CHAPTER 20

VACATION RENTALS

11-20-1: DEFINITION OF VACATION RENTAL:

Vacation rentals are short term rentals of fully furnished residential accommodations for a period of less than 30 days where guests can use the kitchen, bedrooms, bathrooms and common areas as an alternative to traditional hotel stays. (Ord. 764, 2-13-2024)

11-20-2: LICENSE REQUIRED:

No person shall operate VACATION RENTALS without the property owner first having obtained a license from the village. A license may not be issued until the owner has obtained a special use permit from the village and complied with all other village requirements contained herein. (Ord. 764, 2-13-2024)

11-20-3: REQUIREMENTS TO OBTAIN LICENSE:

No license shall be issued until verification of the following with the village:
   A.   A health inspection report from the Jo Daviess County Health Department stating that the vacation rental complies with state and county public health regulations.
   B.   An inspection report from an authorized Village of Stockton Official stating that the vacation rental complies with the following requirements:
         Smoke Detectors/Carbon Monoxide Detectors.
   C.   Every vacation rental unit must have one (1) bathroom for every four (4) guests.
   D.   Applicant must provide proof of being current in property taxes
   E.   Applicant must provide proof of being current in the payment of village sewer, water and garbage fees.
   F.   Applicant must provide proof of being current in the payment of Hotel/Motel Tax.
   G.   Applicant must sign up and stay current on BDD tax paid directly to the village if the vacation rental is located within the BDD District.
   H.   Applicant or vacation rental manager must have a permanent residence within twenty-five (25) miles of the Village of Stockton that is available by phone 24 hours, seven days a week, during the Period of Operation
   I.   No structure regardless of size shall have more than two vacation rentals contained within it.
   J.   Vacation rentals are only authorized by Special Use Permit in the following zoning districts:
         R-l Residential District.
         R-2 Residential District.
         R-M Multi-Family Residential District.
         B-C Central Business District.
         A Agriculture District. (Ord. 764, 2-13-2024; amd. Ord. 765, 3-12-2024)

11-20-4: OWNER OR VACATION RENTAL MANAGER TO BE PRESENT DURING INSPECTION:

No license shall be issued unless the owner or vacation rental manager is present during the initial and annual license inspection by the authorized Village of Stockton Official. (Ord. 764, 2-13-2024)

11-20-5: PROPERTY AND LIABILITY INSURANCE:

Prior to obtaining a vacation rental license, the owner shall provide the village with proof of valid property insurance and liability insurance coverage in an amount of not less than $500,000 per occurrence with respect to such establishment and property. (Ord. 764, 2-13-2024)

11-20-6: INITIAL LICENSE AND ANNUAL LICENSE AND FEES:

   A.   Each applicant for a vacation rental license shall pay an initial license fee of $ 150. Said fee shall be paid prior to the inspections being made. Said fee shall be non-refundable, even if the license is not issued.
   B.   Prior to March 1 of each year, each vacation rental owner who wishes to renew their license for the next fiscal year beginning May 1, shall pay an annual license fee of $130 and provide proof of compliance with all provisions of section 11-20-3. An annual license shall be issued upon payment of the license fee and proof of compliance with this chapter. (Ord. 764, 2-13-2024)

11-20-7: DISPLAY AND FORM OF LICENSE:

The vacation rentals license shall be conspicuously displayed within the establishment. The license shall be in such form and shall include such information as may be prescribed from time to time by the village. (Ord. 764, 2-13-2024)
