CONSTRUCTION SUBJECT TO GEOLOGIC, FLOOD OR OTHER NATURAL HAZARDS
10-20-1: PURPOSE:
The purpose of this chapter is to protect the general public from geologic, flood or other natural hazards that might be detrimental to the health, safety and general welfare of the residents of the county. Any application for a conditional use or building permit which has, in the opinion of the building official, potential soils, earthquake, flood or other discernable hazards or adverse environmental impacts may be required to provide a report addressing such hazards or impacts. 10-20-2: REQUIREMENTS:
A. Report Preparation: The report shall be prepared by a licensed civil engineer and shall make recommendations for the suitability of the property to accommodate the proposed construction.
B. Special Conditions: Whenever a report indicates a parcel may be subject to potential or actual hazards or impacts, the applicant shall meet the special conditions required by said report and/or the county commission. If such conditions cannot be met, or will not be met, the application shall be denied.
C. Applicability Of Flood Control Ordinance1: All requests for permits in potential flood areas shall be subject to all provisions of the county flood control ordinance.
1. In any area which, in the opinion of the planning or building department, is subject to possible flood hazard, an engineer's report certifying the mitigating measures to be undertaken to remove the building from the flood area. (Ord. 2001-815-O, 12-17-2001, eff. 12-17-2001)
2. The engineering report shall be reviewed and approved by the building department and by the public works department. (Ord. 2001-815-O, 12-17-2001, eff. 12-17-2001; amd. 2004 Code)
10-20-3: HAZARDOUS WASTE:
No hazardous waste of any type shall be disposed of in the county. Such material shall be transported to sites specifically approved for that purpose. (Ord. 2001-815-O, 12-17-2001, eff. 12-17-2001)
10-20-4: WELL PROTECTION:
