ARTICLE VIII

C-1 Neighborhood Service District

§ 350-40 Purpose.

The purpose of this district is to provide retail shopping and service facilities that serve the needs of the residents of immediate neighborhoods in appropriate locations to allow convenient access and to minimize traffic impacts on neighborhoods and local streets.

§ 350-41 Authorized uses.

In the C-1 Neighborhood Service District, only the following uses are authorized:
A.

Principal uses.
(a) 
Automobile service station.
(b) 
Bakery, retail.
(c) 
Business or professional offices.
(d) 
Candy or ice cream store.
(e) 
Card and gift shop.
(f) 
Church.
(g) 
Communications antenna mounted on an existing building or on an existing public utility storage or transmission structure, subject to § 350-106.
(h) 
Convenience store.
(i) 
Day-care center.
(j) 
Drugstore.
(k) 
Dry-cleaning pickup store.
(l) 
Essential services.
(m) 
Financial institution.
(n) 
Florist shop.
(o) 
Food store.
(p) 
Forestry, subject to § 350-104.
(q) 
Laundromat.
(r) 
Newsstand.
(s) 
Oil and gas well operations, subject to § 350-107.
(t) 
Personal services.
(u) 
Pharmacy.
(v) 
Public utility building or structure.
(w) 
Restaurant, carry-out.
(x) 
Restaurant, fast-food.
(y) 
Restaurant, sit-down.
(z) 
Video store, excluding adult video store.
(2) 
Accessory uses.
(a) 
Drive-through facilities, subject to § 350-100.
(b) 
Fences, subject to § 350-97.
(c) 
No-impact home-based business or home occupation in a dwelling that is a nonconforming use.
(d) 
Off-street parking and loading, subject to Article XVII.
(e) 
Signs, subject to Article XVIII.
(f) 
Temporary construction trailer or sales office, subject to § 350-101.
(g) 
Other accessory uses customarily incidental to and on the same lot with any permitted use, conditional use or use by special exception authorized in this district.
B. 
Conditional uses.
(1) 
Principal uses.
(a) 
Fire and emergency medical services, subject to § 350-93A(19).
(b) 
Group care facility, subject to § 350-93A(22).
(c) 
Nursing home, subject to § 350-93A(25).
(d) 
Personal care boarding home, subject to § 350-93A(22).
(e) 
Transitional dwelling, subject to § 350-93A(22).
(2) 
Accessory uses: none.
C. 
Uses by special exception.
(1) 
Principal uses.
(a) 
Apartment above office or retail, subject to § 350-93A(4).
(b) 
Car wash, subject to § 350-93A(9).
(c) 
Comparable uses not specifically listed, subject to § 350-93A(14).
(d) 
Temporary use or structure, other than a temporary construction trailer, model home or sales office, subject to § 350-93A(39).
(2) 
Accessory uses: none.

§ 350-42 Area and bulk regulations.

In the C-1 Neighborhood Service District, all uses shall be subject to the following regulations, except as they may be modified by the express standards and criteria for the specific conditional uses and uses by special exception contained in Article XV.
A. 
Minimum lot area:
(1) 
Without public sewers: one acre (43,560 square feet).
(2) 
With public sewers: 0.5 acre (21,780 square feet).
B. 
Minimum lot width: 100 feet.
C. 
Maximum lot coverage: 35%.
D. 
Minimum front yard: 40 feet.
E. 
Minimum rear yard:
(1) 
All principal and accessory structures:
(a) 
Adjoining any R-A, R-1, R-2 or R-3 District: 50 feet.
(b) 
Adjoining all other districts: 30 feet.
F. 
Minimum side yard:
(1) 
All principal and accessory structures:
(a) 
Adjoining any R-A, R-1, R-2 or R-3 District: 50 feet.
(b) 
Adjoining all other districts: 20 feet.
G. 
Minimum distance between buildings (where two or more buildings are on the same lot): 20 feet.
H. 
Special yard requirements: See § 350-97.

Permitted projections into required yards: See § 350-98.
J. 
Maximum height:
(1) 
All principal structures: three stories, but no more than 45 feet.
(2) 
All accessory structures: one story, but no more than 20 feet.
