Short Title and Effective Date; Declaration of Legislative Intent; Community Development Objectives; Conflict

§ 27-101. Short Title and Effective Date.

   This Chapter shall be known and may be cited as “Zoning Ordinance of the Borough of Telford, Pennsylvania.”

§ 27-102. Declaration of Legislative Intent.

   This Chapter is enacted for the purpose of promoting, protecting and facilitating the public health, safety, morals, general welfare; coordinated and practical community development; proper density of population; the provisions of adequate light and air; vehicle parking and loading space; transportation, water, sewerage, public grounds and other public requirements. Further, this Chapter is intended to implement the policies and recommendations of the Indian Valley Regional Comprehensive Plan. It is designated to facilitate the prevention of the overcrowding of land, blight, danger and congestion in travel and transportation, loss of health, life or property from fire, flood, panic or other dangers. It is in accordance with an overall program, and takes into consideration the character of the Borough, its various parts and the suitability of the various parts for particular uses and structures.

§ 27-103. Conflict.

   It is not intended by this Chapter to repeal, abrogate, annul or interfere with any existing ordinance or enactment, or with any rule, regulation or permit adopted or issued thereunder, except insofar as the same may be inconsistent or in conflict with any of the provisions of this Chapter; provided, that where this Chapter imposes greater restrictions upon the use of buildings or land, or upon the height and bulk of buildings, or prescribes larger open spaces than are required by the provisions of such ordinance, enactment, rule, regulation or permit, then the provisions of this Chapter shall control.

§ 27-104. Application.

   No building, structure or premises shall hereafter be used and no building, structure or part thereof shall be constructed, reconstructed, extended, moved, structurally altered or enlarged except in conformity with these regulations.

§ 27-105. Statement of Community Development Objectives.

   The objectives of this Chapter are to:
      A.   Promote a land use and development pattern consistent with the proper functioning and requirements of all classes of land use.
      B.   Provide for an adequate and diversified housing supply.
      C.   Maintain healthful and safe housing.
      D.   Provide and maintain attractive, healthful and safe residential environments.
      E.   Provide for ranges of population density to guide new development and future redevelopment.
      F.   Maintain a strong and healthy economic base.
      G.   Maintain a visible and active business community.
      H.   Provide for convenient shopping and personal service requirements.
      I.   Provide for adequate facilities and programs to meet social, cultural, recreational and aesthetic needs.
      J.   Provide for safe and convenient traffic and pedestrian circulation and movement within the community and to points beyond.
      K.   Protect to the maximum extent possible and promote the best use of the Borough’s natural recreational opportunities and aesthetic resources.
      L.   Maintain consistency with the goals and objectives of the 2005 Indian Valley Regional Comprehensive Plan (as may be amended).
