CHAPTER 16

OFF STREET PARKING

9-16-1: OFF STREET PARKING REQUIRED:

At the time any building or structure is erected or enlarged or increased in capacity or any use is established, there shall be provided off street parking spaces for automobiles in accordance with the requirements set forth in this chapter. (Ord. 89-5, 3-1-1989)

9-16-2: SIZE:

The dimensions of each off street parking space shall be at least nine feet by nineteen feet (9' x 19') for diagonal or ninety degree (90°) spaces, or ten feet by twenty two feet (10' x 22') for parallel spaces. (Ord. 99-26, 10-20-1999)

9-16-3: ACCESS TO INDIVIDUAL PARKING SPACES:

Except for single-family and two-family dwellings, and except as allowed in the downtown mixed use (DM) zone, access to each parking space shall be from a driveway and not from a public street. A conditional use permit shall be required for all uses listed as conditional uses in the district regulations or elsewhere in this title. A conditional use permit may be revoked by the planning commission upon failure to comply with conditions precedent to the original approval of the permit. (Ord. 2009-14, 10-14-2009)

9-16-4: OTHER VEHICLES:

Other vehicles such as boats, travel trailers, campers, etc., shall be parked off of the street. No long term parking of such vehicles on public streets is allowed. (Ord. 89-5, 3-1-1989)

9-16-5: NUMBER OF PARKING SPACES:

The number of off street parking spaces required shall be as follows:

1 parking space for each 3.5 fixed seats, or 1 parking space for each 7 feet of linear pew, whichever is greater.
Churches without fixed seats, sports arenas, auditoriums, theaters, assembly halls, meeting rooms
1 parking space for each 3.5 seats of maximum seating capacity.
Furniture and appliance stores
1 parking space for each 60 square feet of floor area.
Hospitals
2 parking spaces for each bed.
Hotels, motels, motor hotels
1.1 parking spaces for each living unit, plus 1 parking space for each 2 employees working on the largest shift, plus parking space for all accessory uses as herein specified.
Nursing homes
1 parking space for each employee working on the highest employment shift, plus 1 parking space for each 5 beds.
Restaurants, taverns, private clubs and all other similar dining and drinking establishments
1 parking space for each 4 seats or 1 parking space for each 150 square feet of floor area (excluding kitchen, storage or other areas which will not accommodate customers), whichever is greater.
Retail stores and shops, except as provided in “furniture and appliance stores” above
1 parking space for each 250 square feet of retail floor space.
Shopping centers or other groups of uses not listed above
As determined by the planning commission, based on the nearest comparable use standards, including standards for individual uses within a mix of uses.
Single-family two-, three-, four-, or other multiple family dwellings
Single-family, Twin-home, Tri-plex and Four-plex Dwellings: 2 off street parking spaces, and except for dwelling units located in the DM zone, 1 of which shall be enclosed in a garage or carport. The additional required parking space shall be constructed of concrete or asphalt and be a minimum of 9 feet by 19 feet in size. Both parking spaces required by this section shall comply with the front yard setback requirements of the zone in which the lot is located. Except for the mobile home-recreational vehicle (MH) zone, locating 1 parking space immediately in front of the other required parking space (tandem parking) is specifically prohibited. Any single-family dwelling which is converted to a two-, three-, four- or multiple-family dwelling in compliance with the provisions of this title must provide 2 off street parking spaces for each dwelling unit constructed. Each parking space must meet the provisions of this chapter.

* This number may be reduced to 2.0 when the development is a mix of one, two and three (or more) bedroom units, as long as the number one bedroom units is equal to or greater than the number of three bedroom units. 
All required parking spaces for Multiple-Family Dwelling Developments, shall be located within three hundred feet (300') of the building footprint. Required visitor parking spaces may be located beyond the three hundred foot (300') requirement. In certain cases where problems associated with topography or lot configuration, the city council may approve an alternative parking layout.
Townhome Developments: Use the following chart to calculate required parking:

All required parking spaces Townhome Developments shall be located within three hundred feet (300') of the building footprint. Required visitor parking spaces may be located beyond the three hundred foot (300') requirement. In certain cases where problems associated with topography or lot configuration, the city council may approve an alternative parking layout.
Wholesale establishments, warehouses, manufacturing establishments, and all industrial uses
1 parking space for each 1,000 square feet of gross floor area, or 1 parking space for each employee working on the largest shift, whichever is greater, plus 1 parking space for each 200 square feet of office or sales area.

9-16-6: ACCESS REQUIREMENTS:

Access requirements shall be as specified in the access management plan adopted by the city and on file in the city office. (2007 Code)

9-16-7: LOCATION OF GASOLINE PUMPS:

Gasoline pumps shall be set back not less than eighteen feet (18') from any street line to which the pump island is vertical and twelve feet (12') from any street line to which the pump island is parallel, and not less than ten feet (10') from any residential or agricultural district boundary line. If the pump island is set at an angle on the property, it shall be located so that the automobiles stopped for service will not extend over the property line. (Ord. 89-5, 3-1-1989)

9-16-8: MAINTENANCE OF PARKING LOTS:

Every parcel of land used as a public or private parking lot shall be developed in accordance with the following requirements:
   A.   Surfacing: All driveway approaches and parking spaces required by this chapter shall be surfaced with an asphaltic or portland cement or other hard surfacing pavement material approved by the planning commission. All other lot area intended for vehicle storage of any kind shall be covered with a minimum of six inches (6") of compacted road base material, and shall be kept in a dust free condition. The planning commission may require hard surfacing of any vehicle storage area. The parking area shall be so graded as to dispose of all surface water. If such water is to be carried to adjacent streets, it shall be piped under sidewalks. (Ord. 96-07, 2-28-1996)
   B.   Screening: The sides and rear of any off street parking lot which faces or adjoins a residential district shall be screened from such district by a solid visual barrier not less than six feet (6') in height at the grade of the parking lot or other barrier acceptable and approved by the planning commission.
   C.   Maintenance: Each parking lot shall be permanently maintained.
   D.   Lighting: Lighting used to illuminate any parking lot shall be arranged to reflect the light away from adjoining premises in any residential district and from street traffic. (Ord. 89-5, 3-1-1989)

9-16-9: PARKING FOR THE DISABLED:

Any parking area to be used by the general public shall provide parking spaces designated and located to adequately accommodate the disabled, and these shall be clearly marked as such. Parking spaces for the disabled shall be located in close proximity to the principal building. The designation of parking spaces for the disabled shall constitute consent by the property owner to the enforcement of the restricted use of such spaces to disabled motorists by the city. Parking spaces for the disabled shall conform to the standards of the Americans with disabilities act. The number of required parking spaces accessible to the disabled shall be as follows:

In addition, for every eight (8) accessible parking spaces, one accessible van space must be provided. The dimensions of a standard accessible parking space shall be at least nine feet by nineteen feet (9' x 19') with a five foot (5') wide access aisle (total of 14 feet x 19 feet). The dimensions of an accessible van space shall be at least nine feet by nineteen feet (9' x 19') with an eight foot (8') wide access aisle (total of 17 feet x 19 feet). (Ord. 2004-18, 6-9-2004)

9-16-10: PARKING LOT LANDSCAPING:

   A.   Trees: Trees shall be located throughout parking lots and not simply at the ends of parking aisles. In order to be considered within parking lots, trees shall be located in planters that are bounded on at least three (3) sides by parking area paving. Parking areas shall include one tree for every five (5) parking spaces and shall be uniformly dispersed to provide shade. Trees shall be a minimum size of fifteen (15) gallons (at least 1 inch in diameter) at planting, and shall be of a species which shall reach a thirty foot (30') to fifty foot (50') crown within fifteen (15) years.
   B.   Percentage Required; Protection: At least five percent (5%) of the parking lot area shall be developed and maintained as landscaped area. At least half of the landscaped area shall be in the form of live trees, shrubs and ground cover. Landscaping shall be protected from vehicular and pedestrian encroachment by raised planting surfaces, depressed walls or the use of curbs. (Ord. 2004-18, 6-9-2004)

9-16-11: PROHIBITED PARKING FOR SPECIFIC VEHICLES:

   A.   No person shall park, or allow to remain standing or idling for more than fifteen (15) minutes, any "motor vehicle", as defined by the U.S. department of transportation, that has eight (8) or more wheels touching the ground, or has a total length, including an attached trailer or other attached object, exceeding thirty nine feet (39'), upon any street or roadway of the city, except to load or unload the vehicle, as long as the loading or unloading is done expeditiously, or upon restricted vehicle routes and truck routes so designated within the city and in obedience to traffic signs and markings upon said routes, or for city approved construction and maintenance.
   B.   No person shall park, or allow to remain standing or idling for more than fifteen (15) minutes, any "motor vehicle", as defined by the U.S. department of transportation, that has eight (8) or more wheels touching the ground, or has a total length, including an attached trailer or other attached object, exceeding thirty nine feet (39'), upon any privately owned property within the corporate city limits of the city, if that property is zoned for residential use, including MH zones and the residential portions of PUD and PCD zones, with the exception of the agricultural zones and the RA-5 zone. 9-16-12: GUEST PARKING REQUIREMENTS FOR MULTIPLE-FAMILY DEVELOPMENTS:

Except for the DM Zone, guest parking spaces in the ratio of one parking space per three and one-quarter (3.25) units shall be provided for all multiple- family residential developments, including apartments, condominiums, duplexes, attached or detached townhomes, triplexes and fourplexes, and any combination thereof. For developments that have units with personal driveways a minimum of twenty feet (20') in length and eighteen feet (18') in width, located in front of a two car garage and are limited to the use of those units, up to thirty percent (30%) of those driveways may be counted toward meeting the guest parking requirement. In calculating the guest parking requirement, any fraction of five-tenths (0.5) and above shall be rounded up to the subsequent whole number and any fraction below five-tenths (0.5) shall be rounded down to the preceding whole number. 9-16-13: ON SITE PARKING SPACE REDUCTION OPTIONS IN THE DOWNTOWN MIXED USE (DM) ZONE:

To maximize buildable area as a way to assist in bringing vitality to the city's downtown, parking space reduction options are available provided that the number of parking spaces required for a development is satisfied by utilizing the options. The options for reducing on site parking spaces are cited below. However, providing all of the required parking spaces on site is still permissible.
   A.   Providing A Bus Stop Facility: Providing a bus stop facility and associated furnishings, including the costs and installation, at a location determined by the city and other appropriate agencies, qualifies for a reduction in on site parking spaces. The bus stop should be in close proximity to the development site. The design of the facility and associated furnishings, the location of the facility in relation to its proximity to the development site, and the number of on site parking spaces that may be reduced shall be approved by the city after discussing the option with the developer.
   B.   Providing On Street Parking Spaces: Providing on street parking spaces on the side streets perpendicular to Telegraph Street and providing street furniture on the streets fronting the development site, including the costs and installation of improvements (which may also include piping the irrigation gutters), qualifies as on site parking spaces. The parking spaces should be in close proximity to the development site and shall, together with the on site parking spaces, satisfy the number of parking spaces required for the development. The design of the on street parking area and street furniture, the location of the parking area in relation to its proximity to the development site, and the locations and quantities of the street furniture on the streets fronting the development site shall be approved by the city after discussing the option with the developer.
   C.   Contributing To A Public Parking Lot Or Structure: Contributing to a public parking lot or structure and providing street furniture on the streets fronting the development site, including the costs and installation of improvements (which may also include piping the irrigation gutters), qualifies for a reduction in on site parking spaces. The amount of the contribution for a public parking lot or structure, the design of the street furniture, and the locations and quantities of the street furniture on the streets fronting the development site shall be approved by the city after discussing the option with the developer.
