Amendments

§ 27-2001. Amendment.

   The Borough Council of Telford may, from time to time, amend, supplement, change, modify or repeal this Chapter, including the Zoning Map, by proceeding in the following manner, and as otherwise required by law.

§ 27-2002. Enactment of Zoning Ordinance Amendments.

   1.   The Borough Council may from time to time amend, supplement or repeal any of the regulations and provisions of this Chapter. Pursuant to § 609 of the Pennsylvania Municipalities Planning Code, 53 P.S. § 10609 as amended, the procedure for the preparation of a proposed zoning ordinance as set forth in § 607 of the Pennsylvania Municipalities Planning Code, 53 P.S. § 10607, is hereby declared optional.
   2.   Before voting on the enactment of an amendment, the Borough Council shall hold a public hearing thereon, pursuant to public notice. In addition, if the proposed amendment involves a zoning map change, notice of said public hearing shall be conspicuously posted by the Borough at points deemed sufficient by the Borough along the perimeter of the tract to notify potentially interested citizens. The affected tract or area shall be posted at least 1 week prior to the date of the hearing.
   3.   In the case of an amendment other than that prepared by the Planning Commission the Borough Council shall submit each amendment to the Planning Commission at least 30 days prior to the hearing on the proposed amendment to provide the Planning Commission an opportunity to submit recommendations.
   4.   If, after any public hearing held upon an amendment, the proposed amendment is changed substantially, or is revised to include land previously not affected by it, the Borough Council shall hold another public hearing, pursuant to public notice, before proceeding to vote on the amendment.
   5.   At least 30 days prior to the public hearing on the amendment by the Borough Council, the Borough shall submit the proposed amendment to the County planning agency for recommendations.
   6.   Within 30 days after enactment, a copy of the amendment to this Chapter shall be forwarded to the county planning agency.

§ 27-2003. Curative Amendments.

   Municipal curative amendments and landowner curative amendments submitted to the Borough Council shall be considered in accordance with the provisions and procedures of §§ 609.1 and 609.2 of the Pennsylvania Municipalities Planning Code, 53 P.S. §§ 10609.1, 10609.2 as amended.

§ 27-2004. Who May Initiate Amendments.

   1.   Any Borough landowner may submit a written proposal, on such form provided at the Borough office, if any, requesting an amendment of this Chapter or Zoning Map as they relate to the landowner’s property, and shall pay the fee fixed by the Borough Council for such a submission.
   2.   Since the amendment of this Chapter or Zoning Map is a decision which falls within the legislative discretion of the Borough Council, the Council shall have no obligation or duty to grant a hearing or take any action on the proposal for amendment of this Chapter or Zoning Map submitted by a landowner.
   3.   If a Borough landowner submits a proposal for the amendment of this Chapter or Zoning Map and the Borough Council determines to take no action on the proposal, the Borough Zoning Officer or Borough Secretary shall return the application and fee submitted by the landowner or other person, and the Borough shall take no further action on the submission.
   4.   If the Borough Council determines to grant a hearing on any proposal to amend this Chapter or Zoning Map as submitted by a Borough landowner, the Council shall refer the proposal to the Montgomery County Planning Commission and the Bucks County Planning Commission for review and commentary. At its discretion, the Council may also refer the proposal to the Borough Planning Commission for review and commentary. The Council shall advertise the proposed amendment as required by the Municipalities Planning Code, 53 P.S. § 10101 et seq., and, if the proposal involves any amendment to the Zoning Map, any affected property shall be posted. The Borough Council shall hold public hearings as it deems appropriate on the proposal to amend this Chapter or Zoning Map.
   5.   Subsequent to any public hearing, the Borough Council shall be under no obligation to take any final action on any proposal to amend this Chapter or Zoning Map.

§ 27-2005. Fees.

   For the purpose of defraying expenses of advertising, etc., applications for amendments shall be accompanied by a fee, in an amount as established from time to time by resolution of the Borough Council. Said fee shall be nonrefundable after advertisement of the notice of the hearing has been made.
