Definitions.
The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
Accessory building means structures referred to as appurtenant structures. An accessory building is a structure which is on the same parcel of property as a principal structure and the use of which is incidental to the use of the principal structure. Each parcel may contain only one accessory building. Accessory buildings shall not be located within the parcel's front 25-foot setback line. Accessory buildings shall be secured to the ground and shall meet National Flood Insurance Program (NFIP) regulations for new construction and all FEMA standards.
Accessory use means land and/or building uses which are allowed in a zone only when they are clearly subordinate to and in conjunction with a permitted use.
Apartment means a building with three or more areas for occupancy by different families and with separate dining or cooking facilities for each family.
Automotive or auto means and includes automobiles, buses, motorcycles, and trucks.
Building means any structure built for the support, shelter or enclosure of persons, animals, chattels or movable property.
Building line means a line, usually parallel to a street or property line, beyond which buildings shall not be erected.
Conditional uses means land or building uses which, because they may generate special problems such as excessive traffic, excessive noise, or other conditions, may, in certain, cases prove undesirable for a certain zone. Each must be treated separately on a case by case basis. The approval of one conditional use in a zone does not mean this becomes a permitted use.
Customary home occupations means occupations which may be conducted in the home without changing the character of the residential use of the property and not involving retail sales to customers, objectionable noise or odors, or outside storage of material or equipment. Such uses as barbershops, beauty parlors, tea rooms, children's day care and animal hospitals shall not be deemed as home occupations.
Duly authorized representative means a person who is given the authority to stand in the place of another (as deputy, substitute, agent, etc.).
Duplex. See Dwelling, two-family.
Dwelling, one-family, means a detached building having accommodation for and occupied by not more than one family.
Dwelling, two-family, means a detached building having separate accommodations for and occupied by not more than two families.
Family means any number of individuals living and cooking together on the premises as a single housekeeping unit.
Floor area means the gross horizontal areas of the several floors of a structure covered by a roof, exclusive of garages, stoops, carports and unenclosed porches; same as "living area."
Height of building means the distance from average grade or curb level to the highest point of the roof, but not including chimneys, towers, spires, and the like.
Home occupation means any occupation or activity which is clearly incidental and secondary to the use of the premises for dwelling purposes and which is carried on in the main dwelling unit and is not determined or injurious to the economic or aesthetic value of adjoining property.
Hotel means a building containing rooms intended or designed to be used, rented or hired out to be occupied or which are occupied for sleeping purposes by guests and where only a general kitchen and dining room are provided within the building or in an accessory building.
HUD-code manufactured home park means two or more HUD-code manufactured homes located on real property or properties owned by the same persons.
Livestock means horses, cattle, pigs, rabbits, poultry, sheep and goats.
Living area means the gross horizontal areas of the several floors of a structure covered by a roof, exclusive of garages, carports and unenclosed porches; same as "floor area."
Lot frontage means the width of the lot at either the front line or the building line, whichever is greater.
Lot line means the boundaries of any lot as described on the subdivision plat.
Mobile home and HUD-code manufactured home mean the same as is contained in the Manufactured Housing Standards Act, V.T.C.A., Occupations Code Ch. 1201. It is the intent of this chapter to prohibit mobile homes and HUD-code manufactured homes.
Patio home means a dwelling unit structure that has a minimum lot size of 2,800 square feet with setback build lines of 25 feet in front, ten feet in the back, zero lot line on one side and ten feet on the other.
Private yard means an area of open space within a townhouse, but which is unoccupied and unobstructed by any portion of a structure.
Religious institution means any place of worship for the carrying on of religious activities which consists of one or more permanent buildings.
Service shops means and includes bakeries, beauty shops, restaurants, laundry agency, washateria, shoe repair, gasoline service, etc., but excluding auto repair, bus terminals, machinery repair and welding.
Street right-of-way means property either conveyed or dedicated to the public for use as a public street.
Subdivision means the same as is defined in the village subdivision chapter, chapter 42.
Temporary sign means any unattached real estate sign, political sign, or announcement of a local event.
Townhouse means a dwelling unit structure having a separate wall with one or more adjoining dwelling unit structures.
Variance means a legal modification of the district provisions such as yard, lot width and yard depth, signs, setback and off-street parking and loading regulations granted due the peculiar conditions existing within a single piece of property.
