48 - H HISTORIC OVERLAY DISTRICT
The provisions of NRS 384 establishing the Comstock Historic District together with any rules or regulations adopted thereto are made a part of this title within the H historic overlay zone.

The H historic overlay zone is governed by the provisions of this chapter.

The boundaries of this zone are fixed pursuant to the terms of NRS 384 establishing a Comstock Historic District.

The provisions of NRS 384 and any rules or regulations adopted pursuant thereto are applied to this overlay zone.

All of the limitations, uses, and conditions of the underlying zone classification are applicable to this zone.

All commercial buildings constructed in this overlay zone abutting State Route 342 in Gold Hill (Main Street) and Virginia City ("C" Street) have wooden porches over the top of the sidewalks, and must have sidewalks constructed of wood in the front of the buildings unless a variance for good cause is granted by the board with action by the planning commission. Setback distances for commercial and commercial-residential buildings must comply with Chapter 17.28 Commercial Zone, and Chapter 17.30 Commercial-Residential Zone, respectively. A variance to the requirements of this section may not conflict with the provisions of NRS 384.

Buildings, structures, and exteriors must comply with the requirements of this section. The following standards apply to all buildings, structures, and exteriors located within portions of the Comstock Historic District within the county as established by NRS 384.
A.
All exterior materials must consist of a substance shown to have existed prior to 1942, and building and structure exteriors must be appropriate in design for that time period.
B.
Outdoor signs and advertising devices must comply with the provisions of Chapter 17.84 Signs and Billboards.
C.
Lighting within two thousand feet of the Comstock Historic District boundaries is limited to incandescent lighting or indirect (concealed) fluorescent, Compact Florescent Lighting (CFL), or Light Emitting Diode (LED) type lighting. CFL and LED light emitting devices which are made to look like incandescent light "bulbs" are permitted to be plainly visible. No neon, or blinking, flashing, chasing, or motion lights are permitted. The regulations of this provision shall including other light emitting devices which appear similar to neon signs, such as those which employ LEDs similar in hue to neon and configuration to show a continuous stream of light.

A variance to the provisions of this chapter may be made as regulated by Chapter 17.03 Administrative Provisions. The variance must not conflict with the provisions of NRS 384.
