Building Setbacks

§ 140-188 General setback requirements.

A. 
No building or structure shall be constructed within the boundaries of any floodplain or tidal marsh or within 50 feet of the top of the bank of any nontidal stream or river or within 50 feet of the mean high-water line of any tidal stream or river.
B. 
No dock, pier or bulkhead fill or other structure shall be erected or placed within or abutting any tidal water without first securing proper riparian grants and construction permits from the state and federal agencies having control over such construction and any use thereof shall comply with the requirements of this chapter.
C. 
No building or structure shall be erected, no land shall be filled and no land shall be excavated within any easement or right-of-way held by the Township, except that fences, as regulated herein, may be erected within easements held by the Township, provided that they comply with all other federal, state, county and local regulations.
D. 
No building or structure shall be erected, no land shall be filled, no land shall be excavated and no vegetation shall be disturbed within any wetland or wetland transition area within the Township except in conformance with a valid permit issued by the NJDEP.

§ 140-189 Setbacks to conform to Schedule of Zone Requirements.

No principal or accessory building or structure shall be constructed, erected or placed, except in accordance with and as specified by the setbacks listed by the Schedule of Zone Requirements.[1]

§ 140-190 Accessory structures in front yards restricted.

No accessory structures, with the exception of flag poles, light or sign posts, walks, driveways, patios at ground level, fences, mail boxes, and septic tanks, shall be erected within any front yard.

§ 140-191 Setbacks in CR-10 Zone.

In the Commercial Recreation-10 (CR-10) Zone, no principal building or structure, no accessory building or structure, no sport or playing field, and no eating, picnic or food service area shall be located within 100 feet of any property line which abuts a residential use or a property which is zoned for residential uses.

§ 140-192 Setbacks created by new roadways.

The right-of-way of any new roadway or an extension of any existing roadway shall be located a distance equal to or greater than the minimum required front yard depth from any structure located on any adjoining property.

§ 140-192.1 Property with frontage on State Highway 34.

The following bulk requirements shall apply to properties with frontage on State Highway 34 and located between Ridgewood Road and Lakewood Road:
A. 
OP-10 Zone. For all properties located in the OP-10 Zone in this area, the rear setback requirement shall be increased from 75 feet to 100 feet. Where property lines abut residential zones, the setback from said property line shall be increased to 150 feet for two-story buildings and 175 feet for three-story buildings.
B. 
OB-20 and OB-40 Zones. For properties located in the OB-20 and OB-40 Zones in this area, building height shall be limited to two stories or 30 feet.
C. 
OP-2 Zone. For properties located in the OP-2 Zone in this area, building height shall be limited to two stories or 30 feet. Where a property line abuts a residential zone, the setback from that property line shall be 125 feet for a two-story building.
D. 
The front yard setback on all properties in the area shall be 100 feet.
