CHAPTER 3

ZONING DISTRICTS

11-3-1: ZONING DISTRICTS ESTABLISHED:

For the purpose and provisions of this title, the village is hereby organized into the following zoning district classifications:
R-0
Single-family residence district
R-1
Single-family residence district
R-2
Single-family residence district
R-3
Single-family residence district
R-4
Residential transition district
R-5
General residence district
C-1
Limited commercial and office district
C-2
Neighborhood commercial district
C-3
Highway commercial district
I-1
Office, research and restricted industrial district
I-2
General industrial district

11-3-2: ZONING MAPS:

The boundaries of the zoning districts designated above are established as on the maps entitled "zoning map, village of Streamwood", as amended, which are made a part hereof, and shall have the same force and effect as if the zoning maps, together with all notations, references and other information shown thereon were fully set forth and described herein. 11-3-3: DISTRICT BOUNDARIES:

When uncertainty exists with respect to the boundaries of the various districts as shown on the official zoning map, the following rules shall apply:
   A.   All land within the corporate limits is zoned and is subject to this title.
   B.   District boundary lines are either the centerlines of railroads, highways, streets, alleys, or easements, or the boundary line of sections, quarter sections, divisions of sections, tracts or lots or such lines extended or as otherwise indicated.
   C.   In areas not subdivided into lots and blocks, wherever a district is indicated as a strip adjacent to and paralleling a street or highway, the depth of such strips shall be measured at right angles from the centerline of the street or highway and the length of the frontage shall be in accordance with the dimensions shown on the map from the section, quarter section or division lines, or centerlines of street, highway or railroad rights of way unless otherwise indicated.
   D.   Where a lot held in single ownership of record on the effective date of this title is divided by a district boundary line, the entire lot shall be construed to be within either district at owner's discretion, provided that this shall not apply if it increases the less restricted frontage of the lot by more than twenty five feet (25'). 11-3-4: ZONING OF ANNEXED LAND:

Any territory which is not within the corporate limits of the village, but is contiguous to the corporate limits of the village, may be annexed to the village subject to the provisions and procedure set forth in the Illinois Compiled Statutes.
Such lands hereafter annexed to the village shall be automatically zoned in R-1 single-family residence district until such time as the land is rezoned, and shall be subject to all the requirements of this title. Any rezoning of newly annexed land subject to an annexation agreement shall be entered into by the corporate authorities pursuant to the following procedures: (Ord. 2009-34, 12-3-2009, eff. 1-1-2010)
   A.   The Streamwood planning and zoning board shall hold a public hearing. The notification and publication requirements shall be identical to those required by this title for a map amendment. The planning and zoning board shall, within fifteen (15) days of the close of public hearing, communicate to the village board whether said agreement is consistent with the village master plan and whether said agreement advances the goals, objectives, policies and interest of the village.
   B.   Following receipt of the communication from the planning and zoning board, the village board shall enter into the annexation agreement only by the positive vote of two-thirds (2/3) of the president and village board present and/or actively participating in the proceedings.
