USE TABLE

Sec. 28-51.- Intent.

The use table contained in Section 28-54 is intended to serve as a central location to establish the permitted, permitted uses with limitations, and conditional uses within each zoning district. In the table there are general uses and more specific uses, which could be included within the general use category. An example of a general use is "retail sales and service," and an example of a more specific use that could be included within that general use is "sporting goods store." The reason for listing both uses in the use table stems from the purposes and intents of each zoning district. Using the commercial example above, a commercial zoning district created to facilitate commercial uses at a neighborhood level warrants more specific use types to control the intensities of uses within a neighborhood commercial node. The more general use is applicable to commercial zoning districts intended to allow regional shopping centers to serve more than a specific neighborhood.

Sec. 28-52. - Prohibited uses.

The uses in this section are specifically prohibited in the zoning districts listed with each use. These uses are in addition to the prohibited uses illustrated in the use table by a blank cell. Any use not permitted by right, or as a conditional use or accessory use, in a zoning district shall be prohibited in such district.

(a)

Marijuana cultivation is prohibited in all zoning districts in the City of Titusville.

(b)

Pain management clinics and cash-only pharmacies are prohibited in all zoning districts except the Hospital Medical (HM) zoning district. A Conditional Use Permit must be obtained prior to the establishment of any pain management clinic or cash-only pharmacy within the Hospital Medical (HM) zoning district.

(c)

Special education classes for juvenile delinquents, correctional facilities, drug or alcohol dependency/abuse or similar programs are prohibited uses in the Neighborhood Commercial (NC) and Office Professional (OP) zoning districts.

(d)

Outdoor storage is prohibited in the Regional Mixed-Use (RMU) zoning district, including all sub-districts.

(e)

Drive-through services are prohibited in the Regional Mixed-Use 200 sub-district (RMU-200).

(f)

Internet cafés are prohibited in the Indian River City Neighborhood-Commercial (IRCN-C) zoning district.

(g)

Soup kitchens are prohibited in the Downtown Mixed-Use (DMU) zoning district, including all sub-districts.

(h)

Mobile home parks are prohibited in the Downtown Mixed-Use (DMU) zoning district, including all sub-districts.

(i)

In addition to other prohibited uses listed in this section, the following uses are prohibited in the Neighborhood Commercial (NC) zoning district:

(1)

Adult businesses.

(2)

Pawnshops.

(3)

Flea markets/farmer's markets.

(4)

Physical contact establishments.

(5)

Transient merchants, itinerant merchants, and itinerant vendors.

(6)

Automotive sales and service.

(7)

Sales and/or service of household appliances, gasoline-powered mowers, garden tillers, outboard engines, motor scooters, motor bikes, or motorcycles.

(8)

Outdoor sales display or storage of merchandise.

(j)

Additional uses may be prohibited on property within any overlay district. Overlay districts are established in Chapter 29 of these regulations.

Sec. 28-53. - Use table key.

(a)

In the event of a conflict between the use table contained in Section 28-54 and any other use table listed in Article V, Zoning Use Standards, the use table contained in Section 28-54 shall prevail.

(b)

Types of use.

(1)

Uses permitted by right "P". A "P" indicates that a use is allowed by right in the respective district. Such uses are subject to all other applicable requirements of these regulations.

(2)

Uses permitted with limitations "L". An "L" indicates a use that will be permitted subject to the use limitations in Chapter 28, Article V, Zoning Use Standards). Such uses are subject to all other applicable requirements of these regulations.

(3)

Conditional use "C". A "C" indicates a use that is allowed only where approved as a conditional use by the City Council and require public hearings. Such uses are subject to the use limitations in Chapter 28, Article V, Zoning Use Standards, and all other applicable requirements of these regulations.

(c)

Uses not allowed. A blank cell in the use table indicates that a use is not allowed in the respective district.

(d)

Standards. The "Standards" column on the use table is a cross-reference to any limited or conditional use standards in Chapter 28, Article V, Zoning Use Standards. All uses are also required to comply with the appropriate dimensional standards in Chapter 28, Article VI, Zoning District Standards.
