by the planning and Zoning Commission;

AND WHEREAS, the City Council of the City of Spring Valley, Texas, has held public meetings in relation to the enactment of a Comprehensive Zoning Ordinance as recommended by the Planning and Zoning Commission;

AND WHEREAS, notices of the holdings of such public meetings were given by publication in a paper of general circulation within the City of Spring Valley, Texas, as provided by law;

AND WHEREAS, at such public meetings all parties in interest and citizens had an opportunity to be heard;

AND WHEREAS, evidence presented as to conditions within the City of Spring Valley, Texas, at such public meetings, confirmed the findings of fact and recommendations of the Planning and Zoning Commission;

WHEREFORE, BE IT ORDAINED by the City Council of the City of Spring Valley, Texas:
