ARTICLE IX
Parking and Loading Requirements
Section 405.355 Purpose.

The purpose of this Section is to promote the safety and welfare of the public by establishing minimum requirements for the off-street parking and loading/unloading of motor vehicles in accordance with the use of the property. It is intended that all uses have adequate on-site parking and loading facilities.
Section 405.360 Applicability.

At the time of the construction of a new structure, or the enlargement or change in use of an existing structure after the effective date of this Chapter, off-street parking or loading spaces shall be provided as specified in this Section, unless otherwise waived or modified by the City.
Section 405.365 General Provisions.

A.
The parking requirements for a use not specifically listed in this Section shall be the same as for a listed use of similar characteristics of parking demand at the determination of the City Engineer.
B.
The parking requirements as stated in this Section are in addition to those on-site parking spaces needed for storage of trucks and other vehicles associated with any use.
C.
The parking requirements in this Section do not limit special requirements which may be imposed with planned developments, conditional use permits, or developments which are unique relating to parking and traffic generation.
D.
Whenever the intensity of use of any building or premises shall be increased through the addition of dwelling units, seating capacity, floor area, etc., or whenever the existing use of a building or structure shall be changed to a new use, parking facilities as required in this Section shall be provided for such increase in intensity of use or change in use.
E.
For any conforming or legally non-conforming building or use which was in existence on the effective date of this Chapter, and which subsequent thereto is damaged or destroyed by fire or other cause and which is reconstructed, re-established or repaired, off-street parking or loading facilities equivalent to any maintained at the time of such damage or destruction shall be restored or continued in operation.
F.
Overnight parking of motor vehicles in residential areas shall be limited to passenger vehicles and not more than one (1) commercial vehicle of the light delivery type not to exceed one (1) ton. Only one (1) vehicle per two hundred fifty (250) square feet of living space may be parked overnight on or around a dwelling unit. Living space shall be determined by the "base area" contained in the official records of the Lincoln County Assessor. Residents owning more than the number of vehicles allowed by this Section shall be allowed ninety (90) days from passage of this Section to remove excess vehicles. The record owner of the dwelling unit shall be responsible for compliance with this Section.
G.
No parking facilities accessory to a business or manufacturing use shall be located in a residential district.
H.
All required off-street parking for permitted uses in the commercial and industrial districts shall be on the same lot as the uses served or on an adjacent lot when a cross access or joint parking agreement is established. The number of spaces permitted on the adjacent lot shall not exceed twenty-five percent (25%) of the total required parking spaces.
Section 405.370 Design Standards.

A.
Parking areas may be located in a front, side or rear yard, provided however, that no driveway or parking areas within an industrial, commercial or multiple-family district shall encroach upon the required landscape buffer areas of said district when adjacent to a single-family or two-family district or use. Where the proposed parking area is located within the side yard adjacent to similarly zoned property, no parking setback shall be required.
B.
No entrance or exit for any off-street parking area with over four (4) parking spaces, nor any loading area, shall be located within seventy-five (75) feet of the intersection of any two (2) street right-of-way lines.
C.
All off-street parking areas shall provide stormwater drainage facilities so as to prevent drainage to abutting properties and/or public streets, alleys and sidewalks.
D.
All off-street parking spaces shall contain an area of not less than two hundred (200) square feet and be not less than ten (10) feet wide by twenty (20) feet long exclusive of access drives or aisles. Aisles between vehicular parking spaces shall be not less than twelve (12) feet in width when serving vehicles parked at a forty-five degree (45°) angle in one (1) direction nor less than twenty-five (25) feet in width when serving vehicles parked at a ninety degree (90°) angle.
E.
All off-street parking spaces, other than those directly serving one- and two-family dwellings, shall be properly striped by durable paint.
F.
All off-street parking areas shall have concrete, asphalt concrete, or asphalt double-seal surfaces maintained adequately for all-weather use.
Section 405.375 Lighting.

All lighting fixtures used for illumination of any off-street parking area shall be so arranged as to reflect the light away from any adjoining residential or institutional uses or adjacent streets.
Section 405.380 Screening.

A.
All off-street parking areas for four (4) or more vehicles, and loading areas, shall provide landscaping/screening when adjoining a residential or recreational district as specified in Article XI of this Chapter.
B.
In the commercial and industrial districts, no unenclosed parking space shall be located closer to the street right-of-way than fifteen (15) feet. These requirements may be modified in a "PD" Planned Development District.
Section 405.385 Physically Disabled Parking.

A.
Physically disabled parking spaces shall be provided as follows and shall be appropriately marked. Each physically disabled parking space shall be inclusive of the off-street parking space requirements as specified below.

B.
Each physically disabled space shall not be less than twelve (12) feet wide, inclusive of an adjacent access aisle, and shall be located as close to the principal entrance(s) as possible and so located to avoid wheeling or walking behind parked cars to reach such entrance(s).
Section 405.390 Joint Use.

The number of parking spaces required for two (2) or more uses shall be the sum of the requirements for the various individual uses in accordance with this Section. However, in any development where a mixture of uses are permitted, or a Planned Development District, the combined total number of parking spaces required for the combination of uses may be reduced up to twenty percent (20%) of the individual use requirements upon review by the City Engineer.
Section 405.395 Parking Space Requirements By Use.

No building shall be erected, enlarged to the extent of increasing the floor area by as much as fifty percent (50%), or changed in use unless there is provided on the lot space for the parking of automobiles or trucks in accordance with the following minimum requirements:

Section 405.400 Loading Space Regulations.

A.
All loading spaces shall be at least twelve (12) feet in width and forty (40) feet in length and have a vertical clearance of fourteen (14) feet.
B.
All off-street loading areas shall have concrete, asphalt concrete, or asphalt double-seal surfaces maintained adequately for all-weather use as approved by the City Engineer.
C.
All off-street loading areas shall be located on the same lot as the use being served.
D.
All off-street loading areas shall provide landscaping/screening when adjoining a residential or recreational district as specified in Section 405.405. No loading spaces shall encroach upon the required landscaped buffer areas.
E.
All off-street loading areas shall provide stormwater drainage facilities so as to prevent drainage to abutting properties and/or public streets, alleys and sidewalks.
