ARTICLE IV

- ZONING DISTRICTS

Section 1. - Districts and their boundaries.

Listed below are the different land use zones or "zoning districts" that are depicted on a map of the city referred to as the zoning map.

IV.1.1 List of zoning districts. The City of Unadilla is hereby divided into the following six classes of zoning districts:

R-1 Single-Family Residential District

R-2 Multifamily Residential District

C-1 Neighborhood Business District

C-2 Central Business District

I Industrial District

AG Agricultural District

IV.1.2 Official zoning map. The boundaries of these districts are shown on the map which is designated as the Official Zoning Map of the City of Unadilla. The official zoning map is on file in the office of the city clerk, and all notations, references, and other information shown thereon are a part of this ordinance and have the same force and effect as if said zoning map and all such notations, references, and other information shown thereon were fully set forth or described herein.

Except where reference on zoning map to a street or other designated line is made by dimensions shown on said map, the district boundary lines follow lot lines extended and the corporation limits of the City of Unadilla as they existed at the time of adoption of this ordinance. Where uncertainty exists with respect to the boundaries of any zoning district as shown on the zoning map, the Unadilla City Council shall rule on such boundaries.

Section 2. - R-1: Single-family residential district.

Listed in this section are the purpose, permitted uses, and secondary and accessory uses permitted in single-family residential districts delineated on the Unadilla Zoning Map.

IV.2.1 Statement of purpose. This single-family residential district is established as a district in which the principal use of land is for low density single family dwelling units. For the R-1 single-family residential district, the specific intent is to encourage the construction of and the continued use of the land for low density single-family residential development within the city and to discourage land uses which would generate traffic on minor or local streets, other than normal traffic to serve the residences on those streets.

IV.2.2 Permitted Uses. Development in the R-1 district is limited to the following uses:

a.

Single-family detached dwellings, except mobile homes.

b.

Churches, provided that the proposed site is not less than one acre and a complete site development sketch is submitted with the application and provision is made for off-street parking.

c.

Cemeteries, provided that a complete site development sketch is submitted with the application.

d.

Clubs and lodges not operating for profit, provided that:

1.

The buildings are not placed closer than 50 feet to any property lines; and

2.

There is a planted buffer strip at least ten feet wide along the side and rear lot lines.

e.

Public buildings, structures, or other public land uses.

f.

Hospitals and clinics.

g.

Home occupations - Home occupations as limited and defined in article II hereof.

h.

Home offices - Home offices as limited and defined in article II hereof.

i.

Nursery schools, kindergartens, or day care facilities provided that all state licensing requirements are met.

j.

Personal care homes.

k.

Other uses similar to the above and compatible with the particular neighborhood as interpreted by the city council.

IV.2.3 Secondary uses permitted in R-1 districts.

a.

Vegetable gardens.

b.

Guest homes (frame built).

IV.2.4 Accessory uses permitted in R-1 districts.

a.

Swimming pools.

b.

Recreational court facilities (tennis, basketball, volleyball, etc.).

c.

Tool sheds less than 10 percent the size of the dwelling.

d.

Playhouses for children.

e.

Accessory buildings or uses customarily incidental to any of the permitted uses, when located on the same lot and not involving any business, profession, trade, or occupation.

Section 3. - R-2: One, two, and multiple family residential district.

Listed in this section are the purpose, permitted uses, and secondary and accessory uses permitted in one, two, and multiple family residential districts delineated on the Unadilla Zoning Map.

IV.3.1. Statement of purpose. The R-2 residential district is established as a district in which the principal use of land is for medium density single-family dwellings. For the R-2 residential district, in promoting the general purpose of these regulations, the specific intent of this section is to encourage the construction of and the continued use of the land for medium density residential development and to discourage any land use which would generate traffic on minor or local streets, other than normal traffic to serve the residences on those streets.

IV.3.2 Permitted uses. Development in the R-2 district is limited to the following uses:

a.

Single-family detached dwellings.

b.

Mobile homes.

c.

Planned unit developments of which at least 50 percent of the development is dedicated to residential and the other uses do not abut on any residential district.

d.

Any use listed under section three of the R-1 zoning district.

e.

Mobile home parks (See article VIII). Nonresidential uses must not abut any residential district.

f.

Duplexes, triplexes, and quadraplexes.

g.

Apartments.

IV.3.3 Secondary uses permitted in R-2 districts.

a.

Home occupations.

b.

All secondary uses permitted in R-1 zones.

c.

Storage garages for equipment used off premises (all stored items must be completely enclosed.)

IV.3.4 Accessory uses permitted in R-2 districts

a.

All accessory uses permitted in R-1.

b.

Tool sheds less than ten percent the size of the building.

c.

Utility easements and substations.

d.

Accessory buildings or uses customarily incidental to any of the permitted uses, when located on the same lot and not involving any business, professional, trade, or occupation.

Section 4. - AG: Agricultural district.

Listed in this section are the purpose, permitted uses, and secondary and accessory uses permitted in agricultural districts delineated on the Unadilla Zoning Map.

IV.4.1 Statement of purpose. The purpose of the agricultural district within the City of Unadilla is to provide for continuing agricultural related development but where the present application of nonagricultural related controls would be unreasonable or premature.

IV.4-2 Permitted uses. Development in the AG district is limited to the following uses:

a.

Agriculture-related activities.

b.

Single-family detached dwellings.

c.

Mobile homes.

d.

Animal hospitals.

e.

Dog kennels.

f.

Churches.

g.

Cemeteries.

h.

Rural businesses.

IV.4.3 Secondary uses permitted in AG districts.

a.

Vegetable stands.

b.

Rural business (See section III, Definitions).

c.

Nurseries and greenhouses.

d.

Marinas and boat docks.

e.

Fishing ponds.

f.

Horse stables.

IV.4.4 Accessory uses permitted in AG districts.

a.

Storage barns.

b.

Greenhouses.

c.

Silos.

d.

Warehouses for storage of products or equipment including cold storage.

e.

Guest house (one per farm unit)

f.

Horse stables.

g.

Signs for on site advertising

Section 5. - C-1: Neighborhood business district.

Listed in this section are the purpose, permitted uses, and secondary and accessory uses permitted in neighborhood business districts delineated on the Unadilla Zoning Map.

IV.5.1 Statement of purpose. The neighborhood business district is intended to permit retail business and service uses which are needed to serve nearby residential areas. In order to promote such business development, uses are prohibited which would create hazards, offensive, and loud noises, vibration, smoke, glare, heavy truck traffic, or late hours of operation. The intent of this district is also to encourage the concentration of local business areas in locations which poses the mutual advantages of both the consumers and merchants and thereby promotes the best use of land at certain strategic locations.

IV.5.2 Permitted uses. Development in the C-1 district is limited to the following uses:

a.

Barber/beauty shops and other personal service establishments.

b.

Clubs and lodges (see section 2).

c.

Child care centers, kindergartens, and special schools.

d.

Laundry or dry cleaning establishments.

e.

Professional offices.

f.

Repairs, electrical or other household appliances, locks, radios, televisions, etc.

g.

Restaurants, in existing structures with no more than 2,000 square feet of floor space devoted to such use.

h.

Small retail businesses selling convenience goods and serving the adjacent residential neighborhoods such as drug, goods, bakery, and tailor shops.

i.

Other uses similar to the above, subject to the following restrictions:

1.

All businesses shall be retail or service establishments dealing directly with consumers. All goods produced on the premises shall be sold at retail on the premises where produced.

2.

All business, servicing or processing shall be conducted within completely enclosed buildings.

j.

Churches or other religious institutions. (See section two hereof.)

k.

Service stations.

IV.5.3 Secondary uses permitted in C-1 districts.

a.

Any combination of permitted uses.

b.

Patios, terraces, courtyards, and outdoor dining facilities.

c.

Recreational facilities, including driving ranges, batting cages, and miniature golf.

IV.5.4 Accessory uses permitted in C-1 districts.

a.

Storage sheds.

b.

Automatic teller machines.

c.

Utility easements and substations.

IV.5.5 Protective screening. Protective screening for C-1 districts adjacent to residential districts shall be in compliance with the regulations set forth in article III section 10.3 of this ordinance.

Section 6. - C-2: Central business district.

Listed in this section are the purpose, permitted uses, and secondary and accessory uses permitted in central business districts delineated on the Unadilla Zoning Map.

IV.6.1 Statement of purpose. The central business district is intended to protect and promote suitable areas for business and commercial uses which benefit from proximity to each other, to encourage the eventual elimination of uses inappropriate to a central business area and to encourage the intensive development of a centralized business center of the City of Unadilla.

IV.6.2 Permitted uses. Development in the C-2 district is limited to the following uses:

a.

Retail business and service establishments.

b.

Financial institutions.

c.

Hotels.

d.

Professional offices.

e.

Churches. (See section 5.03a).

f.

Clinics and nursing homes.

g.

Publicly owned and operated buildings and public utilities.

h.

Multiple family residential dwellings, boarding or rooming houses.

i.

Night clubs.

j.

Motels.

k.

Automobile sales and service.

l.

Service stations.

m.

Agricultural implement sales and service.

n.

Wholesale stores, storage buildings, warehouses, distributing plants, freezer, and lockers.

o.

Small fabrication and manufacturing shops, when employing not more than ten employees in the office and manufacturing operations.

p.

Cemeteries.

q.

Churches and other religious institutions. (See section 5.03a.)

r.

Hospitals, clinics, and nursing homes.

s.

Night clubs (same development standards as in section 5.03c).

t.

Publicly owned and operated buildings.

u.

Schools.

v.

Open air business.

w.

Mini-warehouses.

x.

Other uses similar to the above and subject to the following regulations:

1.

All business establishments shall be retail or service establishments dealing directly with consumers.

2.

All goods provided on the premises shall be sold at retail on the premises where produced.

3.

All business, servicing or processing, shall be conducted within completely enclosed buildings.

IV.6.3. Secondary uses permitted in C-2 districts.

a.

Storage warehouses.

b.

Any combination of uses permitted unconditionally in C-1 or C-2.

IV.6.4. Accessory uses permitted in C-2 districts.

a.

Parking garages.

b.

Car washes.

c.

Utility easements and substations.

IV.6.5. Protective screening. Protective screening for requirements of C-2 district adjacent to or near residential districts shall be in compliance with the regulations set forth in article III section 10.3.

Section 7. - I: Industrial district.

Protective screening for C-1 districts adjacent to residential districts shall be in compliance with the regulations set forth in article III, section 10.3 of this ordinance.

IV.7.1 Statement of purpose. The intent of the manufacturing district is to provide areas for wholesaling, warehousing, storage, manufacturing, processing, repair services, and sales lots in addition to other retail and service establishments; to expand or extend existing districts only where there is adequate and direct access to major transportation facilities and where there is minimum conflict with residential districts.

IV.7.2 Permitted uses. Development in the I district is limited to the following uses:

a.

Any use permitted in the commercial zone districts.

b.

Manufacturing.

c.

Warehousing, wholesaling, shipping, and receiving.

d.

Agriculture.

e.

Petroleum bulk plant.

f.

Junkyards, automobile salvage yards, or scrap metal processors. (Site plan approval, including landscape buffers and fencing.)

g.

Asphalt plants.

h.

Cement, line gypsum, or plaster of Paris manufacturing.

i.

Fat rendering and fertilizer manufacturing.

j.

Paper and pulp manufacturing.

k.

Corrosive acid and alkali manufacturing, explosives.

l.

Public utilities and buildings.

m.

Tire reclamation facilities.

n.

Cemeteries (site plan required).

o.

Chemical plants.

p.

Churches.

q.

Solid waste collection, treatment and disposal facilities, and recycling operations.

r.

Armories.

s.

Extraction or removal of sand, gravel, top soil, or other natural resources.

t.

Grain elevators.

u.

Hazardous waste facilities.

v.

Lumber yards, planning and sawmills.

w.

Petroleum refining and storage.

x.

Septic tank cleaning services.

y.

Commercial incinerators.

z.

Uses similar to the above.

IV.7.3. Secondary uses permitted in I districts.

a.

Wholesale and retail sales of products made in the plant or other subsidiaries.

b.

Any combination of uses permitted unconditionally in I district.

IV.7.4. Accessory uses permitted in I districts.

a.

Automobile parking lot or parking garage.

b.

Storage warehouses.

c.

Water towers.

d.

Communication stations and towers.

e.

Recreation facilities.

IV.7.5. Protective screening. Protective screening for requirements of I districts adjacent to or near residential districts shall be in compliance with the regulations set forth in article III section 10.3.
