ARTICLE XVIII
Manufactured Housing
Section 405.760 Purpose.

The purpose of this Article is to set forth standards for the placement, construction and architectural appearance of manufactured and modular homes within the City. The intent of this Article is to ensure that manufactured and modular homes are compatible with other dwellings in residential neighborhoods and meet a minimum construction and architectural standard while providing an alternative means of affordable home ownership for the residents of the City.
Section 405.765 Non-Conformity.

All legal or existing occupied mobile and/or manufactured homes located on an individual lot shall be permitted to remain in place, but provided that they may not be replaced unless made to conform with the requirements of this Article.
Section 405.770 Occupancy Restrictions.

Modular homes shall not be placed or occupied on an individual lot without a building permit issued under this Article. Manufactured homes placed in designated and approved manufactured home parks are exempt from requirements of a building permit.
Section 405.775 Zoning Restrictions.

A.
Mobile Homes. These homes are not allowed in the City limits of Troy.
B.
Manufactured Homes. These homes shall be allowed only in a designated and approved manufactured home park.
C.
Modular Homes. These homes shall be allowed as follows:
1.
In designated and approved manufactured home parks.
2.
As a single-family dwelling unit in the residential districts "R-1", "R-2", "R-3" and "C-1".
3.
As an office unit in the commercial districts of "C-1", "C-2" and "C-3" and industrial districts of "I-1" and "I-2".
4.
As a single-family dwelling or as an office unit, modular homes shall be placed on a permanent foundation.
Section 405.780 Siting Requirements.

A.
These requirements apply to modular homes which shall be subject to the same standards as site-built structures.
B.
Modular homes shall be placed in conformance with all zoning and setback requirements established for the district in which located.
C.
All accessory structures shall be placed in conformance with Section 405.195, Accessory Buildings, Structures and Uses.
D.
The roof must be gable or hip roof of at least five (5) in twelve (12) pitch or greater and covered with material that is residential in appearance. Except for permitted deck areas, all roof structures shall provide an eave projection of no less than six (6) inches and no greater than thirty (30) inches.
E.
Modular homes shall have the main entry door facing the street on which the modular home is located. A sidewalk shall be installed from the street, driveway or sidewalk adjoining neighboring lots to the front door. The modular home must be oriented on the lot so that its front entry is parallel with the street.
F.
Modular homes must have exterior surface and window treatment that are architecturally compatible with those of neighboring properties, excluding smooth and ribbed or corrugated metal.
G.
Modular homes must be placed on a parcel according to a pre-submitted and approved plot plan as described on the permit. In addition, an illustration of the finished appearance of the unit shall be provided.
H.
Modular homes shall be attached to a permanent footing, which manner of placement shall be as stated on the building permit, and meet all manufacturer's specifications for support.
I.
Modular homes shall have the tongue and running gear including axles removed.
J.
On a short wall foundation, modular homes shall maintain a minimum of eighteen (18) inches of crawl space under the entire home. All facades and foundations shall have permanently installed venting in accordance with the manufacturer's requirements. Deletions or omissions of vents is not allowed and homes will not be approved for occupancy without appropriate venting.
K.
Modular homes shall have permanent poured-in-place concrete porches and steps at all exits. All means of egress shall be built to existing Building Code.
L.
Modular homes shall be served by a water supply and sewage disposal system meeting the established City requirements.
M.
Underground public utilities shall be required, where available. All utility attachment shall be completed per Building Code.
N.
Property owners shall declare the modular home as real property and must so record with Lincoln County Assessor.
Section 405.785 Inspections.

A.
The following inspections are required. The property owner will need to call twelve (12) to twenty-four (24) hours in advance with permit number, location and what type of inspection. Hours for inspection are from 8:00 A.M. to 3:00 P.M. Monday through Friday.
1.
Siting. Once the proposed footing has been staked out on the lot, before any digging begins. This is to insure zoning requirements are met, i.e., setbacks.
2.
Footing inspection. This is prior to the concrete being poured with steel in place or on site to be floated in.
3.
Foundation or short wall inspection. This is prior to the concrete being poured with steel in place. Depth of crawl space and proposed vent placement will be checked.
4.
Inspection of the anchors. The attachment of the modular home to the foundation as outlined in the manufacturer's specifications will be checked.
5.
Water and sewer tap inspection. The property owner's plumber will make the tap.
6.
Final inspection. This inspection shall be conducted prior to permanent occupancy and prior to the expiration of the building permit. The modular home cannot be occupied until the certificate of occupancy is granted once the final inspection is completed.
